About determination of unused excess of military assets and procedures of transfer of property on it or rights to use by it
The Parliament adopts this organic law.
(1) This law establishes the legal base of determination of unused excess of military assets, and also procedure for transfer of property on it or rights to use by it.
(2) the Purpose of this law is providing the single, transparent and controlled mechanism of determination and transfer of unused excess of military assets.
(1) This law governs the legal relations connected with process of determination of unused excess of military assets, and also procedures of transfer of property on it or rights to use by it, the performed bodies of the public power as a part of the forces intended for ensuring national defense, established by part (3) article 9 of the Law on national defense No. 345/2003 (further - the bodies of the public power owning military assets), and other competent authorities of the public power according to this law.
(2) the Transfer of property on unused excess of military assets or right to use is performed by it according to provisions of this law.
For the purposes of this law the following concepts are used:
1) military assets - the property intended for accomplishment of tasks of national defense, which is in ownership of forces intended for ensuring national defense including arms, ammunition, military devices, military equipment and products of dual purpose;
2) unused excess of military assets (further also - unused excess) - military assets which, according to assessment of the bodies of the public power owning military assets are not necessary any more and/or cannot be used for accomplishment of tasks and for operational needs of forces intended for ensuring national defense.
