According to part two of Item 2 and item 4 of article 85 of the Law of the Republic of Kazakhstan "About banks and banking activity in the Republic of Kazakhstan" Board of the Agency of the Republic of Kazakhstan on regulation and development of the DECIDES: financial market

1. Approve the enclosed values of financial and economic and other signs of deterioration in financial stability of bank, bank branch - the nonresident of the Republic of Kazakhstan.

2. To provide to department of risk analysis and stress testing in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

4. This resolution becomes effective after ten calendar days after day of its first official publication.

Values of financial and economic and other signs of deterioration in financial stability of bank, bank branch – the nonresident of the Republic of Kazakhstan

Chapter 1. General provisions

1. These values of financial and economic and other signs of deterioration in financial stability of bank, bank branch - the nonresident of the Republic of Kazakhstan (further – deterioration Signs) are developed according to part two of Item 2 and item 4 of article 85 of the Law of the Republic of Kazakhstan "About banks and banking activity in the Republic of Kazakhstan" (further – the Law on banks) for the purpose of protection of the rights and legitimate interests of depositors, other creditors, clients and correspondents of bank, ensuring financial stability of bank, bank branch - the nonresident of the Republic of Kazakhstan, prevention of approach of insolvency or potential insolvency of bank, bank branch - the nonresident of the Republic of Kazakhstan, decrease in negative effects in case of deterioration in financial stability of bank, bank branch - the nonresident of the Republic of Kazakhstan, and also decrease in systemic risks.

2. For the purposes of Signs of deterioration the concepts provided by the Law on banks, the Law of the Republic of Kazakhstan "About state regulation, control and supervision of the financial market and the financial organizations" and also the following concepts are used:

1) normative value for bank – measure value, their extreme values and techniques of calculations approved by the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market of the April 28, 2026 No. 85 established by Prudential standard rates and limits, obligatory to observance for banks with the universal banking license, to banks with the basic banking license, to Islamic banks (further – Prudential standard rates) (registered in the Register of state registration of regulatory legal acts at No. 38587);

2) threshold value of bank – value of the quantitative index established by appendix 1 to Signs of deterioration which variation of value demonstrates emergence of signs of deterioration in financial stability of bank of the increased risk level and is good cause for application of one of the following modes, stipulated in Item 3 articles 85 of the Law on banks:

the mode of the strengthened supervision;

mode of recovery of financial stability;

settlement mode;

3) normative value for branch of bank of the nonresident of the Republic of Kazakhstan – measure value, established by Prudential standard rates and limits for branches of nonresident banks of the Republic of Kazakhstan, their extreme values and techniques of calculations, including procedure for forming of assets of branches of the nonresident banks of the Republic of Kazakhstan accepted as reserve, and their minimum size, approved by the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market of April 20, 2026 No. 73 (registered in the Register of state registration of regulatory legal acts at No. 38502);

4) threshold value of branch of nonresident bank of the Republic of Kazakhstan – value of the quantitative index established by appendix 5 to Signs of deterioration which variation of value demonstrates emergence of signs of deterioration in financial stability of branch of nonresident bank of the Republic of Kazakhstan of the increased risk level and is good cause for application of one of the following modes provided by subitems 1) and 2) of Item 3 of article 85 of the Law on banks:
