About approval of the Regulations on realization of the state task

For the purpose of implementation of article 4-1 of the Law of the Kyrgyz Republic "About public procurements", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on realization of the state task according to appendix.

2. To the Ministry of Finance of the Kyrgyz Republic to take the necessary measures following from this resolution.

3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This resolution becomes effective after seven days from the date of official publication.

Regulations on realization of the state task

Chapter 1. General provisions

1. The presents the Regulations on realization of the state task (further - the Provision) are developed for the purpose of implementation of article 4-1 of the Law of the Kyrgyz Republic "About public procurements" and determine procedure for forming of the list and accomplishment of the state task.

2. In this Provision the following concepts are used:

1) the state customer - the state body, local government body, the public and local government offices, funds and other legal entities created at the expense of public funds, means of state bodies or local government bodies;

2) authorized state body on forming and maintaining the list of the state tasks (further - authorized body) - Department of public procurements under the Ministry of Finance of the Kyrgyz Republic;

3) the contractor of the state task - the public and local government offices, the state and municipal companies, and also economic societies in which authorized capital the share of the state participation constitutes 50 and more percent, including their affiliated economic societies;

4) subcontractor (collaborator) - the legal person / the individual entrepreneur involved by the contractor of the state task in accomplishment of part of the state task in cases and procedure, stipulated by the legislation the Kyrgyz Republic and this Provision.

3. The state task is the order at the expense of means republican and local budgets to legal entities with participation of the state in the authorized capital on accomplishment of the priority national objectives aimed at providing social and economic stability and (or) welfare development of the state.

4. Allocation of budgetary funds to legal entities with participation of the state in the authorized capital on accomplishment of the state task is performed without increase in the authorized capital.

5. The goods, works and services acquired within the state task will be bought in exceptional cases strictly in the following priority directions:

1) in spheres of culture, tourist activities, protection and use of objects of historical and cultural heritage;

2) in education, sciences and health cares;

3) on the organization and holding actions by Administration of the President of the Kyrgyz Republic and its subordinated divisions;

4) on construction, reconstruction, repair, content and development of highway network public, the international and republican value;

5) on creation, increase, updating and upgrade of fixed assets, and also development of industries of economy;

6) on the organization and holding official actions at the national level in the territory of the Kyrgyz Republic with participation of the President of the Kyrgyz Republic, Toraga of Jogorku Kenesh of the Kyrgyz Republic, the Chairman of the Cabinet of Ministers of the Kyrgyz Republic.

6. The state customer and the contractor of the state task bear the personal responsibility for target and effective use of budgetary funds within realization of the state task.

7. Transfer of the state task to the contractor of the state task, and also transfer of the state task by the contractor to subcontractor (collaborator) is performed by the state customer proceeding from the principles of openness, impartiality, publicity, transparency and compliance with law of the Kyrgyz Republic about conflict of interest and anti-corruption.

Chapter 2. Authorized body

8. The authorized body enables development and the realization of state policy on accomplishment of the state task.

9. The main functions of authorized body on accomplishment of the state task are:

1) project development of the regulatory legal acts concerning the sphere of the state task including forming and maintaining the Register of the state task;

2) coordination, regulation, assistance and monitoring of realization of the state task;

3) placement on the official site of authorized body on accomplishment of the state task of the List of the state tasks;

4) accountability for inadequate realization of the state task according to the procedure, stipulated by the legislation the Kyrgyz Republic;

5) forming of statistical and analytical information regarding realization of the state task;
