About traffic

This Law determines legal and social basis of traffic for the purpose of protection of life and health of citizens, creation of safe and comfortable conditions for participants of movement and protection of the surrounding environment.

Section I. General provisions

Article 1. Tasks of the Law of Ukraine "About traffic"

The law governs the public relations in the field of traffic and its safety, determines the rights, obligations and responsibility of subjects - participants of traffic, the ministries, other central executive bodies, associations, the companies, organizations and the organizations irrespective of patterns of ownership and housekeeping (further - the ministries, other central executive bodies and associations).

Article 2. Legislation on traffic

The legislation on traffic consists of this Law and acts of the legislation of Ukraine which are issued according to it.

Article 3. Public administration in the field of traffic

Public administration in the field of traffic and its safety is performed by the Cabinet of Ministers of Ukraine, the central executive bodies which are specially authorized on it, executive bodies in the Autonomous Republic of Crimea, local executive bodies, local government bodies.

Article 4. Competence of the Cabinet of Ministers of Ukraine in the field of traffic

In the field of traffic belongs to competence of the Cabinet of Ministers of Ukraine:

preparation of drafts of the laws, regulatory legal acts concerning traffic and its safety, and also responsibility for their violation in the territory of Ukraine;

the paragraph third is excluded;

the paragraph the fourth is excluded;

development and approval of state programs of development of traffic and its safety on highways, streets and railway crossings, requirements of ecological safety, and also programs of coordination of use of all modes of transport public (automobile, railway, air, water);

financing, management and control over the implementation of state programs of development of traffic and its safety;

coordination of activities of the ministries, other central executive bodies, associations and local self-government in the field of traffic, and also requirements of ecological safety;

control over the implementation of the legislation on traffic;

determination of single procedure for the organization of traffic and its safety;

establishment of single requirements for designing, construction, reconstruction, repair, deduction and protection of highways, streets and railroad crossings, approval of programs of their construction;

establishment of single requirements concerning design and technical condition of vehicles which are operated in Ukraine;

determination of procedure for issue of certificates on implementation of the activities connected with production, repair and operation of vehicles, carriages of goods and passengers, training of drivers, construction, reconstruction, repair and the content of highways, streets and railroad crossings, other types of activity influencing traffic security;

determination of procedure of state registration (re-registration), removal from accounting of vehicles, carrying out their mandatory engineering supervision and determination of amounts of check of technical condition of vehicles, determination of the list of the equipment, necessary, for receipt by subjects of housekeeping of the right to implementation of mandatory engineering supervision of the vehicles intended for operation on street road net public and registered by territorial authorities of the Ministry of Internal Affairs of Ukraine (further - subjects of carrying out mandatory engineering supervision), and also the list of documents which are filed for receipt of such right and other powers determined by this Law.

determination of procedure for registration and issue of approvals and permissions, provision of other services connected with traffic safety control and also determinations of the amount of payment for registration and issue of such approvals and permissions, provision of the corresponding services;

establishment of Regulations of Admission of examinations in knowledge of Traffic regulations and skills of control of vehicles;

establishment of single requirements and approval of standard training programs for participants of traffic, forming of proper road culture and the organization of training of different national groups in traffic regulations;

determination of procedure for functioning of system of fixing of offenses in the field of safety control of traffic in automatic mode;

approval of technique of determination of economic losses in connection with death or wound (injuring) of people owing to the road accidents; 

determination of procedure for production and accounting of number boards for the vehicles which are subject to state registration and number boards for one-time trips.

The funds allocated according to the procedure and amounts, stipulated by the legislation, the means of private investors including attracted on model of public-private partnership, raised, including the credits of banks and other financial credit institutes, means from other sources which are not prohibited by the legislation can be sources of financing of system of fixing of offenses in the field of safety control of traffic in automatic mode public fund and local budgets.

Article 5. Competence of authorities of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils, regional, Kiev and Sevastopol public administrations

To competence of authorities of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils, regional, Kiev and Sevastopol public administrations in the field of traffic belongs:

adoption of regulatory legal acts concerning traffic and its safety, except for those which belong to competence of the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine;

approval of regional development programs of traffic and its safety;

the state supervision and control of compliance with law about traffic and its safety, behind activities of the companies, organizations, organizations irrespective of patterns of ownership and housekeeping for planning and accomplishment of actions for traffic safety, requirements of ecological safety;

forming of funds for financing of the state programs and separate actions aimed at the development of traffic and its safety;

ensuring development of network of local highways, streets and railroad crossings, their content and protection;

management of activities for the organization of traffic;

the organization of training of the population in Traffic regulations, holding educational actions among different social age groupes of the population for its safety;

organization of preparation and advanced training of transport drivers and development of network of the relevant educational institutions;

the organization and implementation of actions for timely providing the victims as a result of the road accidents by the emergency medical care directly on site incidents and their transportations for provision of further medical care in the corresponding institutions of health care;

creation of conditions for accomplishment by crews of the emergency (fast) medical care of the standard rate of arrival of crews of the emergency (fast) medical care established by the Cabinet of Ministers of Ukraine to the patient;

the organization and financing of the actions connected with prevention of children's road and transport injury rate;

management of promotion of traffic safety, requirements of ecological safety;

control of collection of the national and local taxes, charges and other obligatory payments in the field of traffic;

organization of providing individual owners of vehicles with paid parking and collective garages;

permission of other questions of traffic.

Article 6. Competence of city councils and their actuators, regional councils and district public administrations

In the field of traffic belongs to competence of city councils and their actuators, regional councils and district public administrations:

fulfillment of requirements of the legislation and decisions of executive bodies on traffic and its safety;

the paragraph third is excluded;

development, approval and implementation of city and district development programs of traffic and its safety;

forming of city and district funds, including off-budget, for financing of the programs and separate actions aimed at the development of traffic and its safety;

control of the organization of training of different social age groupes of the population in Traffic regulations, planning of the actions connected with prevention of its safety and control of their accomplishment;

control of preparation and advanced training of drivers, maintenance and repair of vehicles, ensuring development of the sphere of these services;

the organization of traffic in the territory of the city and the area according to the corresponding master plans, projects of detailed planning and building of settlements, automated control systems for traffic, complex transport schemes and schemes of the organization of traffic and with ecologically safe conditions;

implementation and financing of the actions connected with prevention of children's road and transport injury rate;

carrying out work on promotion of traffic safety;

organization of construction, reconstruction, repair and content of highways, streets, railroad crossings;

establishment of procedure and implementation of measures for ensuring protection of vehicles on paid parking and in collective garages;

decision making about placement, the equipment and functioning of platforms for the parking of vehicles and taxi stands on streets and roads of settlements, control of observance of the vehicles of requirements for placement determined by rules of the parking, the equipment and functioning of platforms for the parking;
