About some questions of development of standard rates of formation of production wastes, procedure for their approval and approval

1. Approve the enclosed Instruction about procedure for approval and approval of standard rates of formation of production wastes.

2. Determine that:

2.1. standard rates of formation of production wastes are developed for the production wastes which are subject to burial on subjects to waste disposal and (or) to storage on objects of storage of waste, except as specified, when:

production wastes are the objects which lost fully or partially consumer properties as a result of their consumption, except for their conversions;

production wastes are formed in case of destruction of goods in customs regime of destruction and destruction of the goods turned into the income of the state, and also in case of destruction of tools of fishery of setematerial which cannot be used for trade fishery, and fishery products, delivery costs and which realization exceed its cost, performed according to the Rules of maintaining fishing economy and fishery approved by the Presidential decree of the Republic of Belarus of December 8, 2005 No. 580 "About some measures for increase in efficiency of maintaining hunting economy and fishing activities, enhancement of public administration by them" (The national register of legal acts of the Republic of Belarus, 2005, No. 196, 1/6996);

the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus establish for subordinate (subordinated) it or the organizations which are their part industry standard rates of formation of production wastes in coordination with the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus;

2.2. standard rates of formation of production wastes are developed on the basis of the data received in case of inventory count of production wastes, and also production schedules, specific expense rates of raw materials and materials, material and raw balance and other normative and technical and technological documentation regulating production, heat and (or) electrical energy, performance of works or rendering services, including indicators of formation of production wastes of some engineering procedures according to appendices 1-4;

2.3. standard rates of formation of production wastes are applied:

for determination of quantitative indices of formation of production wastes for the purpose of accounting of production wastes;

for calculation of number of the waste which is subject to storage and (or) burial in case of receipt of permissions to storage and (or) on production waste disposal in case of establishment of limits of storage and waste disposal of production.

3. This resolution becomes effective since February 2, 2008.

The instruction about procedure for approval and approval of standard rates of formation of production wastes

1. The instruction about procedure for approval and approval of standard rates of formation of production wastes (further - the Instruction) is developed according to article 33 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" (The national register of legal acts of the Republic of Belarus, 2007, No. 183, 2/1368) and determines procedure for approval and approval of standard rates of formation of production wastes.

2. In this Instruction terms and their determinations in the values established in article 1 of the Law of the Republic of Belarus "About the address with waste" and also the following term and its determination are used:

source of formation of production wastes - processing equipment, engineering procedure, structural division (the site, the workshop, etc.) and other object in which there is formation of production wastes.

3. Standard rates of formation of production wastes are developed by producer of production wastes.

4. Standard rates of formation of production wastes are approved with city and district inspections of natural resources and environmental protections, the Minsk city committee of natural resources and environmental protections (further - bodies of approval).

Approval of standard rates of formation of production wastes is made in the bodies of approval which are in the place of formation of production wastes for which standard rates of formation of production wastes are developed.

5. For review standard rates of formation of production wastes producers of production wastes (further - applicants) send to territorial authority of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus the documents specified in Item 34 of the list of the ministerial procedures made by the Ministry of Natural Resources and Environmental Protection and its territorial authorities concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of October 22, 2007 No. 1379 (The national register of legal acts of the Republic of Belarus, 2007, No. 261, 5/26021) (further - the list of ministerial procedures).

6. Bodies of approval perform:

check of completeness and reliability of the documents submitted for review standard rates of formation of production wastes;

approval of standard rates of formation of production wastes or decision making about refusal in their approval.

7. Approval of standard rates of formation of production wastes or decision making about refusal in approval is performed in terms, stipulated in Item 34 lists of ministerial procedures.

8. Approval of standard rates of formation of production wastes is made by means of filling of approval of approval signature stamp with body on the title page constituted in form according to appendix to this Instruction.

9. Approval of standard rates of formation of production wastes is made for the term of five years.

The term of approval of standard rates of formation of production wastes is estimated from the date specified in approval signature stamp on the title page.

10. The refusal of body of approval in approval of standard rates of formation of production wastes is made in cases:

non-presentations of all documents, stipulated in Item 34 lists of ministerial procedures;

availability in the submitted documents of the applicant of false information;

availability in calculations of standard rates of formation of production wastes of mistakes;

non-compliance with production wastes by the producer in case of development of standard rates of formation of production wastes of the requirement about separation of waste by types.

11. The refusal of body of approval in approval of standard rates of formation of production wastes is drawn up in writing with indication of causes of failure and the reference to acts of the legislation of the Republic of Belarus and goes to the applicant.
