About questions of procedure for realization of the vehicles which are in state-owned property
For the purpose of optimization of procedure for alienation of state-owned property, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Approve Regulations on procedure for realization of the vehicles which are in state-owned property according to appendix.
1) the order of the Government of the Kyrgyz Republic "About approval of methodical recommendations about value assessment of property of subjects to privatization" of March 19, 2003 No. 143;
2) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of March 19, 2003 No. 143 "About approval of methodical recommendations about value assessment of property of subjects to privatization" of September 17, 2007 No. 414;
3) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of March 19, 2003 No. 143 "About approval of methodical recommendations about value assessment of property of subjects to privatization" of July 2, 2008 No. 357;
4) Item 2 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of August 16, 2008 No. 463;
5) Item 1 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic regulating questions of privatization of state-owned property" of December 8, 2010 No. 309.
3. This resolution becomes effective after fifteen days from the date of official publication.

Appendix
to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of April 20, 2026 No. 266
1. This Provision determines procedure and sales terms of the vehicles which are in state-owned property. At the same time vehicles are understood as all types of vehicles (not suitable for use for the purposes of activities of state bodies; which are subject to realization in connection with acquisition of new vehicles; with expired useful life), subject to realization according to this Provision.
2. Realization of the vehicles which are in state-owned property is performed by means of running an electronic auction, and also the different ways provided by this Provision.
3. The realization of vehicles is enabled on the principles of legality, publicity, equality of participants and ensuring the competition.
4. Any legal entities and physical persons can be buyers (acquirers) of the vehicles which are in state-owned property.
5. In this Provision the following concepts are used:
1) authorized state body - the authorized state body in the field of management of state-owned property providing coordination of questions of implementation of realization of vehicles;
2) the asset holder - organizations and the companies with the state pattern of ownership, including the state organizations, in economic maintaining or operational management of which are the state vehicles;
3) electronic auction - the biddings on the realization of the vehicle performed electronically with use of electronic trading platform;
4) the initial price - the vehicle cost established as initial (starting) at electronic auction;
5) bid increment - the allowance by which the starting price and each following price created by electronic trading platform raises during trading;
6) the guarantee fee - the sum of money granted by the applicant who showed willingness to participate in electronic auction for the purpose of acquisition of property right to the vehicle;
7) the electronic trading platform (ETP) - the information trade system placed on the Internet for the organization of electronic auction with possibility of remote participation of subjects of electronic auction by means of making of electronic procedures without the need for their physical presence;
8) regulations of ETP - set of the rules determining the operating procedure of electronic trading platform determined by authorized state body;
9) target realization - sale of the vehicle to certain physical person or legal entity;
10) the vehicle - the device intended for transportation across roads of people and loads or the equipment installed on it and also tractors and self-propelled technological machines.
6. Market value of the vehicle which is subject to realization is determined by results of independent assessment according to the legislation of the Kyrgyz Republic in the field of estimative activities.
7. The main functions of authorized state body are:
1) coordination of questions of realization of vehicles;
2) realization of vehicles according to the procedure, established by this Provision;
3) development of regulatory legal acts in the field of management of state-owned property;
4) development and approval of the regulations of ETP determining procedure for carrying out the electronic biddings, participations and interactions of the parties;
5) forming by means of ETP of summary statistical and analytical information on the held electronic auction;
6) the conclusion of the contract with the organization operator of the ETP which is responsible for technical support and uninterrupted operation of the portal of the electronic biddings;
7) maintaining the register of the signed purchase and sale agreements of vehicles;
8) implementation of the best practice and innovative technologies in electronic trading system on ETP;
9) carrying out information work on questions of the organization of the electronic biddings on ETP;
10) ensuring administration of ETP;
11) ensuring transparency and legality of electronic trade procedures;
12) providing the timely publication of the information message about running an electronic auction, and also results of electronic auction on ETP;
13) interaction with civil society concerning enhancement of electronic trading system on ETP;
14) other powers according to this Provision.
8. The asset holder for the purpose of realization of the vehicle through electronic auction allocates to authorized state body by means of ETP document package with appendix of passport specifications of the vehicle and reasons for need of sale.
Realization of the vehicle is made based on the following documents:
1) statement for exposure of the vehicle to electronic auction (appendix 1);
2) the decision of the asset holder and the reference reasons to it with reasons for need of realization;
3) act of technical condition of the vehicle (appendix 2);
4) the certificate of original (historical) cost certified by the head and the chief accountant of the asset holder (appendix 3);
5) report of the independent appraiser (estimative organization) on market value.
Heads of asset holders bear responsibility for reliability of the provided documents to authorized state body for realization of vehicles in cases and procedure, stipulated by the legislation about offenses, the labor, civil and penal legislation of the Kyrgyz Republic.
9. The electronic auction on realization of vehicles is held on auctionetp.gov.kg electronic platform according to the procedure, established by this Provision.
10. Asset holder:
1) makes the decision on realization of the vehicle;
2) carries out pre-sale preparation of the vehicle;
3) is provided by timely placement of the information message about running an electronic auction on the official website or the website of the superior state organization;
4) holds the events directed to informing and involvement of interested persons to participation in electronic auction;
5) is provided by possibility of visual acquaintance of potential buyers with the vehicle, and also documents on this vehicle;
6) perfroms calculation with applicants, participants and the winner of electronic auction;
7) is concluded with the winner of electronic auction (buyer) by the purchase and sale agreement of the vehicle;
8) provides transfer of the vehicle to the winner of electronic auction (buyer) in accordance with the terms of the purchase and sale agreement;
9) performs other functions according to regulations of ETP and this Provision.
11. Authorized state body within one month from the date of receipt of the statement from the asset holder:
1) accepts the documents prepared for implementation of electronic auction;
2) compares actually submitted documents with the list;
3) is revealed by lack of obligatory documents or discrepancy of their form and content to the established requirements;
4) in case of positive result is placed on ETP by the information message about running an electronic auction;
5) in case of identification of shortcomings returns materials for completion or amendment.
12. The information message about running an electronic auction shall be published on the official website of the asset holder or his superior state organization, ETP no later than 10 calendar days before date of its carrying out.
13. In the information message are specified:
1) name of the asset holder, its location and contact telephone numbers;
2) date and time of running an electronic auction;
3) photo of the implementable vehicle;
4) brand, model, technical characteristics of the vehicle;
5) year of release, engine displacement, vehicle fuel type;
6) starting price of realization of the vehicle;
7) the size of the guarantee fee, term and procedure for its introduction, details of the current (settlement) bank account on which it shall be listed;
8) other data (if necessary).
14. All document flow between the participants of electronic auction or persons having the right to act on behalf of participants of electronic auction is conducted electronically on ETP, except for the purchase and sale agreement of the vehicle which consists in writing.
Documents electronically are recognized the digital signature of the owner and the subsequent attachment, valid on condition of their signing, in accordance with the established procedure.
Signing of electronic documents and data the digital signature confirms that they are directed on behalf of appropriate subject of ETP which bears responsibility for authenticity and reliability of such documents and data.
15. In case of realization of the vehicle the authorized state body in the procedure established by the legislation involves the independent appraiser or the estimative organization to rendering services in vehicle value assessment.
16. In case of impossibility of realization of the vehicle through electronic auction the vehicle is subject to target realization.
17. Target realization of the vehicle is allowed in cases and procedure, stipulated in Item the 35th this provision.
18. Transfer of vehicles to property physical and legal persons, and also to the state companies, economic societies with the control state block of shares, to non-profit organizations is on a grant basis performed according to the decision of the Cabinet of Ministers of the Kyrgyz Republic based on the proposal of the President of the Kyrgyz Republic, the Chairman of the Cabinet of Ministers of the Kyrgyz Republic.
At the same time voluntary conveyance of vehicles shall correspond to the principle of proportionality. Voluntary conveyance of vehicles in property to the physical persons and legal entities which made the significant contribution to social and economic development of the country for the purpose of their encouragement is allowed. Also voluntary conveyance is allowed for the purpose of support of socially vulnerable categories of citizens, assistance to development of science, education, culture and sport, realization of charitable and humanitarian initiatives and other socially significant directions.
To hand over the state companies, economic societies with the control state block of shares which received the vehicle on a grant basis having no right them in the sublease, pledge, to bring as contribution to the authorized capital of legal entities, and also to otherwise encumber the specified property.
Can be carried to the bases for transfer of vehicles:
1) providing the socially important purposes (support of needy citizens, disabled people, veterans, educational, medical and cultural institutions);
2) accomplishment of the certain successful national or public objectives having strategic importance for the country;
3) assistance to development of science, the education, culture, sport and other spheres having the public importance;
4) encouragement of citizens, physical persons, the organizations which made the significant contribution to social and economic development of the Kyrgyz Republic;
5) the charitable and humanitarian purposes directed to improvement of living conditions of the population;
6) other initiatives of social orientation.
19. The electronic auction is held according to regulations of ETP and this Provision for the purpose of ensuring transparency, equal access and competition in case of realization of vehicles by means of ETP.
20. The procedure of electronic auction is spent in the day and time specified in the information message about running an electronic auction by consecutive increase in starting price by participants of electronic auction.
21. For participation in electronic auction the participant shall:
1) to be registered on ETP;
2) to submit the application for participation in electronic auction (appendix 4);
To deposit 3) to account, specified in the information message, the guarantee fee not later than day prior to the electronic auction in the amount of established by this Provision;
4) to provide the documents specified in the information message.
Legal entities in addition represent:
1) copy of the certificate on state registration (re-registration) of the legal entity;
2) the copies of constituent documents of the legal entity certified in accordance with the established procedure;
3) the copy of the decision on appointment of executive body of the legal entity certified in accordance with the established procedure;
4) certificates of tax authority and Social fund of the Kyrgyz Republic of absence at the applicant of the tax liability in budgets of all levels and to insurance premiums as of date of application. This requirement is not obligatory for the foreign applicant - the nonresident of the Kyrgyz Republic;
5) the warrant in the name of of the representative authorizing him to act on behalf of the legal entity and to make the corresponding transactions in case documents on behalf of the legal entity are filed not by the head.
If the application is submitted by the representative of the applicant (buyer), then it is necessary to provide the notarized power of attorney on person having the right to act on behalf of the applicant (buyer).
Documents can be submitted in case of possibility of receipt of such documents from other state bodies by means of system of electronic interaction Tunduk.
22. The participant has the right to withdraw the application for participation in electronic auction at any time, but not later than three days before running an electronic auction, by the direction of the notification on withdrawal of the request for ETP.
The authorized state body / asset holder has the right to cancel/refuse electronic auction at any time, but not later than three days before date of its carrying out, with the proper notice of participants of electronic auction by means of ETP.
23. The size of the guarantee fee constitutes 10% of starting price of the vehicle.
To the winner of electronic auction the guarantee fee is set off in payment for the vehicle acquired at auction.
To the participants who are not declared as the winners of electronic auction, the guarantee fee returns no later than 10 working days from signature date of the protocol on results of electronic auction in time.
In case of cancellation/refusal of running an electronic auction the brought guarantee fees of applicants are subject to return no later than 10 working days from the date of placement of the adequate notice in time.
24. The step of electronic auction is established in the fixed size determined as percent from starting price of the vehicle and does not change during the auction.
The step of electronic auction is determined from starting price of the vehicle in the following sizes:
1) to 100000 som - 5%;
2) from 100001 som to 300000 som - 4%;
3) from 300001 som to 500000 som - 3%;
4) over 500001 som - 1%.
25. The winner of electronic auction the participant who offered the highest price for the implementable vehicle is recognized.
26. Results of the procedure of running an electronic auction are drawn up by the protocol on results of electronic auction which take place on ETP no later than the next working day after its signing.
27. The procedure of electronic auction is considered completed from the moment of signing by the asset holder and winner of electronic auction of the protocol on results of electronic auction.
The protocol on results of electronic auction is subject to signing no later than 10 working days from the date of holding procedure of electronic auction in time.
28. The purchase and sale agreement is subject to the conclusion with the winner of electronic auction no later than 10 working days from the date of signing of the protocol on results of electronic auction in time.
29. In case of refusal the winner of electronic auction from signing of the protocol on results of the electronic biddings or the conclusion of the purchase and sale agreement the guarantee fee does not return and transferred into the republican budget.
30. The participant of electronic auction declared as the winner and who twice refused the conclusion of the purchase and sale agreement on one or different electronic auctions during six calendar months loses the right of participation in all electronic auctions for a period of one calendar year estimated from the date of the second refusal and is subject to inclusion in the register of unreliable applicants.
If between refusals there passed more than six months, the first refusal is not considered.
31. The electronic auction is recognized cancelled the following cases:
1) any application for participation in electronic auction is not submitted or any of applicants is not acknowledged as ETP his participant;
2) only one applicant is recognized by ETP as the participant;
3) any of participants of electronic auction did not make price offers after ten minutes since the beginning of electronic auction;
4) the winner of electronic auction refused signing of the protocol on results of electronic auction or the conclusion of the purchase and sale agreement.
Non-recognition of ETP of the applicant by the participant is understood as refusal in the admission to participation in electronic auction on the bases provided by this Provision and the regulations of ETP including:
1) discrepancy of the request to requirements of documentation of electronic auction;
2) non-compliance with specifications of application;
3) loss of the right of participation in electronic auction;
4) identification of the violations interfering participation of the applicant in electronic auction.
32. The decision on recognition of electronic auction cancelled is drawn up by the protocol of ETP on results of electronic auction.
33. In case of recognition of electronic auction cancelled the guarantee fees brought by participants are subject to return no later than 10 working days from the date of decision making about recognition of the biddings by cancelled in time.
34. If the electronic auction is acknowledged cancelled, the authorized state body shall within 10 working days from the date of such recognition repeatedly offer the vehicle for electronic auction.
35. In case of recognition of repeated electronic auction cancelled the asset holder has the right to address with the petition to authorized state body for realization of the vehicle to the single participant of repeated electronic auction.
In case of refusal the single participant of repeated electronic auction from acquisition of the vehicle the asset holder has the right to address to authorized state body with the petition for realization of the vehicle to the certain physical person or legal entity which expressed intention to acquire it.
The following documents are attached to the petition:
1) copy of the protocol on recognition of repeated electronic auction cancelled;
2) the document containing the information about the single participant of repeated electronic auction (in the presence);
3) written refusal of the single participant of acquisition of the vehicle (in the presence);
4) the valuation report of cost of the vehicle constituted in accordance with the established procedure;
5) the document containing data on technical condition of the vehicle;
6) the document containing information on the expected acquirer including the data allowing to identify it, and also confirmation of its intention to acquire the vehicle;
7) reasons for feasibility of realization of the vehicle.
36. The authorized state body considers the submitted documents within 30 calendar days from the date of receipt of the petition.
In the written consent of authorized state body the asset holder signs the purchase and sale agreement with the buyer and realizes the vehicle in accordance with the established procedure.
37. The purchase and sale agreement of the vehicle is signed between the asset holder and the winner of electronic auction (buyer) in 3 copies (appendix 5):
1) one copy remains at the asset holder;
2) one copy is transferred to the buyer;
3) one copy goes to authorized state body in the field of registration of vehicles and driver's structure.
38. The authorized state body after provision by the winner of electronic auction (buyer) of the document confirming introduction of complete payment approves the purchase and sale agreement.
39. In the purchase and sale agreement are specified:
1) information about the asset holder and buyer;
2) determination of the subject of the agreement;
3) data on the vehicle;
4) price of the acquired vehicle;
5) form and payment due dates for the acquired vehicle;
6) other conditions established by the parties of such agreement under the mutual agreement.
40. Transfer of the vehicle is performed after complete payment, its registration in registration authorities of vehicles and driver's structure and signing of the delivery-acceptance certificate (appendix 6).
41. Means from realization of vehicles remain at the disposal of the asset holder if the state-owned property is transferred to it on the right of economic maintaining.
42. The realized vehicle is subject to state registration (re-registration) in the terms and procedure established by the legislation of the Kyrgyz Republic in the field of state registration, re-registration of vehicles, installations and the equipment, and also the property rights to them.
