About some questions of acceptance by courts on civil cases, Administrative and Economic courts of measures for providing the claim (preliminary protection)
For the purpose of ensuring the correct and uniform application by courts of acts of the legislation on taking measures to providing the claim (preliminary protection), being guided by article 22 of the Law of the Republic of Uzbekistan "About courts", the Plenum of the Supreme Court of the Republic of Uzbekistan decides:
1. Draw the attention of courts that consideration of the application about taking measures to providing the claim (preliminary protection) with reguliruyetsyakonstitution of the Republic of Uzbekistan, the Code of civil procedure of the Republic of Uzbekistan (further - GPK), the Economic Procedure Code (further - EPK), the Code about administrative legal proceedings (further - KOAS), the Law of the Republic of Uzbekistan "About execution of court resolutions and acts of other bodies".
2. The purpose of application of measures for providing the claim is prevention of difficulty or impossibility of performance of court resolution, and also prevention of concealment or property acquisition by the defendant.
With respect thereto to draw the attention of courts that on economic and civil cases providing the claim is allowed if rejection of such measures can complicate or make impossible execution of the court ruling, and on administrative cases taking measures of preliminary protection is allowed if before acceptance of court resolution there is real threat of violation of the rights, freedoms and legitimate interests of the applicant or person for the benefit of whom the application is submitted, or protection of the rights, freedoms and legitimate interests of the applicant without acceptance of such measures is impossible or complicated.
