About approval of the Regulations on procedure and conditions of bank support of the purchase agreements signed by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies

For the purpose of increase in efficiency and transparency of execution of the purchase agreements signed by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

1) Regulations on procedure and conditions of bank support of the purchase agreements signed by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies according to appendix 1;

2) the List of banks, authorized to perform bank support of the contract in the field of public procurements, according to appendix 2.

2. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Standard procedure for the organization and implementation of purchases by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies" of June 10, 2022 No. 301 the following changes:

in the Standard procedure for the organization and implementation of purchases by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies, approved by the above-stated resolution:

- to declare the subitem 5 of Item 14 invalid;

"72. In case of compliance of the signed purchase agreement to conditions of application of bank maintenance to the customer it is necessary to include in the tender documentation and the purchase agreement of regulations on bank maintenance.

73. Bank support of purchase agreements can not be applied to the certain customers determined by the Cabinet of Ministers of the Kyrgyz Republic.";

- declare Item 77 invalid.

3. To the authorized state bodies performing shareholder rights, to the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies to take the measures following from this resolution, directed to application of bank support of the purchase agreements corresponding to the conditions of application of bank maintenance specified in appendix 1 to this resolution including the conclusion with authorized banks of agreements on bank maintenance.

4. To the state agency on management of state-owned property under the Cabinet of Ministers of the Kyrgyz Republic to take measures for ensuring bank support of purchase agreements according to this resolution, and also to inform the buying organizations the standard conditions about bank maintenance which are subject to inclusion in the tender documentation about purchase.

5. This resolution becomes effective after ten days from the date of official publication.

Chapter 1. General provisions

1. This Provision determines procedure and conditions of implementation of bank support of purchase agreements (further - the agreement, agreements) the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies (further - the customer, customers).

2. Bank maintenance is applied to the agreements, the corresponding conditions specified in Chapter 3 this provision. Customers have the right to apply bank maintenance at discretion as well to other agreements which are not answering to the conditions established in Chapter 3 this provision.

3. The terms and determinations used in this Provision mean the following:

1) authorized bank - bank, authorized to perform bank support of the agreement in the field of public procurements;

2) the request for bank maintenance - the request provided by the customer in authorized bank according to the procedure, the established agreement on bank maintenance, for the purpose of the organization of bank support of the specific accompanied agreement and containing the parameters of bank maintenance determining conditions of bank support of the accompanied agreement;

3) the contractor - the supplier who signed the relevant accompanied contract with the customer;

4) parameters of bank maintenance - the conditions of ensuring monitoring and control of target use of money determined by the customer in the request for bank maintenance within the calculations performed in course of execution of the accompanied agreement by the contractor and participants of implementation of the accompanied agreement on separate accounts;

5) the "Interactive Reporting of Bank Maintenance" service - the digital service of bank maintenance intended for display of statistics of bank support of the agreement, and also report generation, access to which is provided by authorized bank;

6) the accompanied agreement - the agreement signed between the customer and the contractor, containing condition about bank support of the agreement;

7) the contract - the agreement signed for the purposes of execution (realization) of the accompanied contract between the contractor and the participant of implementation of the accompanied contract or between participants of implementation of the agreement;

8) participants of implementation of the accompanied agreement - persons (collaborators, subcontractors, subsuppliers) involved for the purpose of implementation of the accompanied agreement who according to parameters of bank maintenance shall open separate accounts.

Chapter 2. Participants of bank maintenance

4. Participants of bank support of the agreement are:

1) customer;

2) contractor;

3) the participant of implementation of the accompanied agreement;

4) authorized bank;

5) authorized body.

5. The authorized body realizes the powers according to the provisions established by the legislation including, but without being limited, develops the requirements to documentation on purchase providing bank support of the agreement, standard forms of the accompanied agreement, standard form of the agreement on bank support of the contract.

6. Bank support of the agreement is performed by authorized bank based on the agreement on bank maintenance signed with the customer. The authorized bank shall sign the agreement on bank maintenance with the customer, provide bank maintenance concerning the accompanied agreements, and also opening and maintaining separate accounts to the contractor and participants of implementation of the accompanied agreement according to this Provision and the agreement on bank maintenance. Bank support of the agreement is performed by authorized bank gratuitously.
