About some questions of the termination of lawsuit by the voluntary settlement
For the purpose of ensuring the correct and uniform application of the economic procedural legislation on the voluntary settlement on the cases following from civil legal relationship, the Plenum of Supreme Economic Court of the Republic of Belarus, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges, decides to make the following explanations:
1. According to Articles 63, of 121, of 157, of 171, of 281, of 298, of 317, 365 Economic Procedure Codes of the Republic of Belarus (further - HPK) any dispute arising from civil legal relationship can be stopped by the voluntary settlement at any stage of legal procedure: in economic court of the first instance, including as a result of dispute settlement according to the procedure of mediation without legal proceedings (further - mediation); in economic courts appeal, cassation and supervising instances; in enforcement proceeding.
The lawsuit termination by the voluntary settlement promotes accomplishment of tasks of legal proceedings in economic courts, stipulated in Article 4 HPK, on assistance in formation and enhancement of partner business relations, forming of customs and ethics of business conduct and strengthening of the authority of judicial authority.
