Article 1. No. 3434-XII "About highways and road activities" to be reworded as follows the law of the Republic of Belarus of December 2, 1994:
About highways and road activities
For the purposes of this Law the following main terms and their determinations are used:
emergency road construction - road construction, in use which there was sudden uncontrollable destruction of its or its part which resulted in impossibility of movement on it of vehicles and (or) pedestrians;
the highway - the complex construction intended for movement with the established speeds, loadings and dimensions of cars and other land vehicles, the parcels of land provided for placement of the objects which are part of this construction, and also other objects included in structure of the highway according to this Law and international legal acts constituting the right of the Eurasian Economic Union;
the highway of uncommon use - the highway, held for use according to the procedure, established by its owner;
the highway public - the highway, held for use any persons;
diagnostics - inspection, collection and information analysis about parameters and condition of structural elements of the highway, road construction, characteristics of transport flows, and if necessary - other information for determination of need for carrying out capital repairs, running repair, and also for assessment and the forecast of operational condition of the highway, road construction in the course of their further operation;
admissible weight and (or) dimensional parameters - values of admissible lump, admissible axial weight (the amount of axial masses) and (or) admissible dimensions of the vehicle with load or without load;
road activities - activities for development of the preproject (pre-investment) and project documentation, construction, reconstruction, capital repairs, operation (content and running repair) of highways and road constructions on them, to accomplishment (rendering) of other related works (services);
road construction - engineering (artificial) construction (bridge construction, the overpass, platform, tunnel, water throughput pipe and another) for the omission of vehicles, pedestrians, animal in places of crossing of the highway with natural or artificial obstacle;
the road methodical document - the methodical document developed by the state organization authorized by the Ministry of Transport and Communications which contains accomplishment methods repeatedly (two and more times) the repeating work types of use of specific technologies, matching, approbation of materials when implementing road activities and forms basis for development of technical regulatory legal acts;
intelligent transportation system of the Ministry of Transport and Communications (further - ITS) - the intelligent transportation system intended for management of traffic and ensuring transport and road activities on republican highways and road constructions on them;
information fund of road economy - the systematized collection of information used in case of construction, reconstruction, capital repairs, operation (content and running repair) of highways public and road constructions on them including technical regulatory legal acts, road and other methodical documents, technological documentation on production of roadwork, departmental and individual standard rates of expense of resources in kind, work cost rates, and also the regulatory base of current prices on the resources used in case of construction, reconstruction, capital repairs, operation (content and running repair) of highways public and road constructions on them (further - the departmental regulatory base of current prices on resources);
structural element of the highway - the design perceiving external and internal loadings and transferring to their other designs or the basis;
objects of road service - the buildings and constructions located within strip of branch and intended for servicing of participants of traffic (stopping points of buses, including with pavilions, platforms for short-term stop of vehicles, platforms for rest with parking of vehicles, devices of emergency and calling communication and other buildings and constructions);
objects of roadside service - the buildings and constructions located on roadside strip (in the controlled area) and intended for servicing of participants of traffic along the line (hotels, including motels and hostels, campings, service stations, gas stations, parkings, shopping facilities, objects of public catering, mail service, telecommunication, rendering insurance and other services, Items of medical care, sink and other buildings and constructions);
the organizations of the state road farm - the organizations performing road activities and subordinates to the Ministry of Transport and Communications or local executive and administrative organs;
branch strip - the parcels of land (irrespective of category of lands) which are intended for placement of structural elements of the highway, road constructions, other objects, stipulated by the legislation about highways and road activities, in the field of traffic and on which objects of road service are located or can be located;
users of highways - the legal entities and physical persons using highways as participants of traffic or performing activities which do not belong to road, within branch strip;
preemergency road construction - road construction which technical condition is characterized by availability of the defects and damages menacing to traffic safety in case of which its further operation without change of the mode of movement of vehicles and (or) pedestrians and accomplishment of necessary urgent actions for recovery of road construction will lead to sudden uncontrollable destruction of road construction or its part;
roadside strips (controlled areas) - the parcels of land which adjoin on both sides to strip of branch and in which borders the specific mode of their use for the purpose of providing safety requirements of traffic, and also creation of necessary conditions for reconstruction, capital repairs, operation (content and running repair) the highway, its safety taking into account perspectives of development of the highway is set;
designing of the highway - the production process consisting of complex of construction work and economic calculations and performed on materials of engineering researches;
content of the highway - complex of works on maintenance of normative technical condition of the highway, and also on the organization and safety of traffic;
special permission to driving of the heavyweight and (or) large-size vehicle through highways public (further - special permission) - permission to journey of the vehicle which maximum weight and (or) overall dimensions exceed the admissible weight and (or) dimensional parameters set for driving through highways public;
