About modification of some regulations

This law partially shifts Article 3 of the Directive of the European parliament and Council 2011/24/EU of March 9, 2011 about the rights of patients in case of cross-border medical attendance, published in the Official magazine of the European Union by L 88 of April 4, 2011, CELEX: 32011L0024, taking into account the last changes made by the Directive of the European parliament and Council (EU) 2024/2839 of October 23, 2024.
Art. I. - Chapter I of the Law on health protection No. 411/1995 (1995, No. 34, Art. 373), with subsequent changes, to add the official monitor of the Republic of Moldova with Articles 7-1 and 7-2 of the following content:
"Article 7-1. Assessment of medical technologies
(1) for the purposes of this Article the following concepts are used:
medical technology - medicine, medical product or medical and surgical procedures, and also the measures for prevention, diagnostics or treatment of diseases applied in the field of medical attendance;
assessment of medical technologies - cross-disciplinary process of systematic, transparent, objective and comprehensive generalization of information on the medical, social and economic, ethical and connected with patients aspects of use of medical technology;
joint clinical assessment - the clinical assessment of medical technology which is carried out at the European Union level which consists in comparative analysis of the available clinical data on its efficiency and safety in comparison with one or several existing medical technologies or procedures and contains the description of the disease which is subject to treatment and the current use of other medical technologies, technical characteristic of medical technology, and also assessment of its relative clinical efficiency and relative safety.
(2) Process of assessment of medical technologies provides the technical procedure of examination of medical technology and joint assessment procedure, including on circumstances the procedure of negotiation about financing terms, with the publication of the order of the Minister of Health according to the provision approved by the Government.
