ORDER OF THE MINISTER OF TRANSPORT OF THE REPUBLIC OF KAZAKHSTAN

About modification and amendments in the order of the acting minister on investments and development of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of July 28, 2017 No. 509 "About approval of Rules of production of flights in civil aviation of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 15852) the following changes and amendments:

State preamble in the following edition:

"According to the subitem 4) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" I ORDER:";

in Rules of production of the flights in civil aviation of the Republic of Kazakhstan approved by the specified order:

state Item 1 in the following edition:

"1. These rules of production of flights in civil aviation of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 4) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) taking into account aviation standards of the international organizations in the field of civil aviation.

These rules determine procedure for Production of flights in airspace of the Republic of Kazakhstan, and also airspace of other state (high seas) if they do not contradict requirements of this state (requirements ИКаАО established for the high seas), for the purpose of implementation of the commercial air transportations, aviation works and flights of aircraft of general purpose which are carried out according to requirements of the International standards and Recommended practice stated in Annexes to the Convention on international civil aviation (further – the Convention ICAO).";

in Item 2:

5) to state the subitem in the following edition:

"5) the emergency drive transmitter (further - ELT) – the general term used concerning the equipment which transmits distinctive signals at the set frequencies and depending on application type, can work automatically as a result of blow, or be put in action manually. ELT, maybe, one of the following types:

automatic stationary ELT(AF) – automatically the working ELT which is stationary established onboard the aircraft;

automatic portable ELT(AP) – automatically the working ELT which not movably is fixed onboard the aircraft, but easily is removed from board of this aircraft;

automatically the developed ELT(AD) – ELT which not movably is fixed onboard the aircraft and is automatically developed and works as a result of blow, and, in certain cases, is also put in action by hydrostatic sensors, also its expansion manually is provided;

rescue ELT(S) – ELT which is removed from aircraft board is placed so that it could be used easily in emergency environment, and is put in action manually survived;

automatic stationary ELT(DT) - automatically the working ELT which is stationary established onboard the aircraft on tracking of disaster during flight;"

add with subitem 10-1) of the following content:

"10-1) aspects of human factor – the principles applicable to design processes, certification, trainings, operational activities and maintenance in aircraft and aimed at ensuring safe interaction between the person and other components of system by means of proper accounting of opportunities of the person;";

add with subitem 15-1) of the following content:

"15-1) special approval - represent the approval documented in operational specifications on accomplishment of commercial air transportations and also aircraft of general purpose;";

add with subitem 29-1) of the following content:

"29-1) state of registration of the aircraft – the state in which register the aircraft is entered;";

30) to state the subitem in the following edition:

"30) management on flight operation of the aircraft – the management accepted for authorized the organizations and including operations procedure in regular, special and emergency situations, control cards, restrictions, information on flight technical characteristics and data on systems of the aircraft, and also other materials connected with operation of the aircraft;";

add with subitem 40-1) of the following content:

"40-1) state of airfield – the state in the territory of which the airfield is located;";

add with subitem 42-1) of the following content:

"42-1) basic aircraft – the aircraft with the minimum structure of the equipment required for accomplishment of expected take-off, landing approach and landing;";

68) to exclude the subitem;

add with subitem 70-1) of the following content:

"70-1) land servicing – the servicing necessary in case of arrival of the aircraft in the airport (airfield) or departure of the aircraft from the airport (airfield) which is not including servicing of air traffic;";

add with subitem 73-2) of the following content:

"73-2) expanded operational opportunities – the operational opportunities permitted for flight of the aircraft with expanded opportunities and providing lower operational minima of airfield in comparison with those which would be usually resolved for the basic aircraft, and based on characteristics of the systems of the aircraft with expanded opportunities using the available external infrastructure;";

add with subitem 89-1) of the following content:

"89-1) target objective of safety (TLS) – the general term meaning risk level which is considered admissible in specific conditions;";

90) to state the subitem in the following edition:

"90) dangerous goods – the products or substances creating threat of life and to health, safety and property of the person or the environment, specified in the list of the dangerous goods determined by the Instruction for the transportation of dangerous goods by air on civil aircrafts approved by the order of the Minister of investments and development of the Republic of Kazakhstan of June 21, 2017 No. 371 (it is registered in the Register of state registration of regulatory legal acts for No. 15370);";

91) to exclude the subitem;

add with subitem 107-1) of the following content:

"107-1) aircraft with expanded opportunities – the aircraft with the equipment supplementing the equipment required for accomplishment by the basic aircraft of specific take-off, landing approach or landing;";

108) to state the subitem in the following edition:

"108) the navigation specification – set of the requirements to the aircraft and flight crew necessary for ensuring flights in the conditions of the navigation based on characteristics within the established airspace.

There are two types of navigation specifications:

the specification of required aeronautical characteristics (RNP) – the navigation specification based on zone navigation which includes the requirement to control of keeping and issue of warnings of non-compliance with the characteristics designated by RNP prefix, for example RNP 4, RNP APCH.

the specification of zone navigation (RNAV) – the navigation specification based on zone navigation which does not include the requirement to control of keeping and issue of warnings of non-compliance with the characteristics designated by RNAV prefix, for example RNAV 5, RNAV 1;";

add with subitem 108-1) of the following content:

"108-1) main point – the established geographical place used for determination of route of Department of Internal Affairs, trajectory of flight of the aircraft and for other purposes of navigation and Department of Internal Affairs;";

add with subitem 114-2) and 114-3) of the following content:

"114-2) operational base – the place from which management of flights is performed;

114-3) operational specifications – permissions, including the special approvals, conditions and restrictions connected with the air operator certificate and depending on the conditions stated in management on production of flights;";

add with subitem 114-4) of the following content:

"114-4) state of the operator – the state in which there is the main place of activities of the operator or if the operator does not take such place of activities, the permanent place of stay of the operator;";

add with subitem 118-2) of the following content:

"118-2) operational minima of airfield based on characteristics (PBAOM) - lower operational minima of airfield for specific transactions of take-off, landing approach and landing in comparison with the minima used when flying the basic aircraft;";

add with subitem 121-1) of the following content:

"121-1) flight of the increased extent over water space – the flight which is carried out over water at distance more than 93 km (50 m of miles) or 30 min. flight at normal cruiser speed depending on the fact that it is less, from the land area acceptable for implementation of crash landing;";

126) to exclude the subitem;

add with subitem 131-1) of the following content:

"131-1) flights in the conditions of limited visibility (LVO) – landing approach in case of RVR values less than 550 m and/or in case of DH values less than 60 m (the 200th foot) or take-off in case of RVR values less than 400 m;";

add with subitems 133-1) and 133-2) of the following content:

"133-1) night vision glasses (NVG) – the head-mounted binocular device of night vision which principle of action it is based on strengthening of brightness of the image of observed objects by electron-optical converters of strengthening of light which expands possibilities of visual orientation of surface at night and also allow to observe meteorological educations in the form of clouds, rainfall and ground fog;

133-2) system of night vision (NVIS) – integration of all elements necessary for successful and safe use of ONV in case of management of AF. The system includes at least: ONV, the lighting equipment its components on AF is adapted to work of crew with ONV, professional training of aviation personnel.";

paragraphs the forty fifth, the sixty eighth, the sixty ninth, seventieth to exclude parts two of Item 2:

eighty six parts two of Item 2 to state the paragraph in the following edition:

"EDTO – production of flights with the increased leaving time for reserve airfield;";

138) to state the subitem in the following edition:

"138) threshold time – the distance established by authorized organization expressed in flight time to reserve airfield on route which any exceeding requires special approval of flight of EDTO by authorized organization;";

add with subitem 138-1) of the following content:

"138-1) production of flights with the increased leaving time for reserve airfield (EDTO) – any flights of the airplane with two or more gas turbine engines when flight time to reserve airfield on route exceeds the threshold time established by authorized organization;";

140) to state the subitem in the following edition:

"140) landing strip threshold - the beginning of the site of landing strip which can be used for landing;";

142) to exclude the subitem;

144) to exclude the subitem;

add with subitem 158-1) of the following content:

"158-1) management of flights – implementation of powers concerning the beginning, continuations or the ends of flight, and also change of route for the benefit of safety of the aircraft, regularity and efficiency of flight;";

160) to state the subitem in the following edition:

"160) the employee on ensuring flights / the flight dispatcher – person designated by the operator for control and observation of production of flights which has the qualification conforming to requirements of Standard programs of professional training of the aviation personnel participating in safety of the flights approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 28, 2013 No. 764 (it is registered in the Register of regulatory legal acts for No. 8785), and gives support, instructs and (or) helps the commander of the aircraft with ensuring safe accomplishment of flight;";

169) to state the subitem in the following edition:

"169) flight of the increased range – any flight which is carried out by airplane with two gas turbine engines in case of which flight time with cruiser speed (in the conditions of MSA and in calm conditions) in case of one idle engine from any point of route to the reserve airfield conforming to requirements exceeds the threshold time established by authorized organization;";

add with subitem 169-1) of the following content:

"169-1) exhaustion - physiological condition of the lowered intellectual or physical working capacity as a result of sleeplessness, long wakefulness, phase of daily rhythm and/or operational load (intellectual and/or physical activities) which can worsen activity and capability of the person properly to fulfill the service duties connected with safety of flights;";

add with subitem 174-1) of the following content:

"174-1) wet landing strip – the surface of the runway covered with any visible layer of moisture or water up to 3 mm in depth inclusive within zone, held for use;";

178) to exclude the subitem;

180) to state the subitem in the following edition:

"180) landing approach with continuous decrease on the final site (CDFA) – compatible to schemes of landing approach in the set mode of the technician of piloting on the final site of landing approach (FAS) according to the scheme of the inexact landing approach on devices (NPA) performed with continuous decrease, without equalization in flight, from the absolute / relative height equal to absolute/relative height in final control point of landing approach or exceeding this height, to the point located at the height about 15 m (the 50th foot) over landing threshold of the runway or to point where for this type of the aircraft the maneuver of equalization before landing begins; on FAS according to the scheme NPA with the subsequent landing approach around technology of piloting of CDFA is applied before achievement of minimum of landing approach around (OCA/H of flight around) or the absolute/relative height of visual maneuver in flight;";

the forty fifth parts two of Item 2 to exclude the paragraph;

paragraphs the sixty eighth, the sixty ninth, seventieth to exclude parts two of Item 2;

to exclude the paragraph of the eighty sixth part two of Item 2;

3, 4 and 5 to exclude Items:

state Items 8 and 9 in the following edition:

"8. The operator or the representative appointed by him is responsible for management of flights.

9. The commander of the aircraft (further - KVS) and the employee on ensuring flights / the flight dispatcher if the control method approved by the operator and observations of production of flights provides its use, are responsible for management of flights.";

add with Items 10-1 and 10-2 of the following content:

"10-1. The employee on ensuring flights / the flight dispatcher when he works according to control method and observations of production of flights carries out the following obligations:

1) gives help of KVS in preparation for flight and provides the relevant information;

2) gives help of KVS in preparation of working flight plan and flight plan for Department of Internal Affairs, signs when it is applicable, and represents flight plan for Department of Internal Affairs to the Department of Internal Affairs relevant organ;

3) by means of appropriate means is provided by KVS in flight with information which can be necessary for safe accomplishment of flight;

4) is notified by the Department of Internal Affairs relevant organ in that case when it is not possible to determine location of the airplane by tracking AF, and attempts to establish connection are unsuccessful.

10-2. In case of emergency environment the employee on ensuring flights / the flight dispatcher:

1) is initiated by performing procedures, the flights provided by management on production, avoiding at the same time undertaking of any action which would contradict rules of the Department of Internal Affairs;

2) KVS transfers information concerning safety of flights which can be necessary for safe accomplishment of flight, including information concerning any changes of flight plan which need arises during this flight.";

state Items 15 and 16 in the following edition:

"15. The operator in case of accomplishment of the international flights provides possibility of conducting radio exchange and communication of KVS and crew members according to specified in management on flight operation (further - RLE) or RPP procedures with aviation personnel, land services, including services Department of Internal Affairs, and representatives of authorized body of foreign state in the language used when conducting radiotelephone communication and to understand it as it is specified in the Rules of testing for determination of level of proficiency in the English used in radiotelephone communication, approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 25, 2013 No. 748 (it is registered in the Register of state registration of regulatory legal acts for No. 8783).";

16. Operators, except for belonging to AON and operating airplanes with the maximum certified take-off weight of 5700 kg and less, and helicopters with the maximum certified take-off weight of 3175 kg and less, according to the Program for safety of flights in the field of the civil aviation approved by the order of the Government of the Republic of Kazakhstan of March 11, 2016 No. 136 develop and implement SUBP, according to the minimum requirements of Standard instructions for safety management of flights of operators of civil aircrafts, at the airports, when servicing air traffic, in case of maintenance of aircrafts, approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of March 28, 2011 No. 173 (it is registered in the Register of state registration of regulatory legal acts No. 6855).";

state Item 20 in the following edition:

"20. The program of the analysis of flight data includes proper guarantees of protection of source (sources) of data.";

add with Item 23-1 of the following content:

"23-1. The faces tied with accomplishment and ensuring flights of aircrafts and their maintenance, servicing of air traffic are forbidden to perform such activities of the being able alcoholic, drug, inhalant intoxication (their analogs) or to use the substances causing such intoxication in the course of accomplishment of the obligations.

All owners of certificates which use (used) psychoactive agents, come to light and exempted from accomplishment of the functions influencing safety of flights.";

29, 30 and 31 to state Items in the following edition:

"29. The operator provides accomplishment of flight without safety hazard for AF and the people who are on its board.";

state Item 30 in the following edition:

"30. The operator carries out the program of preparation for safety approved by authorized organization guaranteeing undertaking by crew members of the most correct actions directed to minimizing of effects of acts of illegal intervention. The requirement to the program of preparation for safety is provided in Item 114 of these rules.";

state Item 31 in the following edition:

"31. The operator provides that in transit passengers or load the emergency environment or failures of systems, the equipment and devices were not imitated.";

state Item 39 in the following edition:

"39. The operator is allowed to make the international airborne transportations of military forming, arms and military equipment, and also products of dual purpose on the territory or over the territory of foreign state, only after approval of authorized body in the field of civil aviation and the state in which airspace flight will be performed.";

state Item 45 in the following edition:

"45. The dangerous goods allowed for transportation by civil AF is specified in Instructions for transportation of dangerous goods by air on the civil aircrafts approved by the order of the Minister of investments and development of the Republic of Kazakhstan of June 21, 2017 No. 371 (it is registered in the Register of state registration of regulatory legal acts for No. 15370).

The admission of operators to transportation of dangerous goods is performed according to provisions of paragraph 5 of Chapter 19 of these rules.";

state Item 52 in the following edition:

"52. The operator provides:
