About transport-forwarding activities
According to Items 1, of 10, 13 and 23 parts I of article 94 of the Constitution of the Azerbaijan Republic this Law determines legal, organizational and economic basis of transport-forwarding activities in the territory of the Azerbaijan Republic, regulates activities of state bodies (organizations), and also legal entities, branches and representations of foreign legal entities (further referred to as with legal entities) and individual entrepreneurs in this sphere, and also the relations arising between them.
1.1. The basic concepts used for the purposes of this Law have the following values:
1.1. carrier - the legal entity or the individual entrepreneur performing cargo hauling from the place of its departure to the destination based on the transportation agreement of load and for a fee, and owning, leasing or using vehicles;
1.1.2. the freight forwarder - the legal entity or the individual entrepreneur providing the transport-forwarding services determined based on the transportation agreement and forwarding, at the expense of orders and means of the client or organizing their provision through the third parties;
1.1.3. the remuneration paid to the freight forwarder - the money paid by the client for agreement performance of transportation and forwarding by transfer into the bank account of the freight forwarder;
1.1.4. the client - legal entity or physical person which personally or through the representative issues the order for rendering the transport and forwarding services determined based on the agreement on transport and forwarding services or for the organization of their rendering through the third parties and is user of transport and forwarding services;
1.1.5. transport-forwarding activities - the business activity performed by the freight forwarder on provision of the transport and forwarding services connected with transportation of goods;
1.1.6. participants of transport-forwarding activities are clients, freight forwarders, carriers and other legal entities and physical persons participating in implementation of transport-forwarding activities;
1.1.7. transport-forwarding services - the services provided by freight forwarders, connected with the organization and (or) implementation of transportation of goods by one or several modes of transport based on the agreement on transport and forwarding services;
1.1.8. load - the goods or non-commodity goods provided for transportation;
1.1.9. The transport freight document - the document issued by the customer or the freight forwarder, confirming cargo delivery by the customer, and also its acceptance, storage in warehouse and delivery by the freight forwarder.
1.2. Other concepts used in this Law have the values established by regulatory legal acts of the Azerbaijan Republic.
2.1. The legislation of the Azerbaijan Republic on transport-forwarding activities consists of the Constitution of the Azerbaijan Republic, international treaties which participant is the Azerbaijan Republic, the Civil code of the Azerbaijan Republic, the Code of mercantile shipping of the Azerbaijan Republic, the Law of the Azerbaijan Republic "About transport", this Law and other regulatory legal acts of the Azerbaijan Republic regulating this area.
2.2. The relations in the field of transport-forwarding activities in the free economic zone Alyat are governed according to requirements of the Law of the Azerbaijan Republic "About the free economic zone Alyat".
3.1. This Law is applied to the relations arising between participants of implementation of the transport-forwarding activities connected with domestic and international carriages of loads.
3.2. Provisions of this Law are not applied to the following types of activity:
3.2.1. transportation of goods on pipelines and power networks;
3.2.2. transportation, the stipulated in Article 3.2 Laws of the Azerbaijan Republic "About road transport";
3.2.3. transportation of goods, stipulated in Article 3.2 Codes of mercantile shipping of the Azerbaijan Republic;
3.2.4. transportation of the goods acquired through online platforms for private consumption;
3.2.5. transportation of mailings through special postal services.
4.1. Transport-forwarding services are performed based on the agreement on transport-forwarding services signed between the customer and the freight forwarder.
4.2. Legal entities and individual entrepreneurs shall obtain necessary licenses and permissions if it is required by the Law of the Azerbaijan Republic "About licenses and permissions", for implementation of the activities connected with provision of transport-forwarding services and also for the conclusion of the relevant agreements established by this Law and the Civil code of the Azerbaijan Republic.
