About national defense
The Parliament adopts this organic law.
Art. 1. - (1) This law establishes structure of national system of defense, basis of the organization and ensuring defense of the country, power and responsibility of bodies of the public power in the field of defense, management, the organization, purpose of forces of national system of defense and planning of national defense.
(2) Operation of this law extends to the bodies of the public power, forces intended for ensuring national defense, public organizations, business entities irrespective of type of property and citizens of the Republic of Moldova.
(3) National defense belongs to the most important functions of the state and is case of all people.
Art. 2. - For the purpose of this law the following concepts are determined:
national defense - set of the actions and actions taken and held by the Republic of Moldova for the purpose of guaranteeing sovereignty, independence and unity of the state, territorial integrity of the country and the constitutional democracy;
national system of defense – management, set of forces, means and elements of infrastructure, and also set of the actions intended for ensuring defense of the country;
the armed aggression - use of military force by one state against sovereignty, territorial integrity or political independence of other state or in any manner, incompatible with Articles of organization of the United Nations;
transaction - set of the military operations conducted by military connections according to unified plan for achievement of operational or strategic objectives;
defensive actions - the main form of fighting aiming to complicate offensive actions of the opponent, to put perhaps more notable losses it is reliable to hold entrusted positions, to win time and to create necessary conditions for transition to offensive military operations for the purpose of release of the occupied territory;
military connection - the tactical or operational group of troops from constant, as a rule, the organization having forces and means of several or one types of military forces with firmly established tactical or operational density;
military unit - permanent group of the military personnel with such established organization and equipment which allow to hold all events for combat training, having own governing bodies and logistic support, capable to carry out fighting tasks with certain degree of independence.
Art. 3. - The legal base of national defense is constituted by the Constitution of the Republic of Moldova, the Strategy of national security, the National strategy of defense and the Military strategy, the Military doctrine of the Republic of Moldova, this law, other regulations of the Republic of Moldova, and also the universally recognized norms of international law.
Art. 4. - The organization of national defense includes:
a) determination of defense policy and basic principles of military construction;
b) approval of strategy of homeland security, national strategy of defense and military strategy;
c) development of military science and military art;
d) creation of the regulatory base of national defense;
e) the analysis of military-political provision, forecasting of risks and threats of military nature to homeland security;
f) determination of priority national interests in the field of national defense, determination of complex of political and diplomatic and other measures of not military nature, creation of favorable international situation for the purpose of ensuring national defense;
g) preparation of forces intended for ensuring national defense, maintenance of high level of combat and mobilization readiness;
