1. Approve Storage precautions, protection, uses and disclosures of bank secrecy (are applied).

2. To legal department (V. V. Pasichnik) after state registration in the Ministry of Justice of Ukraine to bring contents of this resolution to permission of territorial administrations of the National Bank of Ukraine and banks for use in work.

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine V. L. Krotyuk, Legal department (V. V. Pasichnik) and chiefs of territorial administrations of the National Bank of Ukraine.

4. The resolution becomes effective in 10 days after state registration in the Ministry of Justice of Ukraine.

Storage precautions, protection, uses and disclosures of bank secrecy

1. General provisions

1.1. These Rules are developed according to the Civil code of Ukraine, the Criminal Procedure Code of Ukraine, the Laws of Ukraine "About banks and banking activity", "About the National Bank of Ukraine", "About electronic confidential services", "About electronic documents and electronic document management" and determine requirements to protection, storage, use and disclosure of information which contains bank secrecy.

The procedure and amounts of disclosure by National Bank and banks of information which contains bank secrecy are determined by the Civil code of Ukraine, the Law of Ukraine "About banks and banking activity" and these rules.

1.2. Banks shall provide storage and information security which contains bank secrecy, for the purpose of non-admission of its illegal disclosure and task thereof material or moral damage to the investors, creditors and other clients.

Item 1.3. No. 194, with respect thereto Items 1.4-1.8 is excluded according to the Resolution of Board of the National Bank of Ukraine of 04.06.2013 to consider respectively Items 1.3-1.7.

1.3. Employees of bank in case of acceptance them for work sign the obligation concerning preserving bank secrecy.

1.4. Banks shall display in coordination with the client in contracts which are signed between bank and the client, clause concerning preserving bank secrecy and responsibility for its illegal disclosure or use.

1.5. For the purpose of prevention of unauthorized information access, containing bank secrecy, subjects which have access to such information, in own instructions on clerical work taking into account features of the activities shall establish special order of registration, uses, storage and access to the documents containing bank secrecy.

Legal entities and physical persons, and also officials who during accomplishment of the functions and/or provision of services of bank directly or mediately obtained information containing bank secrecy not disclose this information and not use it in own favor or for benefit of the third parties, except cases, stipulated by the legislation Ukraine.

1.6. Banks and their heads who are guilty of violation of these Rules bear responsibility, the stipulated in Article 73 Laws of Ukraine "About banks and banking activity" (further - the Law on banks).

1.7. Illegal collection for the purpose of use or use of the data which are bank secrecy, and/or disclosure of bank secrecy involves the responsibility provided by the law.
