About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. In 3-month time from the date of entry into force of this resolution to provide to the Ministry of Industry and Trade of the Russian Federation introduction according to the changes approved by this resolution into standard forms of service provision agreements on provision of codes of marking of the changes providing check of reliability of the goods of data on type of the participant of turnover of goods provided by the producer and method of input of goods in turnover within evaluating producers of the goods which are subject to obligatory marking by means of identification.

3. This resolution becomes effective after 60 days from the date of its official publication.

Changes which are made to acts of the Government of the Russian Federation

1. In Rules of marking of cameras (except movie cameras), the flashlights and lamps flashes means of identification approved by the order of the Government of the Russian Federation of December 31, 2019 No. 1953 "About approval of Rules of marking of cameras (except movie cameras), flashlights and lamps flashes means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning photogoods" (The Russian Federation Code, 2020, No. 2, Art. 195; No. 46, Art. 7295; 2021, No. 3, Art. 594; No. 48, Art. 8066; 2022, No. 43, Art. 7419; 2024, No. 14, Art. 1917; 2026, No. 1, Art. 67):

a) in Item 2:

after the paragraph of the twenty seventh to add with the paragraph of the following content:

"criteria of need of assessment of the actual availability of production" - signs (characteristics) of the producer of photogoods (the third-party producer) specifying availability in information system of monitoring of false information on type of the participant of turnover of photogoods and method of input of photogoods in turnover, revealed following the results of the analysis by the operator of system of information containing in information system of monitoring and the state information systems of federal executive bodies, and other data, available the operator of system for determination of the list of producers of photogoods (third-party producers) on which the decision on evaluating producers is made;";

after the paragraph of the twenty ninth to add with the paragraph of the following content:

"mobile application" - the mobile application used when evaluating producers which opportunity of use is given by the operator of system to producers of photogoods (third-party producers) concerning which assessment of producers is carried out;";

after the paragraph of the thirty second to add with the paragraph of the following content:

"assessment of producers" - the activities of the operator of system directed to confirmation of reliability of the photogoods (the third-party producer) provided by the producer according to these rules of data on type of the participant of turnover of photogoods and method of input of photogoods in turnover and performed by results of systematic collection, processing and the analysis of the data provided by the producer of photogoods (the third-party producer) to information system of monitoring with visit of the actual production site or without visit of the actual production site and also with use of special technical means of remote observation (including mobile application), including with possibility of photographing, audio-and videos;";

after the paragraph of the thirty eighth to add with the paragraph of the following content:

"consent to visit of the actual production site" - the electronic document confirming the consent of the producer of photogoods (the third-party producer) to visit of system of the actual production site of the producer of photogoods by the operator (the third-party producer) and sent by the producer of photogoods (the third-party producer) to the operator of system following the results of consideration of the notification on visit of the actual production site for the purpose of verification of presence of the signs specified in Item 43 (4) these rules;";

after the paragraph of the fortieth to add with the paragraph of the following content:

"the third-party producer" - the legal entity, or accredited branch of the foreign legal entity in the Russian Federation, or the individual entrepreneur who are tax residents of the Russian Federation also perform production (with possibility of input of photogoods in turnover) and transfer of photogoods to the producer of photogoods within contract manufacturing;";

after the paragraph of the forty first to add with the paragraph of the following content:

"the notification on visit of the actual production site" - the electronic document created by the operator of system and sent to the producer of photogoods (the third-party producer) for receipt of consent to visit of the actual production site by one of the methods specified in Item 43 (8) these rules;";

b) in Item 42:

in paragraph one of the word "in case of violation of one of the following requirements" shall be replaced with words "in the following cases";

add with subitems "e" - "з" the following content:

"e) the producer of photogoods (the third-party producer) did not direct in established by paragraph one of Item 43 (6) these rules term the documents and data confirming production availability (including contract manufacturing) and compliance of the producer of photogoods (the third-party producer) to the signs specified in Item 43 (4) these rules, or did not direct in established in the notification on visit of the actual production site according to the paragraph the second Item 43 (6) these rules term consent to visit of the actual production site;

g) concerning the producer of photogoods (the third-party producer) according to Item 43 (7) these rules it is made following the results of evaluating producers the decision on lack of production;

h) the data on method of input of photogoods in turnover specified according to the subitem "b" of Item 41 of these rules do not correspond to the data on type of the participant of turnover of photogoods specified according to Item 14 of General rules of marking of goods.";

c) add with Items 43 (1) - 43(10) following contents:

"43(1). Assessment of producers is carried out:

a) based on the fact of registration of producer of photogoods (the third-party producer) in information system of monitoring - concerning all producers of photogoods (third-party producers) without visit of the actual production site;

b) based on the decision on evaluating producers made by the operator of system according to the paragraph the second Item 43 (2) these rules, - concerning producers of photogoods (third-party producers) on which such decision, with visit of the actual production site is made.

43(2). The producer of photogoods (the third-party producer) is notified by the operator of system on evaluating producers according to the subitem "an" of Item 43 (1) these rules one of the methods specified in Item 43 (8) these rules, within one working day from the date of registration of such producer of photogoods (the third-party producer) in information system of monitoring.

The operator of system makes the decision on evaluating producers based on the analysis by criteria of need of assessment of the actual availability of production on the producer of photogoods (the third-party producer) and sends to producer of photogoods (the third-party producer) on which such decision, the notification on visit of the actual production site within 2 working days from the date of adoption of the specified decision is made.

The operator of system carries out the analysis by criteria of need estimates of the actual availability of production concerning producers of photogoods (third-party producers) on permanent basis.

Criteria of need of assessment of the actual availability of production affirm the operator of system.

The operator of system carries out assessment of producers according to the service provision agreement on provision of codes of marking which is concluded with the participant of turnover of photogoods and which standard form affirms the Ministry of Industry and Trade of the Russian Federation.

43(3). The analysis by criteria of need of assessment of the actual availability of production concerning the producer of photogoods (the third-party producer) is carried out in case of simultaneous availability of the following bases:
