About the rights of children

Corporal punishments of children - the physical and (or) psychological abuse committed concerning children by parents (persons replacing them), the staff of educational, medical, social, sports, cultural, entertaining and penal institutions responsible for supervision of children for the purpose of education or as disciplinary action;

1.1.9. Forms of violence against children - physical abuse, sexual violence, psychological violence, corporal punishments, neglect, threat of life, operation, permanent pressure and aggressive behavior;

1.1.10. Violence against children - action (action or failure to act), life-threatening, to health, sexual immunity, honor, advantage and other rights and freedoms of the child who is under protection of the law, causing or capable to inflict on it physical or psychological suffering, contradicting interests of the child, made by different methods, including with use of information resources of the Internet or information and telecommunication networks;

1.1.11. Persons replacing parents - adoptive parents, guardians (custodians).

1.2. Other concepts used in this Law have the values established by regulatory legal acts of the Azerbaijan Republic.

Article 2. Legislation of the Azerbaijan Republic on the child's rights

The legislation of the Azerbaijan Republic on the rights of the child includes the Constitution of the Azerbaijan Republic, the international agreements which participant is the Azerbaijan Republic, this Law, the Family code of the Azerbaijan Republic, the laws of the Azerbaijan Republic "About social protection of the children deprived of parent guardianship", "About prevention of neglect and violations of the law about minors", "About protection of children from harmful information" and other regulatory legal acts.

Article 3. Scope of this Law

3.1. The rights and freedoms provided by this Law extend to each child irrespective of race, ethnic origin, religion, language, floor, origin, property status, beliefs, opportunities in the field of health care, the social status of the parents (replacing them persons), other family members, membership in public associations and other characteristics.

3.2. Foreign and children without nationality in the Azerbaijan Republic can have all rights and freedoms provided by this Law if other is not provided by other laws and international treaties which participant is the Azerbaijan Republic.

Article 4. The purposes of state policy concerning children

4.1. The purposes of state policy concerning children is the following:

4.1.1. providing the rights and freedoms of children, forming of the legal basis for providing the rights of children;

4.1.2. creation of institutional mechanisms of protection of the rights and freedoms of children, recovery of the rights violated by them;

4.1.3. nondiscrimination concerning children, providing equal opportunities and integration for all children;

4.1.4. social protection of children in difficult vital conditions;

4.1.5. physical, intellectual, spiritual and moral development of children, their education in the spirit of patriotism, civic consciousness, the world, respect for moral values, national customs and traditions;

4.1.6. forming of legal culture at children;
