About introduction of amendments to some laws of Ukraine of rather state support of cinematography in Ukraine

The Verkhovna Rada of Ukraine DECIDES:

I. Make changes to the following laws of Ukraine:

1. In the Law of Ukraine "About cinematography" (Sheets of the Verkhovna Rada of Ukraine, 1998, No. 22, Art. 114 with the following changes):

1) in Article 3 part one:

paragraphs of the third, sixth - to state the eighth in the following edition:

"archive set of initial materials of the movie set of materials, determined by the central executive body with the special status realizing state policy in the field of cinematography";

"the producer of the movie - subject of cinematography which took the responsibility for production of the movie and determined the responsible person - the producer (producers) of the movie;

production filma-Protsess creations of the movie, combining cooperation of physical persons (including physical persons - entrepreneurs): authors and contractors of the movie and other subjects of cinematography (physical persons (including physical persons - entrepreneurs) and legal entities) which consists of the periods (stages) of production (development of the film project (development), preparatory, film-making, mounting тонировочный);

initial materials of the movie - material carriers or the digital file with record of the original of the work of cinematography which use allows to make (to replicate) film copies";

in the paragraph the sixteenth "demonstration" to replace the word with the word "demonstration";

in the first offer of the paragraph of the nineteenth word "movie, which production" shall be replaced with words "the movie (national cultural product), which production";

"development of the film project (development) - the period of production of the movie within which information and methodical work on preparation of the film project by the film-making period is carried out that can include: writing of the literary scenario for the fiction film, storibord for animation, expanded tritment for not fiction film, script-doktoring, creation of presentation visual material, participation in the actions directed to improvement of quality of the scenario and its international competitiveness, search and research of film-making places and the main characters, marketing researches and developments, search and involvement of consultants with the special knowledge necessary for plot, forming of the estimate of production, forming of limit of the costs of production, the working schedule, other documents necessary for production of the movie";

"the development of the director's scenario part of the preparatory period of the movie including development of screen interpretation of the literary scenario by the production director and other authors of the movie, building of production and creative decisions and determination of technical and economic indicators";

"the participant of the movie - for the purposes of article 15 of this Law the participant of the movie is the physical person participating in creation of the movie as the contractor of any role, the participant of documentary (not game) movies, the contractor of the piece of music used in the movie, the scriptwriter and/or texts or dialogues, the production director, the producer;

the movie - the cinema, audiovisual work (including feature, short films and series and their separate series) consisting of the episodes connected among themselves by creative intention and graphic means, and which is result of joint activities of his authors, contractors and producers";

add taking into account alphabetic procedure with terms of the following content:

"The state fund of movies of Ukraine - the public institution of culture providing centralized storage, restoration of movies, archive and research activities for the purpose of development of filmofond, recovery, digitization, accounting, use and promoting of national and world cinema heritage";

"the film festival - the subject of cinematography, cinema cultural and art or cultural and educational event which is held according to the regulations (rules) approved by organizers of such action and provides demonstration of specially selected audiovisual works and can carry out the competitive program which consists of the movies estimated by jury and/or the audience which purpose is promoting of cinema, tracking of appearance of new cultural figures, identification of new tendencies of development of the directions of the world film industry, cultural meetings of national and world film artists, their experience exchange";

"the national cinema heritage is set of such, having art, historical, cultural or scientific value, created, recovered or remained in Ukraine feature, documentary, popular scientific, animation and other films, film copies and film materials created by the Ukrainian subjects of cinematography in Ukraine (including those that are located abroad), and also the movies, film copies and film materials created outside Ukraine for means of private or state producers of movies, and also the related production, archive, author's materials and objects connected with Ukraine subject, the scene of action or authors. Films, digital carriers, scenarios, sketches, director's copies, suits, the equipment, scenery, photos, technical devices, production process artifacts both other material and non-material elements of film production are part of national cinema heritage. The procedure and criteria of reference of elements in structure of national cinema heritage, procedure for its accounting are determined by the central executive body providing forming and realization of state policy in the field of cinematography. The national cinema heritage is object of protection of the state, and its unique elements in accordance with the established procedure can be recognized part of national cultural property. For the purpose of collection, accounting, research, preserving, restoration, digitization, promoting and access to national cinema heritage the State fund of movies of Ukraine (or this status is provided to public institution of culture or one of the state film studios having the status national) and the museum of national cinema heritage with open exposition platforms are created";

"the popular writer of cinematography subject of cinematography who is the organizer of film festivals, national and international film awards and other cultural and art or cultural and educational cinema actions which main objective is promoting of cinematography";

"promoting of cinematography complex of the information and education, cultural and educational, media and organizational actions performed by subjects of cinematography for the purpose of distribution among wide and specialized audience of knowledge of history, the current state and achievements of domestic and world cinema; increase in interest in motion picture art by holding film screenings, festivals, creations of film societies, educational programs and online platforms; assistance to development of national cinematography and support of domestic film product in the internal and international markets";

"script - докторинг - specialized service in the field of film production which consists in the professional analysis and editing the existing scenario (the movie, series, etc.). For the purpose of identification and elimination of its shortcomings, improvement of its art quality (in particular, structures, characters, dialogues, subject lines, dynamics, emotionality), increases in its logicality and integrity, and also assessment of its potential";

"the social movie - the piece of screen (documentary or game) directed to lighting and prevention of the urgent social phenomena and problems, achievement of the socially useful purposes, drawing attention to problems in society and search of ways of their decision, forming of public opinion and motivation to positive changes in society";

"the feature film - the movie timing at least 52 minutes";

"the short film - the movie timing less than 52 minutes";

"series - the movie consisting of two or more parts (series)";

"the game movie movie created on the basis of the scenario with in detail developed plot, the dramatic art kompozitsionno constructed and realized in screen statement by means of acting, art of authors of the movie";

"not game (documentary) movie movie in which participants are real people vital events are fixed, these events are realized, the facts in extent of figurative generalization come down, their essence is analyzed";

"the animation (animated) movie movie of synthetic art at the heart of which there is consecutive row specially created drawn, volume and doll or different way of the created images (characters) and other images fixed by method of time-lapse shooting or computer technology with the minimum quantity at least four original frames per second";

Part one of Article 7 to add 2) with paragraphs the eighth - the eleventh the following content:

"promoting of cinematography - the information and education, cultural and educational, media and organizational actions performing subjects of cinematography on purpose:

distribution among wide and specialized audience of knowledge of history, the current state and achievements of domestic and world cinema;

increase in interest in motion picture art by holding film screenings, festivals, creations of film societies, educational programs and online platforms;

assistance to development of national cinematography and support of domestic film product in the internal and international markets";

Part third of Article 8 to state 3) in the following edition:

"All Ukrainian subjects of professional cinema activity which are engaged in production, distribution, demonstration of movies and promoting of cinematography are entered in the State register of producers, distributors, demonstrators of movies and popular writers of cinematography, the provision on which affirms the Cabinet of Ministers of Ukraine";

To add 4) with Article 8 1 of the following content:

"Article 8 1. State register of producers, distributors, demonstrators of movies and popular writers of cinematography

The state register of producers, distributors, demonstrators of movies and popular writers of cinematography (further - the Register) is kept for the purpose of providing:

1) identifications of the subjects of cinematography performing production, distribution, demonstration of movies and promoting of cinematography on professional basis with observance of technical standards, regulations and rules in this sphere;

2) the analysis of structural changes in cinematography during creation, reorganization and liquidation of subjects of cinematography;

3) the organizations of statistical observations in the field of cinematography;

4) interactions on the single methodological beginnings with databases of other central executive bodies;

5) publicity and openness of information on subjects of cinematography for the interested users.

Decisions on entering into the Register of the subject of cinematography are made:

the central executive body realizing state policy in the field of cinematography - concerning producers of movies, distributors of movies which acquired the right to distribution of movies in all territory of Ukraine, popular writers of cinematography;
