Some questions of functioning of Single state electronic system of allowing documents

The Cabinet of Ministers of Ukraine DECIDES:

1. Approve enclosed:

Regulations on Single state electronic system of allowing documents;

Procedure for provision of some electronic public services by means of the single state web portal of electronic services.

2. Determine that:

provision of electronic public services and submission of claims to decisions, actions (failure to act) of body of licensing concerning violation of the law in the field of licensing through Single state electronic system of allowing documents is performed after ensuring technical capability of provision of the corresponding services;

ensuring functioning of the mechanism of accounting, storage and the publication of data on declarations on implementation of economic activity in the conditions of warlike situation with use of single state electronic system of allowing documents is performed step by step taking into account priority of the corresponding types of declarations and technical readiness of their implementation.

3. Make changes to resolutions of the Cabinet of Ministers of Ukraine which are attached.

4. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

5. To the Ministry of Economics, the environment and agricultural industry together with the Ministry of digital transformation:

1) within two months from the date of entry into force of this resolution to determine and approve technical requirements on electronic information exchange between the Single state web portal of electronic services and the single state electronic system of allowing documents necessary for submission of declarations on implementation of economic activity;

To provide 2) within 12 months from the date of entry into force of this resolution electronic information exchange between Single state electronic system of allowing documents and:

the integrated system of electronic identification;

The single state web portal of electronic services for the purpose of provision of the electronic public services determined by the Procedure for provision of some electronic public services by means of the single state web portal of electronic services approved by this resolution.

6. To the Ministry of Economics, environment and agricultural industry:

To provide 1) within 12 months from the date of entry into force of this resolution implementation of the technical solutions necessary for the unified and automated mechanism of accounting, storage and the publication of data on declarations on implementation of economic activity in the conditions of warlike situation with use of single state electronic system of allowing documents;

To provide 2) within nine months from the date of entry into force of this resolution realization of technical solutions according to approved according to the subitem 1 of Item 5 of this resolution technical requirements and the directions of the notification to the Ministry of digital transformation on readiness for conducting testing of electronic information exchange;

To inform 3) on the fact of ensuring the technical capability provided by the paragraph the second Item 2 of this resolution within three working days from the date of such fact, by publication of the relevant information on the official website and in single state electronic system of allowing documents.

7. To provide to the ministry of digital transformation:

within 12 months from the date of entry into force of this resolution of implementation of the technical solutions necessary for realization of technical capability of submission of declarations on implementation of economic activity in the conditions of warlike situation means of the single state web portal of electronic services in Single state electronic system of allowing documents;

within three months from the date of, the receipt of the notification provided by the subitem 2 of Item 6 of this resolution following behind day - conducting testing and implementation of electronic information exchange between the Single state web portal of electronic services and single state electronic system of allowing documents.

8. To the Ministry of Health and the Ministry of Economics, the environment and agricultural industry to provide within 12 months from the date of entry into force of this resolution electronic information exchange between Single state electronic system of allowing documents, the Single state web portal of electronic services and the licensed register on implementation of economic activity on medical practice in real time.

9. To provide to the Ministry of Education and Science within two months from the date of entry into force of this resolution together with:

The Ministry of Economics, the environment and agricultural industry electronic information exchange between Single state electronic system of allowing documents and single state electronic base concerning education in real time for receipt of data from the document register on education concerning the education documents issued to physical persons in the amount necessary for verification for information provided through Single state electronic system of allowing documents;

The ministry of digital transformation - electronic information exchange between the Single state web portal of electronic services and single state electronic base concerning education in real time for receipt of data from the document register on education concerning the education documents issued to physical persons in the amount necessary for verification for information provided through the Single state web portal of electronic services.

10. To provide to the Ministry of Justice within two months from the date of entry into force of this resolution together with:

1) the Ministry of Economics, the environment and agricultural industry electronic information exchange between Single state electronic system of allowing documents and:

The Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming in real time for receipt of information necessary for provision of administrative services;

The state register of the corporeal rights to real estate in real time for receipt of data on the registered corporeal rights;

2) the Ministry of digital transformation - electronic information exchange between the Single state web portal of electronic services and:

The Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming in real time for receipt of information necessary for provision of administrative services;

The state register of the corporeal rights to real estate in real time for receipt of data on the registered corporeal rights.

11. To the Ministry of Economics, the environment and agricultural industry together with the Office of the National Security and Defense Council to provide within two months from the date of entry into force of this resolution electronic information exchange between Single state electronic system of allowing documents and the State register of sanctions in real time for receipt of data from the state register of sanctions on application against physical persons and legal entities of special economic and other rationing measures according to the Law of Ukraine "About sanctions".

12. Provide to the Ministry of Internal Affairs within 12 months from the date of entry into force of this resolution electronic information exchange between the Single state web portal of electronic services and unified information system of the Ministry of Internal Affairs for receipt of data:

1) about the document, confirmatory that the persons having or having access to the work connected with drug trafficking, psychotropic substances and precursors have no criminal record which is not removed or not extinguished in accordance with the established procedure for making of not heavy, heavy and especially serious crime or for the criminal offense connected with drug trafficking, the psychotropic substances and precursors including made outside Ukraine;

2) in real time about permissions of National police to use of the objects and rooms intended for implementation of activities for drug trafficking, psychotropic substances and precursors.

13. To public service on medicines and control of drugs:

1) together with the Ministry of Economics, the environment and agricultural industry to provide within two months from the date of entry into force of this resolution (if technically possible) electronic information exchange in real time between Single state electronic system of allowing documents and:

Single state web portal of electronic services;

electronic information system of accounting of the grown-up hemp plants for the medical purposes, movement of such plants, products of their conversion, vegetable substance of cannabis, the made (made) from them medicines at all stages of the address;

To provide 2) within two months from the date of entry into force of this resolution filling of Single state electronic system of allowing documents with data on licensing of economic activity on cultivation of the plants (except hemp for the industrial purposes determined by the Law of Ukraine "About drugs, psychotropic substances and precursors") included in the table I of the List of drugs, psychotropic substances and precursors approved by the resolution of the Cabinet of Ministers of Ukraine of May 6, 2000 No. 770 (The Official Bulletin of Ukraine, 2000, No. 19, the Art. 789), development, production, production, storage, transportation, acquisition, realization (leave), import to the territory of Ukraine, export from the territory of Ukraine, use, destruction of the drugs, psychotropic substances and precursors included in the specified list which shall contain in the licensed register according to procedure for forming and maintaining the licensed register approved by the resolution of the Cabinet of Ministers of Ukraine of August 26, 2020 No. 755.

14. To provide to the public treasurer service within 12 months from the date of entry into force of this resolution electronic information exchange between Single state electronic system of allowing documents, the Single state web portal of electronic services and information system of the Public treasurer service for receipt of data on introduction of payment for issue of licenses, for expansion of implementation of the corresponding type of economic activity.

15. Provide to national police:

within two months from the date of entry into force of this resolution filling of unified information system of the Ministry of Internal Affairs information on permissions to use of the objects and rooms intended for implementation of activities for drug trafficking, psychotropic substances and precursors;

regular filling of the specified system new information in day of receipt.

16. To provide to the state agency of tourism development within 12 months from the date of entry into force of this resolution filling of Single state electronic system of allowing documents with data on licensing of economic activity on tour operator activities which shall contain in the licensed register according to procedure for forming and maintaining the licensed register approved by the resolution of the Cabinet of Ministers of Ukraine of August 26, 2020 No. 755 (The Official Bulletin of Ukraine, 2020, No. 71, of the Art. 2269).

17. And consumer protections to provide to public service on safety issues of foodstuff filling within two months from the date of entry into force of this resolution of Single state electronic system of allowing documents with data on licensing of economic activity on veterinary practice which shall contain in the licensed register according to procedure for forming and maintaining the licensed register approved by the resolution of the Cabinet of Ministers of Ukraine of August 26, 2020 No. 755.

Regulations on single state electronic system of allowing documents

General part

1. This Provision determines the main objectives, functionality, structure of Single state electronic system of allowing documents and procedure for provision of public services in such system.

2. In this Provision terms are used in the following value:

1) the allowing documents licenses, documents of allowing nature, other documents which are result of provision public (electronic public) services, or are represented (are drawn up) by the subject of managing for acquisition of right to implementation of economic activity;

2) electronic public service (further - service) - action of public authority, local government body, the legal entities irrespective of form of business who are in their management including administrative service (including in the automatic mode) as a result of which are acquired, are passed, the rights stop and/or obligations by the subject of managing with use of means of the Single state web portal of electronic services (further - Portal Дія) in connection with implementation of economic activity by it are performed;

3) electronic office of the user - further - electronic office) - the personal web page of the user by means of which according to the rights of authorization consideration and processing of the electronic documents submitted by subjects of managing by means of Portal Дія, making of other actions connected with provision of services, maintaining public electronic registers of public authorities, local government bodies, legal entities of the public law is performed (further - public electronic registers), the register of consideration of claims of license applicants, licensees to decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing (further - the register of consideration of claims);

4) Single state electronic system of allowing documents (further - system erazresheniye) - the information and communication system providing creation, viewing, sending, acceptance, collection, introduction, accumulating, processing, use, consideration, storage, protection, accounting and provision of information on allowing documents, maintaining public electronic registers, the register of consideration of claims and also provides electronic interaction between subjects of managing and public authorities, local government bodies, legal entities of the public law, their officials for the purpose of provision of services;

5) users of system erazresheny (further - users) - officials of public authorities, local government bodies and other subjects of provision of services who underwent the procedure of electronic identification and authentication and got access to electronic office;

6) the module of maintaining public electronic registers - system component the erazresheniye providing maintaining, accounting, accumulating, processing, updating, storage and display of information of public electronic registers;

7) the module of maintaining the register of consideration of claims - system component erazresheny, the providing collection, accumulating, protection, accounting, reflection, processing of data and provision of register information on the license applicant, the licensee making the complaint to the decision, actions (failure to act) of body of licensing concerning violation of the law in the field of licensing in Expert and Appeal council on questions of licensing; content and consideration of the claim;

8) the portal of system erazresheniye - system component erazresheny with open access which provides access for users to electronic office; promulgation of information on the services provided with use of system erazresheny; open access of physical persons and legal entities to data of public electronic registers and the register of consideration of claims, except information with limited access according to the law; search and viewing of information and the documents promulgated in system erazresheniye; possibility of submission of the notification on any failures, mistakes or violations in system operation erazresheniye;

9) register document number in system erazresheniye - invariable unique alphanumeric designation which is appropriated automatically to the document in case of its registration in system erazresheniye;

10) the technical administrator of system is erazresheniye - the state company "Tsifrovoye" (his legal successor), functions on management of which are performed by Ministry of Economics.

4. The owner of system is the erazresheniye and exclusive property rights on its software the state on behalf of Ministry of Economics.

The owner of information of system is the erazresheniye of Ministry of Economics.

Owners of information containing in public electronic registers, the register of consideration of the claims which are kept in system erazresheniye are the executive bodies conducting them.

5. The system erazresheniye is conducted in state language and functions in the round-the-clock mode, except carrying out planned and unplanned scheduled and/or technical maintenance which duration of carrying out is determined by the technical administrator.

6. The system erazresheniye is conducted with observance of requirements of the Law of Ukraine "About personal data protection". Processing and personal data protection, other data and information containing in system erazresheniye is performed according to requirements of the laws of Ukraine "About information security in information and communication systems", "About personal data protection", "About public electronic registers".

7. Data, the issued allowing documents containing in system erazresheniye are used for confirmation of availability at subjects of managing of the relevant allowing documents.

8. Provision of services and maintaining public electronic registers in system erazresheniye is performed according to the procedure, established by the legislation.

9. Financing of works on development, implementation, administration, technical maintenance and functioning of system erazresheny, and also actions for creation and ensuring technical information security is performed due to budget settings of the main managers of the budgetary funds established by the Law on the Government budget of Ukraine for the corresponding year, means of the international technical and/or returnable or irretrievable financial aid of the international organizations, and also other sources which are not prohibited by the legislation.

Structure of system erazresheny and its interaction with national electronic information resource, other information and communication systems

10. The system erazresheniye consists of the following components:

portal of system erazresheny;

module of maintaining public electronic registers;

module of maintaining register of consideration of claims;

electronic office.

11. The system erazresheniye provides compatibility and electronic information exchange with national electronic information resource when rendering services, including:

1) the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming;

2) State register of the corporeal rights to real estate;

3) Single state electronic base concerning education;

4) the integrated system of electronic identification;

5) Portal Дія;

6) information system of Treasury;

7) State register of sanctions;

8) Single ecological platform "Ecosystem".

12. Electronic information exchange between system erazresheniye and national electronic information resource is performed gratuitously by means of system of electronic interaction of the state electronic information Trembita resources with observance of requirements of the Laws of Ukraine "About electronic identification and electronic confidential services", "About personal data protection", "About public electronic registers", "About information security in information and communication systems".

In case of lack of technical capability of data transmission electronic information exchange can be performed by means of system of electronic interaction of the state electronic information Trembita resources with use of other information and communication systems with observance of requirements for information security according to the Law of Ukraine "About information security in information and communication systems".

Electronic (technical and information) interaction between the public electronic registers which are kept in system erazresheniye is performed by system software erazresheniye.

13. Electronic information exchange of system erazresheny with national electronic information resource, other information and communication systems is performed in real time for the purpose of the obtaining and data transmission necessary for accomplishment by subjects of electronic interaction of the powers, stipulated by the legislation, during provision of services, maintaining public electronic registers, including by the automated filling of statements, verification of information about subjects of managing and confirmation of their compliance to the requirements established by the legislation.

The amount and structure of data which subjects of electronic interaction via program interfaces of electronic information resources exchange (services) are determined by the agreements on information exchange signed according to procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606 "Some questions of electronic interaction of electronic information resources" (The Official Bulletin of Ukraine, 2016, No. 73, Art. 2455; 2021, No. 52, Art. 3216; 2023, No. 11, Art. 721).

Main objectives of system erazresheny

14. The system erazresheniye carries out the following main objectives:

1) provision of services with use of means of Portal Дія, in particular in the automatic mode, with obtaining and use in case of need information from national electronic information resource, other information and communication systems which is necessary for provision of such services;

2) ensuring electronic interaction between subjects of managing and public authorities, local government bodies, legal entities of the public law, their officials for the purpose of receipt of services;

3) introduction, accumulating, storage and accounting of data on allowing documents irrespective of method of their provision (representation);

4) ensuring forming and maintaining public electronic registers, register of consideration of claims;

5) submission of claims by license applicants, licensees to decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing, providing the applicant with information on condition of consideration and results of consideration of the claim;
