About introduction of amendments to some orders of the Minister of Finance of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of Finance of the Republic of Kazakhstan to which changes are made (further – the List).

2. To provide to department of methodology of financial accounting, audit and assessment of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after day of its first official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Finance of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026, except for paragraphs of the hundred thirty fifth and hundred sixty fourth Item 3 of the List which become effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of Finance of the Republic of Kazakhstan to which changes are made

1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of November 30, 2015 No. 598 "About approval of Rules of carrying out cameral control" (it is registered in the Register of state registration of regulatory legal acts at No. 12599) the following changes:

in the Rules of carrying out cameral control approved by the specified order:

in Item 2:

1) and 2) to state subitems in the following edition:

"1) single platform of purchases (further – the web portal) – the digital system of authorized body in the field of public procurements providing single point of access to electronic services of the public procurements and procurements conducted according to the Law of the Republic of Kazakhstan "About purchases of certain subjects of the quasi-public sector;

2) cameral control – other form of control performed by department of authorized body on internal state audit (further – department) and its territorial subdivisions without visit of object of the state audit and financial control (further – object of the state audit) on the basis of the analysis and comparison of these digital systems, and also data on activities of objects of the state audit;";

8) to state the subitem in the following edition:

"8) digital system – the organizational arranged set of the information and communication technologies, service personnel and technical documentation realizing certain technological actions by means of information exchange and intended for the solution of the specific functional objectives used by authorized body when implementing cameral control, integrated according to the Rules of integration of objects of informatization of "the digital government" approved by the order of the acting minister of information and communication of the Republic of Kazakhstan of March 29, 2018 No. 123 (it is registered in the Register of state registration of regulatory legal acts at No. 16777).";

10, of 11, 12 and 13 to state Items in the following edition:

"10. In case of identification of violations by results of cameral control of public procurements, department and its territorial subdivisions the notification on elimination of the violations revealed by results of cameral control, with the description of the revealed violations in form according to appendix 2 to these rules is drawn up and goes to objects of the state audit (further – the notification), and automatically is registered on the web portal.

In case of identification of violations by results of cameral control in digital system, except for the web portal department and territorial subdivisions the notification is drawn up and goes to objects of the state audit, and is registered in digital system.

11. The notification goes to object of the state audit from 8:30 till 18:00 o'clock, lunch break from 13:00 till 14:30 o'clock, except days off and holidays according to the Labor code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About holidays in the Republic of Kazakhstan", by means of the web portal and/or digital systems, no later than five working days from the date of identification of violations in time.

12. The notification is performed by object of the state audit within ten working days from the date of following behind day of its delivery (obtaining by means of the web portal and/or digital systems) to object of the state audit.

In case of independent elimination of the violations revealed by results of cameral control within five working days from the date of, the delivery following behind day to object of the state audit of the notification, the official is not subject to administrative prosecution.

13. Elements of cameral control of public procurements and methods of elimination of the violations specified in the notification are reflected in appendix 3 to these rules.

Information on execution of the notification (if necessary with appendix of supporting documents) is submitted object of the state audit by means of the web portal and/or digital systems in the department and its territorial subdivision which directed the notification in form according to appendix 4 to these rules.

Confirmation of execution of the notification is performed by means of the web portal and/or digital systems, department and its territorial subdivisions no later than three working days from the date of receipt of information from object of the state audit on execution of the notification.";

"18. Completion of cameral control on the web portal and/or digital systems the mark of the contractor and deputy manager of department and/or the first head of territorial subdivision of the department or person fulfilling its duties about lack of violations by results of the carried-out cameral control is recognized.

The notification on elimination of the violations revealed by results of cameral control is signed by the deputy manager of department and/or the first head of territorial subdivision of department or person persons performing their obligations.

Control of execution of the notification is exercised by the deputy manager of department and/or the head of territorial subdivision of department or person performing its obligations with mark about execution of the notification in the web portal and/or digital systems.

18-1. The notification on elimination of the violations revealed by results of cameral control directed by means of digital systems, registration of the notifications on elimination of the violations revealed by results of cameral control, directed by means of digital systems, except for the web portal of public procurements in form according to appendix 10 to these rules are subject to logging.";

22, 23 and 23-1 to state Items in the following edition:

"22. In case of disagreement with the decision of department of authorized body and (or) with the notification of territorial subdivision sent according to subitems 2) and 3) to part two of Item 21 of these rules the potential supplier, makes the complaint, object of the state audit – objection in the Appeal commission under authorized body (further – the Appeal commission) by means of public digital systems, including by means of the web portal in form according to appendix 5 and 6 to these rules, or takes a legal action.

23. In case of disagreement with the violations specified in the notification, object of the state audit gives by means of the web portal and/or digital systems on which the notification in the Appeal commission under authorized body (further – the Appeal commission) according to the procedure arrived and the terms established by Chapter 11-1 of the Law, objection to the violations specified in the notification on elimination of the violations revealed by results of cameral control in form according to appendix 6 to these rules.

Object of the state audit provides copies of the documents confirming objection arguments by means of the web portal and/or digital systems on which the notification arrived.

23-1. In case of disagreement with the violations specified in the notification of department of authorized body, the potential supplier by means of the web portal and/or digital systems makes the complaint in the Appeal commission.";

state Item 26 in the following edition:

"26. By results of consideration of objection by the Appeal commission one of the following decisions is accepted:

1) about satisfaction of objection – in case of satisfaction of all questions disputed by object of the state audit;

2) about partial satisfaction of objection – in case of partial satisfaction of the questions disputed by object of the state audit;

3) about refusal in satisfaction of objection with reasons for adoption of such decision – in case of dissatisfaction of all questions disputed by object of the state audit according to the procedure and the terms established by Chapter 11-1 of the Law.

Results of consideration of objection are drawn up by the conclusion by results of consideration of objection (further – the conclusion), in form according to appendix 7 to these rules.

The conclusion are registered and goes to object of the state audit by means of the web portal and/or digital systems on which the notification arrived.";

state Item 37 in the following edition:

"37. Results of cameral control are placed on the web portal and/or in digital systems.";

appendix 2 to the specified Rules to be reworded as follows according to appendix 1 to this List;

appendix 10 to the specified Rules to be reworded as follows according to appendix 2 to this List.
