About introduction of amendments to the resolution of Board of the National Bank of Ukraine of February 24, 2022 No. 18

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of determination of features of functioning of the monetary and currency markets in the conditions of the warlike situation Board of the National Bank of Ukraine decide:

1. Bring in the resolution of Board of the National Bank of Ukraine of February 24, 2022 No. 18 "About work of bank system during introduction of warlike situation" (with changes) the following changes:

The resolution after Item 6-2 to add 1) with new Item 6-3 of the following content:

"6-3. The American-Ukrainian investment fund of recovery created in the form of limited partnership, its representation in Ukraine, DIEFSI limited liability company YUKREYN SABSOIL, ELELSI (DFCUKRAINESUBSOIL, LLC) has the right with use of the accounts opened in banks in Ukraine to perfrom cash calculations in the territory of Ukraine in hryvnias and foreign currency with other nonresidents and residents on the transactions determined in Items 122, of 126, of 127, of 128, 132 and 134 Sections X of the Provision No. 5, and also other transactions provided that they are performed for accomplishment and implementation of the Agreement between the Government of Ukraine and the Government of the United States of America about creation of the American-Ukrainian investment fund of the recovery ratified by the Law of Ukraine "About ratification of the Agreement between the Government of Ukraine and the Government of the United States of America about creation of the American-Ukrainian investment fund of recovery" Agreements between Corporation of the United States of America on financing of the international development and the Agency concerning support of public-private partnership about creation of the American-Ukrainian investment fund of recovery in the form of limited partnership, fee Payment procedure in the American-Ukrainian investment fund of the recovery approved by the resolution of the Cabinet of Ministers of Ukraine of December 10, 2025 No. 1616, of the resolution of the Cabinet of Ministers of Ukraine of December 23, 2025 No. 1698 "Some questions of payment of comparable urgent fee in the American-Ukrainian investment fund of recovery" for implementation of the Agreement between the Government of Ukraine and the Government of the United States of America about creation of the American-Ukrainian investment fund of the recovery approved by the resolution of the Cabinet of Ministers of Ukraine of February 16, 2026 No. 202. requirements of Item 89 of the Section IX of the Provision No. 5 do not extend to such transactions.";

Item 12 to add 2) with the new subitem of the following content:

"21) purchases of foreign currency by the physical person needing treatment, either her relatives, or the charity foundation performing fund raising on treatment of this physical person for the purpose of accumulating of the purchased foreign currency on the current account in bank within the amount of the agreement signed with medical institution of foreign state for payment of expenses on treatment and also the accompanying additional expenses connected with treatment process (including consultation, sampling of tests, stay/accommodation in chamber of hospitalization, food) in medical institutions of foreign state.

Purchase of foreign currency is allowed to that person who will make further money transfer for benefit of medical institution, in the amounts which are not exceeding amounts of the expenses provided on treatment including the accompanying additional expenses connected with treatment process. Purchase of foreign currency and cross-border transfer of means are performed through one bank.

The bank shall sell in the foreign exchange market of Ukraine within two working days after the date of the last payment determined in the agreement signed with medical institution of foreign state, or date of termination of such agreement of means in foreign currency which were purchased by the client and were not used by it for designated purpose and/or are returned by medical institution of foreign state.

The statement of the client for purchase of foreign currency / the contract of the client with bank shall/shall contain the order of the client to bank to sell the purchased foreign currency which is not converted to destination, in time, specified in paragraph three of the subitem 21 of Item 12 of this resolution.";

The subitem 5 of Item 12-10 to state 3) in the following edition:

"5) resident clients according to subitems 16 and 21 of Item 12 of this resolution.";

Item 12-15 to add 4) with the new subitem of the following content:

"33) on the account of charity foundation if purchase of foreign currency is performed according to the subitem 21 of Item 12 of this resolution.".
