About introduction of amendments to some orders of the Ministry of Foreign Affairs of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Ministry of Foreign Affairs of the Republic of Kazakhstan to which changes are made.

2. To provide to department of digitalization of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Foreign Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the chief of staff of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Bring in the order of the acting minister of foreign affairs of the Republic of Kazakhstan of April 3, 2015 No. 11-1-2/130 "About approval of Rules of registration in the Ministry of Foreign Affairs of the Republic of Kazakhstan and implementation by foreign institutions of the Republic of Kazakhstan of control of the children who are the citizens of the Republic of Kazakhstan transferred to adoption to foreign citizens" (it is registered in the Register of state registration of regulatory legal acts at No. 11240) the following changes:

"According to the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services", Item 53 of the Consular charter of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of April 25, 2016 No. 240, the subitem 163) of Item 15 of the Provision of the Ministry of Foreign Affairs of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1118, and Item 41 of Rules of transfer of the children who are citizens of the Republic of Kazakhstan on adoption No. approved by the order of the Government of the Republic of Kazakhstan of March 30, 2012 380, I ORDER:";

in the Rules of registration in the Ministry of Foreign Affairs of the Republic of Kazakhstan and implementation by foreign institutions of the Republic of Kazakhstan of control of the children who are the citizens of the Republic of Kazakhstan transferred to adoption to foreign citizens approved by the specified order:

the second Item 2 to state part in the following edition:

"The list of the main requirements to rendering the state Service "Registration of the Children Who Are Citizens of the Republic of Kazakhstan, Transferred to Adoption (Adoption) to Foreign Citizens" (further – the state service) including data taking into account features of provision of the state service is given in appendix 2-1 to these rules.";

state Item 3 in the following edition:

"3. In cases of detection of mistakes or inaccuracies in the statement and (or) documents submitted by uslugopoluchatel, their discrepancies to requirements for form and content, the representations by uslugopoluchatel of incomplete document package specified in Item 9 of the List, the service provider adopts the statement by means of the digital waiting list and issues the corresponding receipt (in any form).

The documents submitted by uslugopoluchatel (including originals) are subject to return to uslugopoluchatel without their acceptance on storage by the service provider, except as specified filing of application and (or) documents by means of the web portal of "the digital government", the stationary subscriber structure, the subscriber structure of cellular communication, and also other digital objects determined by the central state bodies.

"4-1. The refusal in rendering the state service is performed on the bases, the main requirements to rendering the state service specified in Item 10 of the List.

In case of refusal in rendering the state service hearing with uslugopoluchatel is not carried out.";

"6. The information about the registered children is registered on accounting of children in form according to appendix 5 to these rules with the subsequent obligatory entering into the Single Golden eagle digital system (further – ETsS "Golden eagle")".;

state Item 6-1 in the following edition:

"6-1. According to the subitem 11) of Item 2 of article 5 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further – the Law on the state and socially responsible services) the Ministry provides entering of data into digital monitoring system of rendering the state services on stage of rendering the state service.";

"The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law on the state and socially responsible services, is subject to consideration within five working days from the date of its registration.";

In case of receipt of the notification on change of the residence of the child within one consular district, the consular official of foreign institution makes record about change of the residence in the magazine on accounting of children with the subsequent obligatory entering into ETsS "Golden eagle".";

"2) the web portal of "the digital government" www.egov.kz (further – the Portal) – the digital system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;";

state Item 5 in the following edition:

"5. The request for issue of the petition for receipt of the investor visa to the persons who are nonresidents of the Republic of Kazakhstan and performing investing activities in the territory of the Republic of Kazakhstan (further – the request), moves uslugopoluchatel through the Portal in Committee on investments of the Ministry of Foreign Affairs of the Republic of Kazakhstan (further – the service provider) in form according to appendix 1 to these rules with appendix of the list of documents, stipulated in Item the 9th appendices 2 to these rules.";

state Item 7 in the following edition:

"7. The service provider within 3 (three) working days from the moment of registration of the request performs verification of the submitted documents on compliance to requirements of these rules and makes the decision on issue of the petition in case of compliance to the main requirements to rendering the state service according to appendix 2 to these rules and availability of one of the following conditions:

1) investment physical person of investments into economy of the Republic of Kazakhstan on the amount of equivalent 300 (three hundred) thousand US dollars or more the last 12 (twelve) months prior to date of application;

2) membership of uslugopoluchatel in Council of foreign investors in case of the President of the Republic of Kazakhstan;

3) availability at uslugopoluchatel of the investment contract signed with authorized body on investments;

4) availability at uslugopoluchatel of recommendations of the state bodies or subjects of the quasi-public sector confirming realization by uslugopoluchatel of the investment project in the territory of the Republic of Kazakhstan.

In the presence of the condition specified in the subitem 1) of this Item, the petition is issued for up to 10 (ten) years.

In the presence of one of the conditions specified in subitems 2) and 3) of this Item, the petition is issued for up to 5 (five) years.

In the presence of the condition specified in the subitem 4) of this Item, the petition is issued for up to 3 (three) years.

"12. In case of failure of the digital system containing necessary data for rendering the state service, the service provider within one working day notifies the operator of digital infrastructure of "the digital government" (further – the operator).";

state Item 13 in the following edition:

"13. The service provider refuses rendering the state service in the bases, stipulated in Item the 10th appendices 2 to these rules.

In case of refusal in rendering the state service hearing with uslugopoluchatel is not carried out.";

state Item 15 in the following edition:

"15. The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law on the state and socially responsible services is subject to consideration within five working days from the date of its registration.";
