About modification of some legal acts of Ukraine concerning enhancement of procedure for execution of judgments, decisions of other bodies and digitalization of separate stages of enforcement proceeding

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Economic Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):

Article 150 to add 1) with parts six and the seventh the following content:

"6. If applicant is the legal entity, account details of the applicant in bank, non-bank predostavitel of payment services are specified in the statement.

If applicant is the physical person or the physical person - the entrepreneur, account details of the applicant in bank, the non-bank representative of payment services or information on lack of such account are specified in the statement. In the absence of the account the applicant specifies in the statement desirable method of receipt of money in case of allowance of the application.

7. In case of specifying in the statement of account details of the applicant in bank, non-bank predostavitel of payment services the document confirming availability of such account is enclosed to the application";

Article 162 to add 2) with part seven of the following content:

"7. In case of presentation by the legal entity of the recovery suit of money account details of the claimant in bank, non-bank predostavitel of payment services are specified in the action for declaration.

In case of presentation by physical person or physical person - the entrepreneur of the recovery suit of money in the action for declaration specifies account details of the claimant in bank, non-bank predostavitel of payment services or information on its absence. In the absence of the account the claimant notes in the action for declaration desirable method of receipt of money in case of satisfaction of the claim";

Article 164 to add 3) with part seven of the following content:

"7. In case of specifying in the action for declaration of account details of the claimant in bank, non-bank predostavitel of payment services the document confirming availability of such account is enclosed to the application".

2. In the Code of civil procedure of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):

Article 163 to add 1) with parts six and the seventh the following content:

"6. If applicant is the legal entity, account details of the applicant in bank, non-bank predostavitel of payment services are specified in the statement.

If applicant is the physical person or the physical person - the entrepreneur, account details of the applicant in bank, the non-bank representative of payment services or information on lack of such account are specified in the statement. Article 177 to add 3) with part eight of the following content:

"8. In case of specifying in the action for declaration of account details of the claimant in bank, non-bank predostavitel of payment services the document confirming availability of such account is enclosed to the application".

3. In article 34 of the Law of Ukraine "About traffic" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 31, Art. 338 with the following changes):

the fifth and sixth to replace parts with four new parts of the following content:

"For the automated accounting of the vehicles used on street road net public and which are subject to state or departmental registration, and the information about their owners and proper users the Unified state register of vehicles which holder is the Ministry of Internal Affairs of Ukraine is kept.

During implementation of re-registration, removal from accounting of the vehicle it is performed concerning availability/lack of information about the vehicle owner in the Unified register of debtors according to the procedure determined by the Ministry of Justice of Ukraine and the Ministry of Internal Affairs of Ukraine.

In case of availability of information about the vehicle owner in the Unified register of debtors territorial authorities of the Ministry of Internal Affairs of Ukraine refuse making of registration action what no later than the next working day report the body of the public executive service or the private contractor specified in the Unified register of debtors with provision of data on such vehicle about.

The territorial authorities of the Ministry of Internal Affairs of Ukraine, bodies performing departmental registration of vehicles do not refuse making of registration action concerning the vehicle, the information about which owner contains in the Unified register of debtors, in case:

1) if the re-registration of the vehicle is not connected with its alienation;

2) acquisition of the vehicle or its obtaining on account of debt repayment according to the procedure, determined by article 61 of the Law of Ukraine "About enforcement proceeding";

3) acquisition of the vehicle according to the procedure, determined by article 30 of the Law of Ukraine "About providing requirements of creditors and registration of encumbrances";

4) free transfer of the vehicle confiscated by a court decision;

5) alienation by Fund of guaranteeing household deposits according to the procedures provided by the Law of Ukraine "About system of guaranteeing household deposits", the vehicle acquired in property as a result of indemnification (losses) according to requirements of Fund of guaranteeing household deposits, provided by part five of article 52 of the Law of Ukraine "About system of guaranteeing household deposits" for satisfaction of requirements of creditors of insolvent bank or bank on which the decision on withdrawal of the banking license and liquidation of bank is made".

With respect thereto the seventh or sixteenth to consider parts respectively parts of the ninth or eighteenth;

after part eleven to add with new part of the following content:

"In case of availability of information about the vehicle owner in the Unified register of debtors departmental registration (re-registration) of the vehicle is not performed, except the cases provided by this Article".

With respect thereto the twelfth - the eighteenth to consider parts respectively parts thirteen - the nineteenth.

4. In the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383 with the following changes):
