About modification and amendments in some orders of the Minister of national economy of the Republic of Kazakhstan
I ORDER:
1. Approve the enclosed list of some orders of the Minister of national economy of the Republic of Kazakhstan to which changes and additions are made (further - the List).
2. To provide to committee on regulation of natural monopolies of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after day of its first official publication.
3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.
4. 1. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of February 1, 2017 No. 36 "About approval of Rules of pricing in the socially significant markets" (it is registered in the Register of state registration of regulatory legal acts for No. 14778) the following changes:
in Rules of pricing in the socially significant markets approved by the specified order:
state Item 41 in the following edition:
"41. Ceiling calculation of price for goods (works, services) the Subject is made according to appendix 11 to these rules, except for Subjects in the field of retail sale of commodity gas and centralized purchase and centralized sale of electrical energy and (or) centralized purchase of service in maintenance of readiness of electric power and centralized sale of service in ensuring readiness of electric power for execution of loading by which ceiling calculation of price for goods (works, services) is made according to appendices 12, 12-1 and 12-2 to these rules.
Limiting calculation of goods price (work, service) the Subject on retail sale of electrical energy (electric utility service) is made according to appendix 13 to these rules.
Limiting calculation of goods price (work, service) the Subject on transportation of goods by railway transport and locomotive draft, except for services in provision in lease of rail goods wagons and services of the operator of cars (containers), services in transportation of goods by railway transport in the transit message through the territory of the Republic of Kazakhstan, services in transportation of goods in containers, kontreylerny sendings, empty containers and empty fitting platforms by rail is made according to appendix 14 to these rules.";

2. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of August 13, 2019 No. 73 "About approval of Rules of implementation of activities by subjects of natural monopolies" (it is registered in the Register of state registration of regulatory legal acts for No. 19242) the following changes and amendments:

These rules of implementation of activities by subjects of natural monopolies (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further - the Law on the state and socially responsible services) and the subitem 6) of article 8 of the Law of the Republic of Kazakhstan "About natural monopolies" (further - the Law) and determine procedure of activities by subjects of natural monopolies, and also rendering the state services "Inclusion and Exception of the State Register of Subjects of Natural Monopolies, Except for Services in the field of Air Navigation and the Airports and Communication", "Issue of consent to transactions with property of the subject of natural monopoly if book value of property concerning which the transaction is made, considered in the balance sheet for the beginning of the current year exceeds percent 0,05 from book value of its assets according to the balance sheet for the beginning of the current year, except for services in the field of air navigation and the airports and communication "and" issue of consent to reorganization and liquidation of subjects of natural monopolies, except for services in the field of air navigation and the airports and communication ".";
7) to state the subitem in the following edition:
"7) the tender documentation - the document package placed by the subject of natural monopoly on digital systems of electronic procurement for preparation of the bid, containing conditions and procedure for carrying out tender;";
21) to state the subitem in the following edition:
"21) the purchase agreement - the civil agreement signed by means of digital system of electronic procurement between the customer and the supplier, certified by digital signatures, except as specified, stipulated by the legislation the Republic of Kazakhstan;";

"35) digital system of electronic procurement (further - the portal) - the portal providing single point of access to electronic procurement, the natural monopolies performed by subjects.";
the second Item 5 to state part in the following edition:
"Uslugopoluchatel addresses to the service provider through the web portal of "the digital government" www.egov.kz (further - the portal) with the statement:
no later than fifteen calendar days from the date of the beginning of provision of regulated service to consumers for inclusion in the State register of the subject of natural monopolies in form 2 according to appendix 1 to these rules.";
the second Item 7 to state part in the following edition:
"Processing of the statement of uslugopoluchatel for inclusion in the State register of subjects of natural monopolies, except for services in the field of air navigation and the airports and communication is performed within 30 (thirty) minutes from the moment of receipt in the state digital system of permissions and notifications, further following the results of the certificate on inclusion in the state register of subjects of natural monopolies is created, except for services in the field of air navigation and the airports and communication in electronic form signed by the transport signature of the state digital system of permissions and notifications and goes to personal account of uslugopoluchatel on the portal.";
state Item 13-1 in the following edition:
"13-1. In disagreement cases with results of rendering the state service the uslugopoluchatel can take a legal action according to the subitem 6) of Item 1 of article 4 of the Law on the state and socially responsible services.";

"34. For receipt of the state service "Issue of Consent to Reorganization and Liquidation of Subjects of Natural Monopolies, Except for Services in the field of Air Navigation and the Airports and Communication", uslugopoluchatel through the web portal of "the digital government" www.egov.kz (further - the portal) represents to the service provider:
1) the petition for receipt of consent of authorized body in form 2 according to appendix to 2 these rules;
2) the electronic copy of the transfer act - in case of merge, accession, transformation;
3) the electronic copy of the separation balance sheet - in case of separation, allocation;
4) the electronic copy of the liquidation balance sheet - in case of liquidation.";
state Item 37-2 in the following edition:
"37-2. In disagreement cases with results of rendering the state service the uslugopoluchatel can take a legal action according to the subitem 6) of Item 1 of article 4 of the Law on the state and socially responsible services.";
second and third Item 41 to state parts in the following edition:
"The service provider accepts from the subject of natural monopoly the notification on implementation of the activities which are not relating to regulated services including by means of the state digital system of permissions and notifications and places the register of the accepted notifications on the Internet resource.
Information on procedure for rendering the state services, and also the made changes and (or) additions in the subordinate regulatory legal acts determining procedure for rendering the state service, the service provider goes to Single contact center, according to the subitem 13) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" and to the operator of information and communication infrastructure of "the digital government", the performing reception of applications and issue of results of rendering the state service.";
to state part one of Item 48-1 in the following edition:
"48-1. Purchases of works and services, selection of projects and suppliers, the conclusion of agreements, purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within implementation of the national project on upgrade of energy and utility sectors are performed on digital platform of purchases of the national project on upgrade of energy and utility sectors.";

"If by results of tender among the Kazakhstan producers one request conforming to qualification requirements and (or) requirements of the tender documentation, stipulated in Item 142 these rules is submitted, such participant is recognized the winner of tender. "In case of filing of application through the State corporation the employee of the State corporation performs identification of the identity of the consumer, and encloses the data on the documents provided by the subitem 1) of Item 216, the subitem 1) of Item 223, the subitem 1) of Item 261, the subitem 1) of Item 272 of these rules, received from the corresponding state digital systems through the web portal of "the digital government" to the application.";
the fifth to state part in the following edition:
"In case of filing of application through the web portal of "the digital government" the consumer provides electronic copies of the documents specified in Items 216, of 223, of 261 and 272 these rules.";

Appendix 13
to Rules of pricing in the socially significant markets
Limiting calculation of the price of retail sale of electrical energy (electric utility service) of subjects of the socially significant market
1. Marginal calculation of price of retail sale of electrical energy of subjects of the socially significant market is perfromed taking into account price differentiation of retail sale of electrical energy on customer groups.
Differentiation by the power supplying organizations of rates for electrical energy depending on amounts of its consumption by physical persons is performed according to Rules of differentiation by the power supplying organizations of rates for electrical energy depending on amounts of its consumption by the physical persons approved by the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of February 20, 2009 No. 57-OD (it is registered in the Register of state registration of regulatory legal acts for No. 5602).
2. Marginal forming of price of retail sale of electrical energy by the power supplying organizations is performed according to Rules.
3. For the purpose of establishment of the differentiated marginal price of retail sale of electrical energy by the power supplying organizations the following customer groups are allocated:
1 customer group - the residential customers using electrical energy for own domestic needs which are not connected with production (sale) of goods, works and provision of services;
2 customer group - the consumers using electrical energy not for domestic needs;
3 customer group - public institutions, the state companies, legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to the state, and the legal entities affiliated with them, national investment holding, the national companies and the organizations, fifty and more percent of shares (share in the authorized capital) which directly or indirectly belong to national investment holding, the national company, except for the organizations entering into structure of National Bank of the Republic of Kazakhstan and legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to National Bank of the Republic of Kazakhstan or are in its trust management.
4. The holiday rate is applied for:
the consumers located in the territory of special economic and industrial zones;
subordinated organizations of Administration of the President of the Republic of Kazakhstan and its departments;
producers of socially important food products.
Calculation of the differentiated marginal prices of retail sale of electrical energy for customer groups.
5. Calculation of the differentiated ceiling prices for the electric power for the first customer group is perfromed taking into account coefficient of ceiling change of price for electrical energy for the first customer group, is determined by department of authorized body and/or territorial subdivision of department of authorized body by formula:
Tsdif1 = Zdeystv. * k, tenge/kWh (excluding VAT), where:
Zdeystv. - current price for the first group, tenge/kWh (excluding VAT);
k - the coefficient of ceiling change of price for electrical energy for the first customer group determined by department of authorized body or territorial subdivision of department of authorized body taking into account:
1) level of solvency of the population of the respective region;
2) influences on inflation;
3) level of development of industrial production;
4) creations of incentives for energy saving.
6. Ceiling calculation of price for the electric power for the second customer group (in case of lack of the third customer group), is performed on formula:
Tsdif2 = ((Zi * Vobshch.God) - (Tsdif1 * V 1)) / V 2, tenge/kWh (excluding VAT), where:
Zi - marginal price, without differentiation on customer groups;
Vobshch.God - the planned annual sales amount of the electric power the power supplying organization, kWh;
V1 - the planned amount of electrical energy of the first customer group, kWh;
V2 - the planned amount of electrical energy the second customer group, kWh;
7. Ceiling calculation of price for the electric power for the third customer group in the absence of the second customer group, is performed on formula:
Tsdif3 = ((Zi * Vobshch.God) - (Tsdif1 * V 1)) / tenge/kWh V3 (excluding VAT), where:
V3 - the planned amount of electrical energy of the third customer group, kWh;
8. Ceiling calculation of price for the electric power for the second and third customer groups, in case of availability of the second and third customer groups, is performed on formulas:
Tsdif3 = ((Zi * Vobshch.God) - (Tsdif1 * V 1) - (Tsdif2 * V 2)) / V 3, tenge/kWh. (excluding VAT).
