About grapes, wine and products of wine growing
(In edition of the Laws of Ukraine of 18.06.2024 No. 3817-IX, 27.03.2025 of No. 4341-IX)
This Law governs the legal and organizational relations connected with conducting wine growing, implementation of production and realization of grapes, wine and other products of wine growing, products of wine flavored, determines features of preparation for registration, use and protection of geographical instructions concerning the wines, products wine flavored and also features of control concerning such geographical instructions.
1. In this Law the following terms are used in the following value:
1) wine - the alcoholic drink received by complete or partial spirit fermentation of previously crushed or not dissolved fresh grapes or must grape with the actual fortress on amount at least 9% about., general durability on amount no more than 15% about., general acidity 3,5 of gram or 46,6 of milliekvivalent on 1 liter of ready-made product there is at least if other is not provided by this Law.
For wine with the registered geographical specifying (the name of the place of origin) the actual fortress on amount of at least 4,5 of % is allowed about., and for the wine made only from the grapes gathered in the zones of wine growing established by specially authorized body, corresponding to zones of wine growing of A and B on classification of the European Union - % 8,5 suffices about.
General fortress on wine amount with the registered name of the place of the origin made without enrichment or using partial concoction according to this Law can exceed 15% about. in the cases established by the specification. General fortress on amount of the wine made without enrichment in the geographical wine-making territories determined by specially authorized body cannot exceed 20% about.;
2) the wine flavored - alcoholic drink with the actual fortress on amount from 14, % about. to 22% about. and general durability on amount % 17,5 suffices about., received from one or several such products: the must is grape which fermentation is stopped by alcohol addition, wine (except retsina), wine gassy, sparkling wine, selected sparkling wine, selected sparkling wine aromatic, wine liqueur, wine semi-gassy, wine half-acne which content constitutes at least 75% of total amount to which can be added alcohol, food dyes, must grape, the must which grape is partially fermented sweeteners;
3) wine gassy - the alcoholic drink received from wine without the registered geographical specifying which when opening reservoir in which it is poured releases the gas of dissolved carbon dioxide having fully or partially unnatural origin (was added) and which because of availability of carbon dioxide has excessive pressure at least 3 bars, in case of the storage condition at temperature of 20 °C in the closed reservoir;
4) sparkling wine - alcoholic drink, general fortress on volume fraction of alcohol in the cuvee intended for its development constitutes at least 8,5 of % about., received by primary or secondary spirit fermentation from the crushed or not dissolved fresh grapes, must grape or wine which when opening reservoir in which it is poured, releases the gas of dissolved carbon dioxide formed only as a result of fermentation and which because of availability of carbon dioxide has excessive pressure at least 3 bars, in case of the storage condition at temperature of 20 °C in the closed reservoir;
5) selected sparkling wine - alcoholic drink, general fortress on volume fraction of alcohol in the cuvee intended for its development constitutes at least 9% about., received by primary or secondary spirit fermentation from fresh grapes, must grape or wine which when opening reservoir in which it is poured, releases the gas of dissolved carbon dioxide formed only as a result of fermentation and which because of availability of carbon dioxide has the excessive pressure of at least 3,5 of bar, in case of the storage condition at temperature of 20 °C in the closed reservoir;
6) selected sparkling wine aromatic - alcoholic drink with the actual fortress on amount at least 6% about. and general durability on amount at least 10% about., the cuvee received by primary or secondary spirit fermentation, mashes grape or mashes grape in the course of the fermentation received from aromatic grades of grapes which when opening reservoir in which it is poured release the gas of dissolved carbon dioxide formed only as a result of fermentation and which because of availability of carbon dioxide have excessive pressure at least 3 bars, in case of the storage condition at temperature of 20 °C in the closed reservoir;
7) the overripe grapes wine - alcoholic drink with the actual fortress on amount at least 12% about., general durability on amount at least 15% about., natural durability on amount at least 15% about., which is made from the overripe grapes without enrichment;
8) faded grapes wine - alcoholic drink with the actual fortress on amount at least 9% about., general durability on amount at least 16% about., natural durability on amount at least 16% about., which is made without enrichment from the grapes subjected to partial dehydration in the sun or in shadow, content of sugar in which constitutes no more than 272 grams on 1 liter of ready-made product;
9) fortified wine for distillation - alcoholic drink with the actual fortress on amount at least 18% about. and no more than 24% about., received only by addition to the wine which is not containing residual sugar, not rectified distillate received by distillation (distillation) of grape wine with the maximum actual strength of 86% about., content of volatile acids in which constitutes no more 1,5 of gram on 1 liter in terms of acetic acid;
10) wine liqueur - alcoholic drink with initial natural fortress on amount at least 12% about., the actual durability on amount from 15% about. to 22% about., general durability on amount % 17,5 suffices about., received from wine and/or must grape in the course of fermentation to which add: alcohol neutral wine, in particular alcohol from faded grapes with the actual fortress on amount at least 96% about., and/or distillate of wine or distillate of wine from faded grapes with the actual fortress on amount from 52% about. to 86% about., and/or the must grape concentrated, mix of alcohol of neutral grape origin, including the alcohol received by way of distillation of wine from faded grapes with the actual fortress on amount at least 96% about., and/or distillate of wine or distillate of wine from faded grapes with the actual fortress on amount from 52% about. to 86% about. and for certain wines with geographical specifying (the name of the place of origin) - it is received from must grape or its mixes with wine.
Other components also can be added to liqueur wine with geographical specifying, namely:
alcohol neutral of grapes, including the alcohol received by way of distillation of wine from faded grapes with the actual fortress on amount at least 96% about. and/or distillate of wine or distillate of wine from faded grapes with the actual fortress on amount from 52% about. to 86% about.;
alcohol wine or the alcohol received by way of distillation of wine from faded grapes with the actual fortress on amount from 95% about. to 96% about., and/or distillate wine or distillate from grape residue with the actual durability on amount from 52% about. to 86% about., or the distillate received owing to distillation of product of spirit fermentation of extract of raisin with the actual durability on amount from 52% about. to % 94,5 about.;
must grape partially fermented from faded grapes and/or the must grape concentrated, received by direct heating, meeting all other requirements to must grape concentrated, except this transaction, and/or must grape concentrated;
mix of must grape in the course of fermentation with must grape or mix of must grape in the course of fermentation with wine and with one of the following products: alcohol wine or the alcohol received by way of distillation of wine from faded grapes with the actual fortress on amount from 95% about. to 96% about., distillate wine or distillate from grape residue with the actual durability on amount from 52% about. to 86% about., the distillate received owing to distillation of product of spirit fermentation of extract of raisin with the actual durability on amount from 52% about. to % 94,5 about.;
11) wine young in the course of fermentation - wine in which spirit fermentation did not come to the end yet and which is not separated wine deposit yet;
12) wine semi-gassy - alcoholic drink with the actual fortress on amount at least 7% about., general durability on amount at least 9% about., received from wine, wine young in the course of fermentation, must grape or mashes grape in the course of fermentation which after opening of reservoir in which it is poured releases gas of the carbon dioxide having fully or partially unnatural origin it (was added) and which because of availability of dissolved carbon dioxide has excessive pressure from 1 bar to 2,5 of bar, in case of the storage condition at temperature of 20 °C in the closed reservoir and which is stored in reservoirs by amount no more than 60 liters;
13) wine semi-sparkling - the alcoholic drink received from wine, wine young in the course of fermentation, must grape or mashes grape in the course of the fermentation having the actual durability on amount at least 7% about., general durability on amount at least 9% about., the excessive pressure at least 1 bar and no more 2,5 of bar in case of storage at temperature of 20 °C in the closed reservoirs caused by content formed only in the course of fermentation of dissolved carbon dioxide in solution, is also stored in reservoirs by amount no more than 60 liters;
14) grapes - berries of bush plant of family of grape (Vitaceae), mature or partially withering, used for production of products of wine growing, suitable for crushing or pressing and for the spontaneous beginning of spirit fermentation;
15) wine growing - set of organizational and processing methods of reproduction, cultivation and cleaning of grapes;
16) grape juice - liquid product, unfermented, but suitable for fermentation, with the actual durability on amount no more than 1% about., received from grapes or must of the concentrated grape juice or the concentrated must, grape by recovery, grape and processed for suitability to the use;
17) winemaking - set of organizational and processing methods of production of products of winemaking;
18) the producer of wine - the producer of product of wine growing, the producer of product of winemaking;
19) the producer of grapes - the physical person or legal entity which is owner or the user of the parcel of land on which grows up grapes processes the site of grapes, reaps grapes crop for the purpose of its further conversion in products of wine growing or realization for further conversion in wine growing products;
20) the producer of product of wine growing - the physical person or legal entity performing economic activity in the field of wine growing and winemaking namely conversion of grapes, must of the grape or young wine which is in process of fermentation in product of wine growing and/or product of winemaking for the purpose of its further realization or flood in consumer pack;
21) the producer of product of winemaking - the physical person or legal entity performing economic activity in the field of wine growing and winemaking namely endurance of product of wine growing after process of fermentation and/or processing of product of wine growing and flood of product of winemaking, or only winemaking product flood in consumer pack;
22) endurance - engineering procedure of maturing of product of winemaking in the reservoirs determined by the legislation in the field of wine growing and winemaking during the certain period of time for ensuring natural process of certain reactions as a result of which the product of winemaking acquires the improved organoleptic characteristics or happens its complete or partial physical and chemical stabilization;
23) geographical specifying of wine - the name, including the traditional name identifying winemaking product, the must grape which is partially fermented, coming from certain geographical place (the country, the region, the settlement, the area, etc.), has the special quality, reputation or other characteristics caused mainly by this geographical place of its origin provided that at least 85% of the grapes used for production come only from this geographical place, all production phases are performed in certain geographical place and from grapes grades, belonging to type grapes this (Vitis vinifera) or to hybrid grades of type grapes this (Vitis vinifera) and other type of sort grapes (Vitis).
For the purposes of this Item it is necessary to understand any and all production phases as production phase, from harvesting before completion of production processes of ready wine, except any post-production processes and except harvesting of grapes of no more than 15% of total amount of the grapes coming from this geographical place;
24) geographical specifying of product of wine flavored - the name, including the traditional name identifying the product wine flavored coming from certain geographical place (the country, the region, the settlement, the area, etc.), has the special quality, reputation or other characteristics caused mainly by this geographical place of its origin;
25) the site of grapes - the parcel of land of agricultural purpose the area is at least hectare 0,1 set with grapes bushes for production of products of wine growing and/or for the experimental purposes and/or for reproduction of grapes;
26) Commission of experts - the commission formed by specially authorized body with research purpose and approvals of specifications of the wine/product flavored wine with geographical specifying;
27) enologichesky practice - the technological transaction applied (carried out) to grapes, wine growing products, winemaking products under the conditions determined by this Law;
28) the single document - the document on geographical specifying in which basic provisions of the specification of wine/product wine flavored and the description of communication of product with the geographical circle or the geographical place of its origin are stated;
29) general fortress on weight - general concentration of alcohol on weight: the amount of the actual and potential fortress on mass fraction of alcohol or the amount of the actual and potential concentration of alcohol on weight;
30) general fortress on amount - general concentration of alcohol on amount: the amount of the actual and potential fortress on volume fraction of alcohol or the amount of the actual and potential concentration of alcohol on amount;
31) the applicant - person or consolidation of persons who addressed for approval of the specification for application for geographical specifying of wine/product wine flavored and/or submitted the corresponding application;
32) wine growing zone - the geographical vinogradarsko-wine-making territory classified by the amount of active temperatures and ecological conditions on which the enologichesky practicians permitted for this zone taking into account the restrictions determined for this zone can be applied;
33) categories - the types (types) of products of wine growing, products of winemaking, products determined by this Law wine flavored, classified based on physical, chemical and/or organoleptic characteristics, structure of such products and method of their production;
34) cocktail of vinosoderzhashchiya flavored - alcoholic drink with the actual fortress on amount from % 1,2 about. to 10% about., received from one or several such products: wine (except retsina, wines with alcohol addition), wine gassy, sparkling wine, selected sparkling wine, selected sparkling wine aromatic, wine liqueur, wine young in the course of fermentation, wine semi-gassy, wine half-acne, must grape, the must which grape is partially fermented which content constitutes at least 50% of total amount is allowed addition of food dyes, must grape, the must which grape is partially fermented, sweeteners, without alcohol addition;
35) the concentrated grape juice - not caramelized grape juice with the actual fortress on amount no more than 1% about., received by way of partial removal from grape juice of water by any method permitted according to the legislation in the field of wine growing and winemaking, except direct heating for which the refractometer indicator at temperature of 20 °C constitutes at least 50,9 of %;
36) blending - technological transaction of preparation of blend, mix in certain ratio of the wines and/or grape mashes differing by the form, to geographical origin, grapes grade, year of harvesting;
37) cuvee must grape, wine or mix of mashes grape and/or wines with different characteristics, intended for production of sparkling wine, selected sparkling wine, selected sparkling wine aromatic;
38) marketing year - the period of production and/or sales of products of wine growing, winemaking products which begins on August 1 the previous calendar year and comes to an end on July 31 the current calendar year;
39) International standards - the technical requirements to production of products of wine growing, winemaking products stated in the International enologichesky code, the International code enologichesky the practician of the international organization of wine growing and wine (Organisation Internationale de la vigne et du vin-OIV);
40) the name of the place of origin of wine - type of geographical specifying, the name, including the traditional name identifying winemaking product, the must grape which is partially fermented the wine flavored, coming from certain geographical place (the country, the region, the settlement, the area, etc.), has the special quality, reputation or other characteristics caused only or mainly by the specific geographical circle with natural and human factors inherent in it provided that 100% of the grapes used for its production occur exclusively from this geographical, all stages of its production are performed in certain geographical place and from the grades of grapes belonging to type grapes this (Vitis vinifera) or to hybrid grades of type grapes this (Vitis vinifera) and other type of sort grapes (Vitis).

42) natural fortress on amount - general fortress on volume fraction of alcohol in product before any its enrichment;
43) certification body - the company, organization, the organization or their structural division performing activities for certification of wine/product wine flavored according to this Law;
44) deposit wine - remaining balance which accumulates in reservoirs with wine owing to fermentation the applications permitted enologichesky the practician or in storage time or are formed owing to filtering or centrifuging of wine, or accumulate in reservoirs with must grape owing to application permitted enologichesky the practician or in storage time, or are formed owing to filtering or centrifuging of must grape;
45) the official name of product of wine flavored - the name of product category wine flavored, requirements to which are determined by this Law and to which there corresponds such product;
46) the official name of product of wine growing, winemaking product - the name of product category of wine growing, product of winemaking, requirements to which are determined by this Law and to which there corresponds such product;
47) vinegar wine - the product received only by acetic fermentation of the wine having general acidity at least 60 grams on 1 liter in terms of acetic acid;
48) picket - the product received by fermentation of the raw grape residue or lixiviation of the fermented grape residue soaked in water by water;
49) by-products - the remaining balance appearing in production process of products of wine growing, winemaking products;
50) the thrown (thrown) vineyard - vineyard to which within five years the main agrotechnical or ampelotekhnichesky measures for the purpose of receipt of harvest of grapes were not applied;
51) potential durability on mass fraction - number of kilograms of net alcohol which can be received as a result of complete fermentation of the sugars containing in 100 kilograms of product;
52) potential durability on amount (potential durability on volume fraction of alcohol) - number of amounts of net alcohol at temperature of 20 °C which can be received as a result of complete fermentation of the sugars containing in 100 amounts of product at such temperature;
53) representation in the market - any information provided to consumers by means of packaging material, including appearance, form, type (type) of bottle (reservoirs);
54) medicines the aromatic-aromatic products received with use of physical, enzymatic or microbiological processes of the foodstuff including processed and/or from non-food materials of plant, animal or microbiological origin;
55) product wine flavored - the alcoholic drink received from products of wine growing, products of winemaking of the categories determined by this Law and subjected to aromatization;
56) wine growing product - wine, wine gassy, sparkling wine, faded grapes wine, wine from the overripe grapes, fortified wine for distillation, wine liqueur, wine young in the course of fermentation, wine semi-gassy, wine half-acne, selected sparkling wine, selected sparkling wine aromatic, must grape, must from faded grapes, the must grape concentrated, must grape concentrated rectified, must grape partially fermented / must grape in the course of fermentation, vinegar wine;
