For the purpose of streamlining of system of selection, acceptance of foreign citizens in educational institutions, research establishments of the republic and training in them the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on training in the Republic of Belarus of foreign citizens.

3. To the Ministry of Education, other ministries and departments of the republic, regional executive committees and the Minsk Gorispolkom under which supervision educational institutions and research establishments are:

increase the responsibility of heads of the specified institutions and organizations for quality of training of foreign citizens, for accomplishment of the legislation of the Republic of Belarus by them, regulations of educational institutions and student residences;

in case of transfer of foreign citizens in educational institutions and research establishments of the republic to provide observance of requirements of the corresponding international agreements and conditions of the signed agreements.

5. To the Ministry of Health and the Ministry of Education for the purpose of increase in efficiency of the medical and sanitary help to the foreign citizens studying in the republic to review the corresponding regulations.

6. To the Ministry of Internal Affairs, the Ministry of Foreign Affairs, the Ministry of Education to take necessary measures for streamlining for the foreign citizens arriving to study to the republic, the passport and visa mode.

Regulations on training in the Republic of Belarus foreign citizens

1. The regulations on training in the Republic of Belarus of foreign citizens (further - the Provision) determine procedure for training of the foreign citizens and stateless persons who are temporarily living in the Republic of Belarus (further - foreign citizens) if other is not provided by international treaties of the Republic of Belarus.

2. Acceptance of foreign citizens for study according to international treaties of the Republic of Belarus, including interdepartmental nature, is made by organizations of education and the scientific organizations in coordination with republican state body under which authority they are, and the organizations providing the higher education - under amount, on the specialties and other indicators determined by republican state body under which authority they are.

3. Acceptance of foreign citizens in organizations of education and the scientific organizations on compensation conditions of training costs is performed on the basis of the agreements signed by these organizations with foreign citizens or their representatives in whom, except the conditions established by the legislation the responsibility of the parties on payment of expenses in case of need of sending the foreign citizen out of limits of the Republic of Belarus is provided.

4. The organization of acceptance and training of foreign citizens is performed by organizations of education and the scientific organizations, control of implementation of these activities - state bodies under which authority these organizations are. The educational and methodical management concerning the organization of training of foreign citizens in all organizations of education, and also control of the organization of acceptance and training of foreign citizens in private educational institutions performs the Ministry of Education of the Republic of Belarus.

5. The foreign citizens who are staying in the Republic of Belarus on legal causes and having the necessary level of the previous education can get the main education of the following levels:

general basic and general secondary education;

vocational training;

secondary vocational education;

the higher education (including bachelor degree and magistracy);

postgraduate education (postgraduate study, graduate military course, assistantship training, doctoral studies) and additional education.

6. Acceptance of foreign citizens in the organizations of education providing general secondary education is performed on general with citizens of the Republic of Belarus the bases.

7. In the organizations of education providing professional, secondary vocational education the foreign citizens having the education corresponding to general basic or general secondary education in the Republic of Belarus are accepted.

8. In the organizations of education providing the higher education the foreign citizens having the education corresponding to general average or secondary vocational education in the Republic of Belarus or to the education necessary for training in magistracy are accepted.

9. For training in specialties of humanitarian and art criticism profile the foreign citizens having the corresponding education and creative capabilities in the chosen area are accepted. At the same time the additional terms of acceptance connected with features of training in these specialties can be established by organizations of education.

10. In postgraduate study of the organizations of education providing the higher education, and the scientific organizations the foreign citizens having the higher education at the level of the master of sciences (arts) are accepted. To the foreign citizen who is not knowing training language, training term in postgraduate study can be prolonged up to 4 years.

11. In postgraduate study of the organizations of education providing the higher education, and the scientific organizations for specialties of medical and veterinary profile the foreign citizens having the corresponding higher education are accepted.

12. In the correspondence postgraduate study the foreign citizens having necessary conditions for carrying out scientific work on the chosen subject of dissertation research in the place of permanent residence are accepted. The graduate student-correspondence student shall represent to organization of education or the scientific organization at least once a year the report on the done work, to undergo certification and to take examinations (offsettings) in the terms established by the individual plan of preparation. Duration of its training is determined by organization of education or the scientific organization.

13. On training in organizations of education and the scientific organizations the foreign citizens having appropriate level of education can be accepted.

14. For advanced training the foreign citizens who are knowing language of training and having the corresponding education are accepted.

15. For studying of languages foreign citizens irrespective of the education level are accepted. The amount of academic load when training in languages shall make at least 20 class periods a week.

16. Issue of education by organization or scientific organization to the foreign citizen of the invitation to training is performed on the basis:

copies of the education document with indication of the studied objects and received in them at examinations of estimates (points) or certificates of the got education for the pupils of senior class assured in accordance with the established procedure;

copies of the certificate of birth, identity document.

The invitation to training is the document of the strict reporting, responsibility for its registration and issue is born by organization of education or the scientific organization.

17. Issue of visas for study is performed by diplomatic representations and consular establishments of the Ministry of Foreign Affairs of the Republic of Belarus according to the legislation of the Republic of Belarus. The organization of education or the scientific organization renders to candidates for training assistance in receipt of the entrance visa.

18. Documents of candidates for training are filed to organizations of education or the scientific organizations on Belarusian, Russian, English, French, Spanish or German prior to training. Their list includes:

the application for admission on training with indication of specialty;

the certificate (document) on education about specifying of the studied objects and received in them at examinations of estimates (points);

the medical certificate about the state of health confirming possibility of training in climatic conditions of the republic and in the relevant organizations of education and the scientific organizations, issued by official organ of health care of the country from which there arrived candidate for study;

the certificate on absence of HIV infection issued by official organ of health care of the country of arrival of the candidate for study;

the copy of the certificate of birth certified in accordance with the established procedure;

the list of the published works (if is available);

6 photos of 4х6 cm in size.

Their transfer on Belarusian or Russian certified notarially at the same time is applied to the documents listed in part one of this Item performed in foreign language.

In case of transition of the foreign citizen to training to other organization of education or the scientific organization its documents go to the place of further training according to the procedure established for citizens of the Republic of Belarus.

19. Foreign citizens are accepted on training to the Republic of Belarus in the presence of the medical certificate about the state of health confirming possibility of training in climatic conditions of the republic and in the relevant organizations of the education and the scientific organizations issued by official organ of health care of the country of arrival of the candidate for study. The foreign citizens arriving to study are enlisted in organizations of education and the scientific organizations after passing of obligatory physical examination in the territorial organization of health care of the Republic of Belarus for the place of training and submission of the medical certificate confirming lack of contraindications to training in the Republic of Belarus.

In case of detection of discrepancy of the medical certificate received outside the Republic of Belarus to results of inspection in the republic the candidate for study shall leave the territory of the Republic of Belarus.

20. Medical attendance of the foreign citizens accepted for study who are subject to compulsory medical insurance according to the legislation is performed in the presence at these citizens of the agreement of compulsory medical insurance signed with the state insurance company of the Republic of Belarus or the agreement of the medical insurance signed with foreign insurance company valid for the territories of the Republic of Belarus and relevant to conditions, stipulated in Item 207 Regulations on insurance activity in the Republic of Belarus, approved by the Presidential decree of the Republic of Belarus of August 25, 2006 No. 530 "About insurance activity" (The national register of legal acts of the Republic of Belarus, 2006, No. 143, 1/7866) if other is not provided by international treaties of the Republic of Belarus.

21. Documents are provided:

on the candidates directed according to international treaties of the Republic of Belarus - in the Ministry of Education of the Republic of Belarus;

on the candidates accepted on training in the agreements signed by organizations of education or the scientific organizations - in the specified organizations or the organizations.

22. Necessary condition of transfer on training is availability of the valid identity document, corresponding visa and agreement of compulsory medical insurance, drawn up according to the procedure, established by the legislation of the Republic of Belarus.

23. Foreign citizens study by curricula and programs of organizations of education or the scientific organizations of the Republic of Belarus. In case of successful completion of training course in foreign citizens diplomas (certificates) of the established samples are issued.

24. The foreign citizens who are not knowing sufficiently training language are enlisted on training courses of organizations of education on which learn language of training and other objects depending on specialty which they intend to receive.

By results of positively passed examinations foreign citizens receive certificates on the termination of preparatory rate and are enlisted on training in the chosen specialty.

The foreign citizens who did not seize on training courses knowledge necessary for training in organizations of education are subject to assignment and shall leave the territory of the Republic of Belarus. In some cases according to the decision of the head of organization of education repeated training of foreign citizens at preparatory rate is allowed.

Transfer on full course of training of the foreign citizens who do not have the certificate on the termination of preparatory rate is possible only in case of confirmation by the commission created by the order of the head of organization of education, knowledge of language of training and appropriate level of the previous education.

25. The foreign citizens studying in organization of education or the scientific organization have the right on:

education according to educational standards;

transfer into training in other specialty or into other form of education according to the procedure, established by the Ministry of Education of the Republic of Belarus;

training in individual curricula within educational standards;

participation in self-government institutions;

creation of associations (associations).

26. The foreign citizens studying in the Republic of Belarus shall:

observe the Constitution of the Republic of Belarus, the legislation of the Republic of Belarus, regulations of organizations of education, the scientific organizations;

carry out orders of management of organizations of education and the scientific organizations;

seize knowledge and skills of the chosen specialty;

attend obligatory studies, carry out in certain terms all types of study provided by the curriculum and programs to timely take examinations and offsettings;

in case of departure out of limits of the Republic of Belarus to get the corresponding permission of organization of education or the scientific organization with document creation in accordance with the established procedure;

timely and in full to bring the financial resources provided by training contracts into accounts of organizations of education and the scientific organizations.

27. The foreign citizens who are not carrying out the obligations specified in Item 26 of this provision are deducted from organizations of education or the scientific organizations and in a month the Republic of Belarus shall leave.

28. The foreign citizens studying in the Republic of Belarus, who committed crimes, administrative and other offenses in the territory of the Republic of Belarus bear responsibility according to the legislation of the Republic of Belarus.

29. Organizations of education and the scientific organizations shall represent to law-enforcement bodies of the information about the foreign citizens accepted on training, deducted, and also transferred for training to other organization of education or the scientific organization.
