About introduction of amendments to the Law of Ukraine "About securities and the stock market" rather financial monitoring of activities of professional participants of the stock market
The Verkhovna Rada of Ukraine decides:
I. Bring in the Law of Ukraine "About securities and the stock market" (Sheets of the Verkhovna Rada of Ukraine, 2006, No. 31, the Art. 268) such changes:
1. Add Article 16 with parts five and the sixth such content:
"5. Professional participants of the stock market can form separate divisions outside Ukraine in coordination with the National commission on securities and the stock market and in the procedure established by it.
Professional participants of the stock market and their separate divisions, including those which are formed also act in foreign states, shall observe the requirements concerning the organization of financial monitoring established by the legislation of Ukraine in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way and to terrorism financing.
If requirements concerning the organization of financial monitoring contradict the legislation of foreign state in the territory of which the separate division is formed, the professional participant of the stock market shall inform specially authorized body concerning financial monitoring and the National commission on securities and the stock market on impossibility of observance by its separate division of the specified requirements.
6. The professional participant of the stock market in the procedure established by the legislation takes measures concerning restriction of business relations or financial transactions with persons acting in the territory of the states which do not carry out or inadequate image implement recommendations of the international, intergovernmental organizations involved in the field of fight against legalization (washing) of income gained in the criminal way, or terrorism financing".
2. Add Article 27 with part two of such content:
