About modification of Storage precautions, protection, uses and disclosures of bank secrecy
According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 62 of the Law of Ukraine "About banks and banking activity", for the purpose of enhancement of procedure for disclosure of information which is bank secrecy, the Board of the National Bank of Ukraine decides:
1. Bring in Chapter 3 of Storage precautions, protection, uses and the disclosures of bank secrecy approved by the resolution of Board of the National Bank of Ukraine of July 14, 2006 No. 267, registered in the Ministry of Justice of Ukraine on August 03, 2006 at No. 935/12809 (with changes), the following changes:
The subitem 2 of Item 2 to state 1) in the following edition:
"2) in electronic form - the qualified digital signature or the advanced digital signature with the qualified certificate, or other digital signature of this person created according to requirements of the Regulations on use of the digital signature and electronic seal approved by the resolution of Board of the National Bank of Ukraine of December 20, 2023 No. 172 (further - No. Provision 172).";
The subitem 2 of Item 3 to state 2) in the following edition:
"2) in electronic form - the qualified digital signature or the advanced digital signature with the qualified certificate, or other digital signature of the head or authorized by it persons created according to requirements of the Provision No. 172.";
3) the first offer of Item 13 to state in the following edition:
"13. Banks provide to the authorized state body and persons determined in the Law on banks, information which is bank secrecy in paper or electronic form if it is determined in request of authorized state body and persons determined in the Law on banks.";
