About modification of some regulatory legal acts of National Bank of the Kyrgyz Republic concerning licensing and regulation of activities of the specialized financial organizations

6. This resolution becomes effective after 15 (fifteen) days from the date of official publication.

Regulations on licensing of activities of the specialized financial organizations

The provision "About Licensing of Activities of the Specialized Financial Organizations" (further - the Provision) determines procedure for licensing of activities of the specialized financial organizations (further - the SFD) performing the separate banking activities specified in this Provision.

This Provision does not extend to commercial banks, the microfinancial organizations, credit unions, JSC Finance Company of Credit Unions and other legal entities, the persons under surveillance to National Bank of the Kyrgyz Republic (further - National Bank) who are acting on the basis of the allowing document of National Bank and competent to perform separate banking activities.

Chapter 1. General provisions

1. The SFD is the legal entity created in form of business of the joint-stock company (closed or opened) or limited liability companies, competent to perform separate banking activities based on the corresponding license of National Bank, according to the legislation of the Kyrgyz Republic, this Provision and constituent documents of the SFD.

2. For implementation of the activities of the SFD shall obtain the license of National Bank for the right of implementation of the separate banking activities specified in Item 3 this provision (further - the license) according to the Laws of the Kyrgyz Republic "About banks and banking activity" and "About licensed authorization system in the Kyrgyz Republic" and other regulatory legal acts of National Bank.

3. The SFD has the right to perform the following separate banking activities taking into account the restrictions set by National Bank provided that such transactions are specified in the license:

1) purchase and sale (exchange) of non-cash foreign currency only for non-cash foreign currency according to requests of commercial banks of the Kyrgyz Republic;

2) implementation of transactions with precious metals, in the form of the measuring ingots emitted by National Bank.

4. The SFD is forbidden to participate in all "game" types of activity, including in the organization and holding draws and cash and prize lotteries, including carrying out cash and prize lotteries in rooms of the SFD or their advertizing.
