About modification and amendments in some regulatory legal acts of the Republic of Kazakhstan concerning enhancement of regulation of the security market and activities of stock exchange

Board of the Agency of the Republic of Kazakhstan on regulation and development of the DECIDES: financial market

1. Approve the enclosed List of regulatory legal acts of the Republic of Kazakhstan concerning enhancement of regulation of the security market and activities of stock exchange to which changes and additions are made.

2. To provide to department of the security market in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

4. This resolution becomes effective after ten calendar days from the date of its first official publication.

The list of regulatory legal acts of the Republic of Kazakhstan concerning enhancement of regulation of the security market and activities of stock exchange to which changes and additions are made

1. Bring in the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and supervision of the financial market and the financial organizations of September 30, 2005 No. 360 "About requirements to foreign legal entities, and also members of the International financial center "Astana" for membership on the stock exchange" (the following change is registered in the Register of state registration of regulatory legal acts at No. 3916):

the members of the International financial center "Astana" having the corresponding licenses of Committee of the International financial center "Astana" on regulation of financial services on implementation of broker and (or) dealer services;

the foreign legal entity corresponding to one of the given conditions:

1) being the member of the stock exchange which is part of World Federation of the exchanges (The World Federation of Exchanges);

2) it is registered in the state which authorized regulating authority is participant of the Multilateral memorandum of mutual understanding concerning consultations, cooperation and exchange of information of International Organization of Securities Commissions (MMoU IOSCO) or with which authorized body of the Republic of Kazakhstan the bilateral agreement about cooperation and exchange of information in the field of supervision of the security market is signed, and has the current license (permission) granted (issued) by such authorized regulating authority, on implementation of broker, dealer, clearing activities or other professional activity in the security market and (or) digital assets if availability of such license (permission) is provided by the applicable legislation of the country of residence of the foreign organization.".

Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of April 28, 2012 No. 165 "About approval of Requirements to the program technical means and other equipment necessary for implementation of activities in the security market" (it is registered in the Register of state registration of regulatory legal acts at No. 7734) the following changes:

1) availability in the organizational structure of the separate division performing custodial activities;

2) access for employees of the division performing custodial activities to information in system of accounting of the central depositary in the amount necessary for execution of their functional obligations;

3) restriction of access for employees of other divisions of the central depositary to information in the system of accounting of the central depositary relating to activities of the division performing custodial activities.";

"9-1. The custodial contract with the client is signed after acceptance by custodian of the measures for proper check provided by the Law of the Republic of Kazakhstan "About counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction".";
