About hop and hmeleprodukta
This Law governs the legal and organizational relations in the field of hop-growing and production of hmeleprodukt connected with conducting hop-growing, implementation of conversion of hop, production and realization of hmeleprodukt and also establishes features of certification of hop and the hmeleprodukt, their import and feature of quality control of hop and hmeleprodukt placed in the market.
In this Law the following terms are used in the following sense:
1) the certificate of equivalence - the document issued by foreign certification body in paper or electronic form confirming compliance of hop (hmeleprodukt) to the quality standards equivalent to the standards determined by the legislation in the field of hop-growing and production of hmeleprodukt;
2) altered hmeleprodukt - product of conversion of hop which does not contain alpha acids in steady-state condition;
3) the producer of hmeleprodukt - the subject of managing (the legal entity or the physical person - the entrepreneur) performing activities for conversion of hop and production of hmeleprodukt;
4) producer of hop - the subject of managing (the legal entity or the physical person - the entrepreneur) performing activities for cultivation, preparation, storage or realization of hop. The producer of hop can be producer of hmeleprodukt;
5) hop granule - small dense lump spherical cylindrical or squared, made from the crushed female hops;
6) hop extract - hmeleprodukt, received by way of allocation of concentrate from cones or granules of hop;
7) the closed operating cycle - the process of preparation or conversion of hop (hmeleprodukt) performed under observation of employees of the certified center by method which makes impossible addition or extraction of additional amount of hop (hmeleprodukt) during such cycle. The closed operating cycle begins with opening of sealed packaging of the unprepared or prepared hop which needs to be prepared either for conversion, or for the processed hop product, and comes to an end with sealing of the packaging containing the prepared hop or hmeleprodukt;
8) mixed hmeleprodukt - mix of two or more hmeleprodukt from different batches;
9) izomerizovanny hmeleprodukt - altered hmeleprodukt, in which alpha acids almost completely of izomerizovana;
10) foreign certification body in the field of hop-growing and production the hmeleproduktov-company, organization, the organization or their separate division having the right to issue certificates on hop (hmeleprodukta) or certificates of equivalence according to requirements of the legislation of foreign state which are introduced in the list of foreign certification bodies;
11) competent authority - the central executive body realizing state policy in spheres of safety and separate quality factors of foodstuff, quarantine and protection of plants;
12) the concentrated hop-hmeleprodukt powder received by effect of solvent on hop powder;
13) marking of hop (hmeleprodukt) - the words, the description, sign for goods and services (trademark), graphical representation or symbol placed on packaging, the label (sticker), and in the absence of packaging - in the document or the message accompanying hop (hmeleprodukt) also allows to identify it;
14) not changed hmeleprodukt - product of conversion of hop in which alpha acids and other components of hop are in not changed form (not changed condition);
15) unprepared hop - the fresh-gathered hop which is previously dried up and packed;
16) batch of hop (hmeleprodukt) - the number of packagings of hop (hmeleprodukt) with identical characteristics which are at the same time given for certification by one producer of hop (hmeleprodukt);
17) the list of areas of cultivation of hop - the list of administrative and territorial units within which hop which affirms the central executive body providing forming and implements the state agrarian policy, for the purposes of certification of hop (hmeleprodukt) can be grown up;
18) hop conversion - production of hmeleprodukt from female hops for further use;
19) hop preparation - set of the processes including ventilation of female hops before drying, drying, otlezhivaniye (conditioning on humidity), pressing and packaging of female hops without their destruction;
20) the prepared hop - the hop which passed preparation stage;
21) hop powder - not altered hmeleprodukt in the form of the crushed and floured female hops;
22) the Register of the certified centers performing issue of certificates on hop (hmeleprodukta) (further - the Register of the certified centers), - the information and communication system intended for collection, accumulating, protection, accounting, reflection of processing and providing information on the legal entities having the corresponding accreditation and authorized to perform issue of certificates on hop (hmeleprodukta);
23) fresh-gathered hop - the female hops separated stalk and leaves of plant of hop;
24) the certificate on hop (hmeleprodukta) - the document issued by the certified center in paper or electronic form confirming compliance of hop (hmeleprodukt) to requirements of the legislation in the field of hop-growing and production of hmeleprodukt;
25) the certified center company, organization, the organization or their separate division authorized by competent authority on carrying out certification of hop (hmeleprodukt) and entered in the Register of the certified centers;
26) certification of hop (hmeleprodukt) - the procedure of confirmation of conformity of hop (hmeleprodukt) to requirements of the legislation in the field of hop-growing and production of hmeleprodukt performed by the certified center;
27) hmeleprodukt - the product received as a result of hop conversion, including not changed hmeleprodukta, modified hmeleprodukta and izomerizovanny hmeleprodukta;
28) hop - the dried-up inflorescences known as cones of female plant of hop (Humulus lupulus);
29) hop without seeds - hop with the content of seeds which is not exceeding 2 percent of its weight;
30) hop with seeds - hop with the content of seeds exceeding 2 percent of its weight.
1. Operation of this Law extends to the subjects of managing performing activities for cultivation, processing, conversion, certification, storage, realization, export and import of hop (hmeleprodukt) taking into account provisions of part two of this Article.
2. Provisions of this Law are applied to the goods carried to goods items 1210 10 00, 1210 20 and 1302 13 00 according to UKTVED. At the same time provisions of the Section IV of this Law (except Article 16) do not extend on:
1) the hop collected on the parcel of land which is in property or use of the subject of managing - producer of the beer used by such producer of beer in the natural or processed condition.
Provisions of this Item are not applied if the hop collected on the parcel of land located outside customs area of Ukraine;
2) the hmeleprodukta made under the contract by request of the subject of manufacturing managing of beer provided that they are used directly by such producer of beer;
3) the hop and hmeleprodukta which are packed up for sale to physical persons for own use with indication of hop grade (type of hmeleprodukt) and packaging weight. At the same time the weight of packaging cannot exceed:
5 kg - for female hops, granules or powder of hop;
1 kilogram - for extract of hop and izomerizovanny hmeleprodukt;
