About introduction of temporary ban (moratorium) on conducting checks of subjects of entrepreneurship

In the field of state regulation of business activity system problems which negatively influence development of entrepreneurship and business environment remain, and also promote decrease in trust from business community and to reduction of general economic activity.

One of the most significant problems remains the excessive number of checks and the facts of abuse of authority from law enforcement agencies, tax and other monitoring bodies, local government bodies and the city halls of the cities of Bishkek and Osh. On similar actions addresses and claims from representatives of small, medium and large business, including commercial banks regularly arrive. Cases of unreasonable, duplicative or actually illegal checks and raid actions are the most widespread.

For the purpose of stabilization of economic activity of subjects of entrepreneurship, ensuring development of business environment, improvement of the investment climate, elimination of unreasonable and excessive intervention of state bodies in activities of subjects of entrepreneurship, according to Articles 66, I decide 71 Constitutions of the Kyrgyz Republic:

1. Impose till December 31, 2026 the moratorium on the inspections of subjects of entrepreneurship which are carried out by the law enforcement and other authorized bodies having the right to conducting checks of subjects of entrepreneurship, except for the checks performed:

1) within criminal and civil trial;

2) according to statements of the subjects of entrepreneurship which are subjects of check according to the legislation of the Kyrgyz Republic;

3) on requests of state bodies of other countries;

4) according to appeals of physical persons and legal entities;

5) at the request of officials of state bodies and local government bodies, in case of concrete facts of violation by the subject of entrepreneurship of the legislation of the Kyrgyz Republic with application of documents, materials and other confirmatory data, including in the form of publications in mass media;
