About modification of some legal acts of Ukraine concerning the right to use termination by the parcels of land in case of their assignment for public requirements

The Verkhovna Rada of Ukraine decides:

1. Make changes to such legal acts of Ukraine:

1) in the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, No. 3-4, of Art. 27 with subsequent changes):

a) in Article 102-1:

in part six:

state Item 3 in such edition:

"3) alienation of the parcel of land of private property for public requirements or based on social necessity";

add with Item 3-1 of such content:

"3-1) acceptance of the executive authority by authorized body, local government body of the decision on use of the parcel of land of the state-owned or utility property for public requirements";

the seventh to state part in such edition:

"7. Cancellation of the agreement of emphyteusis, superficies of the parcel of land of the state-owned or utility property on the bases determined in Item 3-1 of part six of this Article is performed by rules, the stipulated in Clause 32-1 Law of Ukraine "About lease of land";

b) add Article 122 with part eight of such content:

"8. The parcels of land alienated for public requirements or based on social necessity are provided in use of bodies which made the decision on their redemption for public requirements";

c) to add Article 151 part six Item "in" after words of "the parcel of land (its part)" with words "(except the redemption of the parcel of land (its part) on the bases which allow possibility of its compulsory acquisition based on social necessity)";
