About some questions of storage and waste disposal of production

Based on part three of Item 2 of article 25 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for issue and cancellation of permissions to storage and waste disposal of production, and also suspension of their action.

2. Determine that the permissions to placement of production wastes issued before entry into force of this resolution are effective before the expiration established in them.

3. This resolution becomes effective after its official publication.

The instruction about procedure for issue and cancellation of permissions to storage and waste disposal of production, and also suspension of their action

Chapter 1. General provisions

1. This Instruction about procedure for issue and cancellation of permissions to storage and waste disposal of production, and also suspension of their action is developed according to article 25 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" (The national register of legal acts of the Republic of Belarus, 2007, No. 183, 2/1368) and determines conditions, the bases and procedure for issue and cancellation of permissions to storage of production wastes and permissions to production waste disposal, and also suspensions of their action.

2. For the purposes of this Instruction the following terms and their determinations are established:

applicants are owners of production wastes or the legal entities or individual entrepreneurs performing the address with waste authorized by them;

bodies of issue of permissions - territorial authorities of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus;

permission - permission to production waste disposal, permission to storage of production wastes.

3. Storage of production wastes is allowed only in the authorized storage locations of production wastes.

The authorized storage locations of production wastes are:

the objects of storage of waste determined in permission to storage of production wastes;

the places of temporary storage of production wastes determined in the instruction on the treatment of production wastes for temporary storage of production wastes for the purpose of accumulating of the number of waste necessary for transportation, or for the purpose of neutralization on subjects to neutralization of waste, uses on objects for use of waste.

Storage of production wastes out of the authorized storage locations of production wastes is forbidden, and also:

not on objects of storage of production wastes or not in places of temporary storage of production wastes;

without the permission on storage of production wastes or during suspension of action of such permission;

with violation of procedure for the storage of production wastes established by the Law of the Republic of Belarus "About the address with waste" and other acts of the legislation on the address with waste.

4. Waste disposal of production is allowed only in the authorized places of waste disposal of production.

The authorized places of waste disposal of production are the subjects to waste disposal determined in permission to production waste disposal.

The authorized places of burial of utility production wastes are subjects to waste disposal on which burial of such waste according to the signed service provision agreements on their burial on condition of export of utility production wastes by the specialized utility enterprises is performed.

In the cases specified in part three of this Item, permission to waste disposal of production is not required.

Waste disposal of production out of the authorized places of waste disposal of production is forbidden, and also:

on subjects to waste disposal without the permission on waste disposal of production or during suspension of action of such permission, except as specified, specified in part three of this Item;

with violation of procedure for waste disposal of the production established by the Law of the Republic of Belarus "About the address with waste" and other acts of the legislation on the address with waste.

5. Issue of permissions is made in the location of objects of storage of waste and subjects to waste disposal:

The Minsk city committee of natural resources and environmental protections - to the applicants performing storage of production wastes, waste disposal of production in the city of Minsk;

regional committees of natural resources and environmental protections - to the applicants performing storage of production wastes, production waste disposal in case among the production wastes declared to storage, burial in the territory of the area there is waste of 1-3rd class of danger or total amount of the production wastes which are subject to storage, burial in the territory of the area constitutes over 100 tons per year;

district or city inspections of natural resources and environmental protections - to the applicants performing storage of the production wastes, production waste disposal, except as specified, provided by the paragraph third this Item.

6. In case of lease of buildings, structures, constructions and other objects permission is got by person rendering services in collection, storage, export on placement of the waste which is formed in case of operation of buildings, structures, constructions and other objects.

7. Issue, modification and (or) amendments, action suspension, cancellation of permissions are registered body of issue of permissions:

for permissions to storage of production wastes - in register of permissions to storage of production wastes in form according to appendix 1;

for permissions to production waste disposal - in register of permissions to waste disposal of production in form according to appendix 2.

Storage duration of registers of permissions to storage of production wastes, registers of permissions to production waste disposal - twenty years.

8. Establishment of limits on placement of production wastes to the owner of waste, the other person authorized by it without availability of permission is not allowed.

9. Bodies of issue of permissions monthly represent to owners of subjects to waste disposal, objects of storage of waste or persons performing ownership or use of such objects, the information about owners of production wastes to which permissions for implementation of waste disposal of production, storage of production wastes on these objects are issued.
