I ORDER:

1. Bring in the order of the Minister of Ecology and Natural Resources of the Republic of Kazakhstan of November 27, 2023 No. 332 "About approval of Rules of the direction of money by the operator of expanded obligations of producers (importers) who arrived on its bank account from producers and importers for the organization of collection, transportation, preparation for reuse, sorting, processing, conversions, neutralizations and (or) waste recyclings which are formed after loss of consumer properties of products (goods), on which (which) expanded obligations of producers (importers) by payments extend" (it is registered in the Register of state registration of regulatory legal acts at No. 33703) the following of change and amendment:

1) of Item 3 to state the subitem in the following edition:

"1) to the subjects of entrepreneurship performing collection, transportation, conversion and (or) waste recycling of packaging, autocomponents, the electronic electric equipment, lamps by issue of money according to the procedure, provided by the presents to Rules and according to the sizes approved by the order of the Government of the Republic of Kazakhstan of December 29, 2023 No. 1250 "About approval of the amount of money payments of the Operator by the money which arrived on its bank account from producers and importers, to the subjects of entrepreneurship performing collection, transportation, preparation for reuse, sorting, processing, conversion, neutralization and (or) waste recycling, the consumer properties of products (goods) which are formed after loss on which, (which) expanded obligations of producers (importers) extend".

add with subitem 7-1) of the following content:

"7-1) consolidation of owners of property of the apartment apartment house (further – consolidation of owners of property) – the legal entity, the control of object of condominium which is non-profit organization, formed by owners of apartments, non-residential premises of one apartment apartment house, exercising financing it the content and ensuring its safety according to subitem 16-6) of article 2 of the Law of the Republic of Kazakhstan "About the housing relations";

43) the accompanying waste – the waste which is formed as a result of conversion and (or) the waste recyclings which are not finished goods according to production schedules of the Receiver of payments.";

"8. The subject of entrepreneurship performing collection, sorting, transportation and (or) processing, preparation for reuse, conversion, neutralization and (or) waste recycling of packaging (glass, paper and cardboard, polymeric and packagings) in information system 1 chooses the type of activity corresponding to the standard agreement from the combined materials.

The subject of entrepreneurship performing collection, sorting, processing, transportation, preparation for reuse, conversion, neutralization and (or) waste recycling of autocomponents of the electronic and electric equipment and metal packaging (complete cycle) in information system 1 chooses the type of activity corresponding to the standard agreement.

At the same time, for implementation of activities for collection, sorting, transportation, processing, preparation for reuse, conversion, neutralization and (or) utilization of other types of the waste which is formed after loss of consumer properties of products (goods) on which (which) expanded obligations of producers (importers) extend and who are not specified in case of registration, the subject of entrepreneurship needs to conclude with the Operator in information system 1 separate corresponding standard agreement in addition.

For the conclusion of additional standard agreements, registration is performed according to the procedure, provided by these rules.";

"Chapter 2. Organization of collection, transportation, preparation for reuse, sortings, processings, conversions and (or) waste recyclings";

"24. After approval in information system 1 the statement of accession in the established form according to appendix 3 to these rules completed and signed by the subject of entrepreneurship by means of the EDS is created.";

"4) the receipt order of inventories is signed by means of the EDS and drawn up on each flight of the accepted and weighed waste.";

"35. After agreement signature of delivery of waste, according to the established form provided by Explanations with the receiver of payments for preparation for reuse, processing, conversion, neutralization and (or) waste recycling, waste are transported from the main base on production facilities on preparation for reuse, processing, conversion, neutralization and (or) waste recycling, according to Explanations";

"37. For registration in information system 1 transporter provides copies of the following documents:

1) the car driver license confirming the right to control of vehicles of category "C" and (or) "SE" and (or) subcategory of "C1" and (or) subcategory of "C1E";

2) registration certificates of the cargo vehicle participating in transportation of waste, including, trail car and (or) semitrailer truck (in the presence);

3) data on inclusion in the state electronic register of permissions and notifications of authorized body in the field of environmental protection according to article 337 of the Code;

In case of lack of the coupon about acceptance of the notification when transporting waste at the transporter, the coupon about acceptance of the notification of the receiver of payments with which in information system 1 the agreement confirming the civil relations of the driver is signed is provided.

4) the document confirming the employment or civil relations of the driver with the subject of entrepreneurship who received the coupon about acceptance of the notification of subjects of entrepreneurship in the field of waste management (in the presence);

5) the existing documents confirming compulsory insurance of civil responsibility of the driver.

In case of incorrect filling of data or lack of documents in case of registration of the transporter in information system 1, the Operator corrects and attaches such data and documents according to the request of the transporter for changes of data in information system 1.";

"45. The operator considers each report on implementation of activities for collection, sorting and transportation of waste within 15 (fifteen) working days from the date of its signing by the receiver of payments for collection, sorting and transportation of waste in information system 1.

At the same time, confirmation by the Operator of each report on implementation of activities for collection, sorting and transportation of waste and payment for them are performed after consideration and confirmation by the Operator of the report on implementation of activities for preparation for reuse, processing, conversion, neutralization and (or) waste recycling of the receiver of payments to which waste in the accounting period according to Items 74, of 75, of 76, of 77, of 78, of 79 and 80 these rules was realized.

The operator stops consideration of the report on implementation of activities for collection, sorting and transportation of waste for the term of no more than 10 (ten) working days in the following cases:

when implementing request of the relevant information to the receiver of payments for collection, sorting and transportation of waste;

when implementing information request, concerning activities of the receiver of payments for collection, sorting and transportation of waste in authorized body and (or) other state bodies;

when carrying out monitoring of activities and production processes with visit of production facilities on collection, sorting and transportation of waste.";
