About modification of some regulations (reform "Perezapusk in education")

The Parliament adopts this organic law.

Art. I. - In the Code of the Republic of Moldova about education No. 152/2014 (Official monitor of the Republic of Moldova, 2014, Art. No. 319-324, 634), with subsequent changes, to make the following changes:

1. In Article 3:

after the concept "equivalent education document" to add with concept of the following content:

"territorial agency of education - the administrative authority subordinated to the Ministry of Education and Research having territorial subdivisions in the structure and performing the powers provided by this code concerning public organizations of primary, gymnasia, lyceum and vocational education, and in ATO Gagauzia - the administrative authority created by People's Assembly and subordinated to it, performing the powers provided by this code;";

after the concept "education system" to add with concept of the following content:

"system of video surveillance - set of the equipment and the software used for obtaining, the transfers, storage and viewing of images of persons established and used by educational institution for the purpose of safety of children, pupils, personnel and property;".

2. Part (Article 13 to add 3) with the offer of the following content: "Territorial agencies of education perform coordinating and check of providing scope of children with compulsory education at the local level.".

3. In Article 18:

parts (5) and (to state 6) in the following edition:

"(5) Territorial agencies of education are created by the Government according to the offer of the Ministry of Education and Research, and in ATO Gagauzia the Territorial agency of education is created by People's Assembly.

(6) the Name, extreme number, standard structure and standard regulations on the organization and functioning of territorial agencies of education affirm the Government according to the offer of the Ministry of Education and Research. The structure, the list of educational institutions concerning which the relevant territorial agency of education acts as the founder both regulations on the organization and functioning of each territorial agency of education affirm the Ministry of Education and Research. "a) in the general education:

- at the territorial level - territorial agency of education concerning public organizations of primary, gymnasia, lyceum and vocational education, and concerning public organizations of early education - within the powers on methodical coordination and institutional support provided by this code;

- at the local level - the founder or competent authority of local public authority concerning public organizations of early education and public organizations of out-of-school education;

- at the institutional level - managers of educational institutions;";

add Article with part (1-1) following contents:

"(1-1) Organa of local public authority of the first and second levels perform at the local level of power in the field of preschool and out-of-school education according to provisions of this Code directly or, on circumstances, through structural divisions.".

4. In part (Article 20 of the word to "industry local body in the field of education" shall be replaced with words 7) to "territorial agency of education".

5. In Article 21:

Public organizations of primary, gymnasia and lyceum education are created, will be reorganized and liquidated by territorial agencies of education in the presence of pre-trial detention or according to the decision of the Ministry of Education and Research. Bodies of local public authority shall promote proper functioning of organizations in the subordinated territory according to the provisions and standards approved by the Ministry of Education and Research.";

add Article with part (1-1) following contents:

"(1-1) Decisions of bodies of local public authority of the second level and ATO Gagauzia about reorganization or liquidation of organizations of additional out-of-school art education - schools of arts (musical, theatrical, the fine arts, dancing, etc.) are accepted in the presence of the advisory proceeding of the Ministry of Culture for the purpose of impact assessment on art education and access for citizens to culture.";

part (to state 2) in the following edition:

"(2) Organa of local public authority of the first level, being founders of educational institutions, school districts for each public organization of preschool education shall establish.";

add Article with part (2-1) following of content:

"(2-1) Territorial agencies of education after consultations with bodies of local public authority establish school districts for each public organization of primary and/or gymnasia education.";

part (to state 3) in the following edition:

"(3) Public organizations of vocational education are created, will be reorganized and are liquidated by territorial agencies of education in the presence of pre-trial detention of the Ministry of Education and Research, and in ATO Gagauzia - bodies of local public authority of ATO Gagauzia in the presence of pre-trial detention or according to the decision of the Ministry of Education and Research.";
