About measures for creation of legal conditions for activities of banks of the Kyrgyz Republic in foreign states
For the purpose of creation of legal conditions for activities of banks of the Kyrgyz Republic in foreign states and increases in competitiveness of banking sector in the international financial markets, being guided by Articles 66, 71 Constitutions of the Kyrgyz Republic, I decide:
1. To National Bank of the Kyrgyz Republic (further - National Bank) taking into account need of ensuring financial stability of banking sector, safety of means of investors and proper level of banking supervision in three-months time:
1) to carry out work on enhancement of the regulatory legal acts regulating activities of banks of the Kyrgyz Republic (further - banks) in foreign states;
2) to establish requirements for annual capitalization of the banks performing activities in foreign states at the level necessary for ensuring safe and uninterrupted activities of banks;
To bring 3) in accordance with the established procedure in the Cabinet of Ministers of the Kyrgyz Republic of the offer on introduction of amendments to the legislation of the Kyrgyz Republic for implementation of this Decree.
2. Recommend to the banks which opened branches in foreign states:
1) to perform activities with observance of requirements of the bank law of the Kyrgyz Republic, the legislation of the Kyrgyz Republic in the field of counteraction to financing of criminal activities and to legalization (washing) of the criminal income, and also legislations of foreign state of stay and sanctions requirements and restrictions in foreign jurisdictions;
2) to provide completeness and reliability of information on activities of branch provided in National Bank in the foreign state according to the procedure established by the legislation of the Kyrgyz Republic.
3. To impose control of execution of this Decree on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.
