About protection of children from harmful information

(as amended on 08-07-2022)

This Law according to Item 1 of part I of article 94 of the Constitution of the Azerbaijan Republic determines measures for protection of children from information harmful to them, in connection with implementation of the right of children to information corresponding to their age and governs the relations arising in this area.

Chapter 1. Basic provisions

Article 1. Basic concepts

1.0. The basic concepts used in this Law designate the following:

1.0.1. receipt of information by children - possibility of children to receive and use information, including information products which receipt is not limited to the law;

1.0.2. information products - products of mass media, audiovisual products, computer and other video games intended for the address and consumption on territories of the country, and also cultural events and other information products extended on telecommunication network;

1.0.3. age category of information products - the age indicator suitable for use of the information products provided by this Law;

1.0.4. age classification of information products - distribution of information products on age groupes, the established this Law;

1.0.5. demonstration of violence and cruelty - the description or the image of physical or mental abuse and scenes of such cruelty, causing sufferings and bodily harms, murders of people and animals, and also bodies with violence signs;

1.0.6. cultural events - mass demonstration, execution or performance, including the dramatized, cultural and educational and entertaining actions, in the places open for mass or garden leave;

1.0.7. the information products intended for children - the information products carried on subject, content and registration only or mainly to minors;

1.0.8. information discrediting institute of family - information which can create the distorted ideas at children of the sphere of family and scrap by denial of family values or the data on is not present the importance of such social institutes as family, scrap, motherhood and paternity;

1.0.9. information harmful to children - the information which is not intended for children and exerting negative impact on physical or mental health of the child, including leading to violation of their spiritual, mental, physical or social development through forming of the distorted social representations;

1.0.10. promotion - the activities of physical persons or legal entities directed to forming in consciousness of children of any rule of conduct or stereotype or pursuing the aim to induce the child to making of any actions or failure to act;

1.0.11. information propagandizing antisocial and illegal actions - information inducing children to occupation prostitution, gamblings and vagrancy (including begging), to making of the acts offending national and moral values, and also other acts, violating the rights of persons;

1.0.12. information propagandizing the activities posing hazard to life and health of children - the information posing hazard to life, physical and mental health of children, including propagandizing suicide, use of firearms and explosives, drugs, psychotropic substances and their precursors, alcoholic and energy drinks, and also tobacco products;

1.0.13. information propagandizing crimes - the information causing in children aspiration to making of crimes, representing and propagandizing criminal environment, including crimes and criminals, criminal regulations and values, attributes and characters of the criminal circle including criminal slang, in positive sense;

1.0.14. information of terrible content - information capable to cause in children feeling of permanent fear, alarm or horror, terrible state or the description of fictional beings, and also the naturalistic (natural) description or the image of heavy bodily harms, suicides (including suicide attempts), accidents, catastrophic crashes and their effects, and also use in information products of some special rituals and mystical doctrines, spiritism imparting arrangement to unwanted habits;

1.0.15. the naturalistic (natural) description - the description or the image of the living being, subject, event, movement (failure to act) and their effects capable to draw attention of the user of information products to details, anatomic questions or physiological processes;

1.0.16. information of erotic content - the information products which are not pornographic, but causing premature excitation of sexual interest in children;

1.0.17. marking of information products - specifying on information products, its carrier and packaging of sign of age category;

1.0.18. places of possible finding of children - public places which visit by children and (or) stay in which is not forbidden to children including the public place in which children take access to information products (including the information products placed in telecommunication networks);

1.0.19. the expert - the person meeting the requirements of this Law having the higher education in the field of pedagogics, psychology or children's psychiatry and drawing expert opinion for the purpose of carrying out age classification of information products.

Article 2. Legislation of the Azerbaijan Republic on protection of children from harmful information

2.1. The legislation of the Azerbaijan Republic on protection of children from harmful information consists of the Constitution of the Azerbaijan Republic, international treaties which the Azerbaijan Republic, this Law and other regulatory legal acts joined.

2.2. This Law does not extend to the following relations:

2.2.1. turnover of scientific and scientific and technical information products;

2.2.2. turnover of information which distribution is forbidden and limited to the current legislation in the field of fight against terrorism, extremism, crimes against the world and humanity.

Article 3. The basic principles in the field of protection of children from harmful information

3.0. The basic principles of protection of children from harmful information consist in the following:

3.0.1. priority of interests of children, providing their rights and freedoms;

3.0.2. creation of conditions for turnover of information products, safe for life and health of children and providing their all-round development and socialization;

3.0.3. inadmissibility of promotion of violence, cruelty, drugs and psychotropic substances, alcoholic and energy drinks, and also tobacco products, antisocial behavior, information of pornographic nature;

3.0.4. prevention of introduction into circulation of harmful information products, including offenses concerning children with use of information technologies;

3.0.5. implementation of international cooperation in the field of protection of children from harmful information.

Article 4. Types of information, harmful to children

4.1. To information harmful to children, belongs:

4.1.1. information which turnover among children is prohibited according to article 4.2 of this Law;
