The purpose of this Constitutional Law is determination of the status of the International center of digital technologies (further - the Center) as the separate territory and the special legal regime operating in the territory of the Center.
This Constitutional Law sets special legal regime in the following spheres:
creation, testing and implementation of innovations, services and products within "Regulatory sandbox";
implementation of the business activity directed to investment attraction to the sphere of digital technologies and stimulation of occupation by export activities in this sphere;
the relations in the field of the civil, corporate and commercial law;
civil and economic procedural relations;
customs affairs and taxation;
employment relationships;
financial and banking activity, implementation of currency transactions;
data protection, processing and personal data protection;
rendering the state services;
protection of intellectual property.
In the territory of the Center the special legislation in the following the procedure for priority established by this Article is effective:
Constitution of the Republic of Uzbekistan;
this Constitutional Law;
the decrees and resolutions of the President of the Republic of Uzbekistan accepted according to this Constitutional Law concerning creation, start (activation) of activities, change of borders, strategic management of the Center, appointment of the main officials and also on other questions which are directly relating to powers of the President of the Republic of Uzbekistan in this Constitutional Law;
the decisions of the Center made on the basis and according to this Constitutional Law, regulating the questions entering its jurisdiction (further - solutions of the Center);
in necessary cases, on condition of not contradiction of the Constitution of the Republic of Uzbekistan, to this Constitutional Law and solutions of the Center, - the principles and common law rules and equity law of England and Wales;
the acts of the legislation of the Republic of Uzbekistan applied in the part which is not settled by this Constitutional Law and solutions of the Center, and also not contradicting them.
The procedure for development, registration, enforcement, publication of solutions of the Center, introduction of changes in them and amendments, their cancellation, and also suspension and the termination of their action is determined by solutions of Board of governors.
In the territory of the Center the obligations following from international treaties of the Republic of Uzbekistan and the following acts of the legislation are applied:
Constitution of the Republic of Uzbekistan;
the penal and criminal procedure legislation according to provisions of article 7 of this Constitutional Law;
the legislation on the administrative responsibility according to provisions of article 6 of this Constitutional Law;
the legislation on homeland security, defense, counteraction of legalization of income gained from criminal activities, to financing of terrorism and financing of distribution of weapons of mass destruction, immigration control, family, environmental protection, emergency state, sanitary and epidemiologic wellbeing and protection of public health;
the legislation connected with forced execution of court resolutions and acts of other bodies;
The constitutional Law of the Republic of Uzbekistan "About the Tashkent international financial center" and the applicable law specified in article 8 of this Law - concerning activities and services rendered by members of the Tashkent international financial center in the territory of the Center;
other acts of the legislation if their application is directly provided by this Constitutional Law or solutions of the Center.
The international agreements ratified by the Republic of Uzbekistan are applied in the territory of the Center in that measure in what they are subject to direct application concerning subjects of the Center.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are provided by the special legislation of the Center are applied rules of the international treaty.
In the territory of the Center the decisions of the Center made within its jurisdiction prevail over any regulatory legal acts contradicting these decisions, except for Constitutions of the Republic of Uzbekistan, this Constitutional Law and international treaties ratified by the Republic of Uzbekistan.
In addition to requirements for counteraction of legalization of income gained from criminal activities, to financing of terrorism and the distribution of weapons of mass destruction established by the acts of the legislation of the Republic of Uzbekistan specified in paragraph five of part three of this Article, by solutions of the Center concerning subjects of the Center additional or expanded requirements can be established.
Except as specified, the provided by part three of this Article, relevant legislation of the Republic of Uzbekistan or administrative acts of any state body or department on the questions entering jurisdiction of the Center according to this Constitutional Law and solutions of the Center are not effective concerning subjects of the Center, except for the particular cases which are directly provided in this Constitutional Law or solutions of the Center.
In this Constitutional Law the following basic concepts are applied:
members of the Center are residents and investors of the Center;
subjects of the Center - bodies of the Center, participants and their workers, and also accredited partners;
special legal regime - set of the precepts of law determined in the special legislation, establishing special conditions of regulation of the public relations and existing in the territory of the Center concerning his subjects;
"Regulatory sandbox" - the experimental and legal environment created in the territory of the Center for development, testing and implementation of innovative technologies, products and services.
The special legal regime established by this Constitutional Law is effective till 2100.
The special legal regime is applied to the types of activity approved by Board of governors.
For the purpose of protection of interests of the Republic of Uzbekistan and prevention of safety hazards Board of governors has the right to set restrictions for use of special legal regime on certain subjects of the Center.
The relations between bodies of the Center and other subjects are based on the agreements signed between them.
Opportunities, the preferences and privileges provided within special legal regime are guaranteed, and deterioration in conditions of their application or early termination of their action is not allowed.
The special legal regime acts on the territory of the Center within the borders determined by the President of the Republic of Uzbekistan.
In cases when members of the Center have need of implementation of the projects outside the Center, the special legal regime can act also on this territory if the territory in which these projects are implemented is recognized as the production territory.
