I.O'S ORDER. MINISTER OF TRANSPORT OF THE REPUBLIC OF KAZAKHSTAN

About modification and amendments in the order of the acting minister on investments and development of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan" and in the order of the acting minister of transport and communications of the Republic of Kazakhstan of May 16, 2011 No. 279 "About approval of the Instruction on the organization and servicing of air traffic"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 15852) the following changes and amendments:

in Rules of production of the flights in civil aviation of the Republic of Kazakhstan approved by the specified order:

in Item 2:

add with subitem 9-1) of the following content:

"9-1) current plan of flight (CPL) - flight plan which reflects the possible changes in the provided flight plan caused by the subsequent dispatching permissions of Department of Internal Affairs;";

add with subitem 12-3) of the following content:

"12-3) preliminary plan of flight (PFP) - information on flight provided by the operator or the appointed representative for carrying out collaborative planning of flight before representation of flight plan;";

add with subitem 49-1) of the following content:

"49-1) provided flight plan (FPL or eFPL) - the last flight plan provided by the pilot, the operator or his authorized representative for use by bodies of Department of Internal Affairs;";

127) and 128) to state subitems in the following edition:

"127) mountain airfield (HEA) - airfield with exceeding of 2450 m (the 8000th foot) or more;

128) the mountainous area - the area with the changing area profile where change of exceeding of the area within km 18,5 distance (mile m 10,0) constitutes more than 900 m (the 3000th foot);";

129) to exclude the subitem;

131) to state the subitem in the following edition:

"131) the area hilly - the area with the crossed relief and relative excesses from 200 m (the 650th foot) to 900 m (the 3000th foot) in radius of 18.5 km;";

state subitem 138-1) in the following edition:

"138-1) production of flights with the increased leaving time for reserve airfield (EDTO) - any flights of the airplane with two or more gas turbine engines when flight time to reserve airfield on route exceeds the threshold time established present by Rules;";

add with subitem 141-1) of the following content:

"141-1) combinations "airplane/engine" (AEC) - the combination of model of the airplane and model of the engine determined for the purposes of certification of flights of EDTO (which is also called approval of standard design and reliability) or EDTO permitted for accomplishment of flights. Certification of specific combination "airplane/engine" (AEC) on EDTO makes sure of the card of data of the certificate of type (CDCT).

Special approval of specific AEC on accomplishment of flights of EDTO makes sure of the operational specification allowing to extend single permission to slightly different modifications of model when from the point of view of configuration and the program of operation they have much in common. In case of the demonstration of compliance necessary for certification of EDTO and/or receipt of permission to flights of EDTO of AF of specific combination "airplane/engine", elements similar with already certified or resolved AEC, such as the reduced models like the airplane or submodel of the propulsion system, namely during the carrying out new certification of EDTO and/or receipt of special permission to flights of EDTO are considered only such distinctions between possible AEC and already certified and/or permitted AEC which have a direct bearing on EDTO which exert direct impact on processes and the EDTO procedures are considered;";

148) to state the subitem in the following edition:

"148) flight plan - the document of the established form containing certain data on the planned flight or part of flight of AF";

add with subitem 181-1) of the following content:

"181-1) reserve airfields when flying EDTO - the reserve airfield specified in dispatching permission or permission to flight and held for use in case of leaving reserve airfield in case of EDTO flight accomplishment it answer the corresponding dispatching minima (meteoconditions and condition of the airfield). This determination belongs to planning of flights and does not limit power of the commander of the aircraft during flight at all;";

the eighty first to state the paragraph to part two of Item 2 in the following edition:

"EDTO - production of flights with the increased leaving time for reserve airfield;";

state Item 19 in the following edition:

"19. All airplanes with the certified take-off weight more:

1) 27 000 kg; or

2) 15 000 kg with passenger capacity more than 19 people and having the certificate of the flight validity which for the first time is issued on January 1, 2027 or after this date, are equipped with means of support of the program of the analysis of flight data.";

add with Item 19-1 of the following content:

"19-1. The operator of the airplane equipped as it is specified in Item 19 of these rules, develops and supports the program of the analysis of flight data as component of its safety management system of flights.";

state Item 52 in the following edition:

"52. The operator provides:

1) finishing to passengers of oral information concerning safety rules which in parts or in full is submitted in the form of audio or video;

2) each passenger cards for passengers with information on operations procedure in emergency environment which in the short illustrated form contain instructions for use of crash equipment, methods of opening of emergency exits and procedure for emergency escape of the airplane by passengers.

Information provided in cards for passengers belongs only to type, model and the AF series on which it is used, corresponds to the specific systems and the equipment, and also the procedures applicable to systems and the equipment installed on it on AF of this type, model and series, according to appendix 25 to these rules;

3) development of procedures of check of placement onboard the correct instructions both withdrawal, and replacements of the damaged instructions onboard AF.

4) specifying in cards for passengers of Date of Introduction in action, number of the edition and audit, and also the reference to appropriate section of RPP approved by authorized organization.";

add with Item 60-2 of the following content:

"60-2. The operator establishes policy and procedures for transportation of products in cargo section which include carrying out special risk assessment for safety of flights.

The risk assessment, at least, provides accounting:

1) the types of danger connected with properties of the products which are subject to transportation;

2) operator's opportunities;

3) operational reasons (area of production of flights, leaving time for reserve airfield);

4) opportunities of the airplane and its systems (opportunities of fire-proof system of cargo sections);

5) characteristics of deduction of content of unit load devices;

6) the aspects concerning packing and packaging sets;

7) aspects of safety of supply chain of the products which are subject to transportation;

8) quantities and distributions of the dangerous goods which are subject to transportation.";

state Item 64 in the following edition:

"64. The operator who is carrying out commercial air transportations, also the operator, operating airplanes with the maximum certified take-off weight more than 5700 kilograms and helicopters with the maximum certified take-off weight more than 3175 kilograms provides availability, approved by authorized organization, MEL and any changes to it which allows KVS to determine possibility of the beginning or continuation of flight from any intermediate point in case of failure of any device, equipment or system.

If the Republic of Kazakhstan is the state of the operator and is not the state of registration of the aircraft, the authorized organization provides that the minimum list of the equipment (MEL) did not influence aircraft compliance to the requirements of the flight validity applicable in the state of registration.";

state Item 66 in the following edition:

"66. MEL is developed for each AF based on the MMEL developed for the AF corresponding type by the organization responsible for standard design, and approved by the state of the AF developer.";

add with Item 66-1 of the following content:

"66-1. In departure from Item 66 of these rules, for the AF separate types for which in case of certification MMEL, MEL was not issued it is developed based on the list of admissible defects containing in RLE provided that the specified list is issued by the organization responsible for standard design, and is approved by the state of the AF developer. In that case the list of admissible defects containing in RLE is recognized the document equivalent to MMEL specified in Item 66 of these rules.";

state Item 67 in the following edition:

"67. The operator within 90 (ninety) calendar days from coming into force of changes in MMEL or the list of the admissible defects containing in RLE concerning the operated AF type makes corresponding changes to MEL and approves them in authorized organization.

The operator develops MEL allowing to operate the aircraft in case of failure of some systems or the equipment on condition of preserving acceptable level of safety.

Availability of MEL does not mean that the aircraft can be operated during the uncertain period of time with idle systems or the equipment.

The basic purpose of MEL is in resolving safe operation of the aircraft with idle systems or the equipment within the controlled and reasonable program of carrying out repair work and replacement of the equipment.";

state Items 69 and 69-1 in the following edition:

"69. The MEL format, statement of its Items and conditions of the admission of the aircraft to accomplishment of flight shall reflect the format, statement of Items and conditions provided by MMEL or the equivalent document:

1) the preamble reflecting content of MMEL or the equivalent document including instructions and determinations for the flight crew and personnel on maintenance using MEL;

2) the status of audit of MMEL based on which MEL, and also the status of audit of MEL is developed;

3) scope, amount and purpose of MEL;

4) the terms and determinations used in MEL;

5) the terms necessary for elimination of failures of the devices, the equipment and systems and also warning and emergency signals;

6) the list of the devices, the equipment and systems specifying refusal, and also warning and emergency signals;

7) the list of devices, the equipment and systems in case of which refusal operation of AF is allowed.

Concerning the specific system or component of the equipment recognized as disabled establishment of procedures of maintenance before accomplishment of flight for the purpose of shutdown or isolation of such system or component will be required. Also development of the corresponding procedure of actions of flight crew will be required.

69-1. Operator:

1) is established by renewal period of working capacity for each idle device, unit of equipment or function specified in MEL. The renewal period of working capacity established in MEL shall not be less strict, than the corresponding renewal period of working capacity established in MMEL or the equivalent document;

2) installs the effective program of maintenance;

3) is operated by AF after the expiration of the renewal period of working capacity established in MEL, only in cases when:

defect is eliminated; or

renewal period of working capacity is prolonged according to Item 69-2 of these rules.";

add with Item 69-2 of the following content:

"69-2. The operator prolongs time frames of MEL for categories B and C, when applicable, according to the procedure of prolongation approved by authorized organization for the term equal to the term established in MEL in case of observance of the following conditions:

1) prolongation of renewal period of working capacity conforms to requirements of MMEL or the equivalent document for the AF this type;

2) the procedure of prolongation, including the description of special obligations and responsibility for controlled prolongation of time frames, is established by the operator in case of development of MEL and affirms authorized organization;

3) the operator performs only single prolongation of the above-stated time frame;

4) the operator notifies authorized organization on each prolongation of time frame in time, not exceeding one month;

5) elimination of defect is performed as soon as possible.";

state Item 71 in the following edition:

"71. In case of determination of possibility of ensuring acceptable level of safety the probability of additional refusals in case of continuation of operation with disabled systems or the equipment shall be considered also. In case of development of MEL variations from the requirements provided in the Section of management on flight operation concerning restrictions, emergency procedures or other requirements of the flight validity of the state of registration or the state of the operator are not allowed if the authorized organization or RLE does not provide other.";

state Items 107 and 108 in the following edition:

"107. Everyone AF equipped with door in cabin of flight crew shall be equipped with system of locking of the door providing its blocking for prevention of unauthorized access to cabin of flight crew including opportunity for flight crew to lock door and to support her in the locked provision from within cabin.
