About road transport

This Law establishes legal, organizational and economic basis of public conveyances and loads road transport in the territory of the Azerbaijan Republic, governs the relations arising in this sphere between state bodies (structures), carriers and consumers of services in public conveyance and loads road transport.

Chapter I. General provisions

Article 1. Basic concepts

1.0. The basic concepts used in this Law:

1.0.1. the vehicle - the vehicle (consisting of one or several vehicles), set in motion by the motor provided for public conveyance, loads or the special equipment on automobile ways;

1.0.2. road transport - mode of transport by means of which, using vehicles and infrastructure facilities of road transport, are carried out public conveyance and loads;

1.0.3. the organizer of transportations by road transport - the legal entity or physical person concluding on its own behalf or on behalf of the customer of the agreement in connection with public conveyance or loads and also in connection with the organization of transportations by road transport;

1.0.4. transportations by road transport for commercial purposes - the transportations which are carried out based on the transportation agreement of the passenger or load or on other legal causes with performing payment for transportation;

1.0.5. transportations by road transport for economic needs - the transportations which are carried out by legal entities and business owners at own expense the vehicles which are at their disposal for the purpose of transportation of workers or loads. The vehicles used for similar transportations shall be controlled workers of these legal entities or business owners;

1.0.6. infrastructure facilities of road transport - the highways used for public conveyance and loads by road transport, bus stations (bus stations), stops, parkings, terminals and other constructions, and also technical and repair sites and technical repair stations, petrol filling centers, motor transportation parks rendering to vehicles maintenance;

1.0.7. the bus - the vehicle provided for public conveyances, having more than nine places for sitting including the place for sitting of the driver;

1.0.8. baggage - the load packed for transportation, sent by the passenger by means of the vehicle or accompanied with it during trip, permitted to transportation depending on dimensions, weight and properties;

1.0.8-1. the applicant - the legal entity, branch, representation of the foreign legal entity, the individual entrepreneur irrespective of its form of business which addressed to the body (organization) determined by relevant organ of the executive authority for receipt of the permission provided in article 48.1 of this Law;

1.0.9. carrier - the legal entity or the business owner who is carrying out, owning the vehicle by the property right, leases or uses of public conveyance or loads based on for a fee transportation agreement or on other legal causes;

1.0.9-1. the operator of activities for international carriages of passengers and loads road transport (further - the operator) - the legal entity or physical person having the corresponding permission performing international carriages of passengers and loads road transport, answering to the criteria connected with goodwill, financial condition and working experience and also requirements for training level of the driver (drivers);

1.0.9-2. person in charge of the operator - physical person, actually and regularly managing based on the agreement transport activities of the operator, including answering to the criteria connected with working experience;

1.0.10. cabin baggage - the things belonging to the passenger which on the properties, the sizes and weight are allowed to take in interior of the passenger vehicle;

1.0.11. the travel document (ticket) - the document confirming the passenger's right to travel by the bus and the conclusion of the transportation agreement between the passenger and carrier processed in the established form;

1.0.11-1. the payment instrument - the means provided for introduction of payment for travel in electronic procedure by the buses transporting passengers along regular intracity (raionwide) routes;

1.0.12. the passenger vehicle - the vehicle which on the design and the equipped equipment is intended for transportation of people and baggage;

1.0.13. the passenger - the physical person transported based on the document (ticket) granting the right to journey in the vehicle or on other legal causes;

1.0.14. public conveyance - delivery of passengers the vehicle from departure Item to destination;

1.0.15. the order - the agreement governing the relations between the customer of public conveyances or loads road transport and carrier;

1.0.16. the customer - the body which signed in the appropriate order the agreement on accomplishment of public conveyances or loads or the authorized legal entity, and also the legal entity or physical person which signed with carrier the agreement on public conveyance or loads designated by it;

1.0.17. the driver - the person having rights of control of the vehicle, being directly involved in process of transportations, and also representing carrier in appropriate cases;

1.0.17-1. taximeter - the special measuring device intended for the car to taxi or the software with fiscal memory providing accounting of the taxi of distance and down time period overcome by the car, calculation of the amount of fare and informing on it the passenger;

1.0.18. the passenger car taxi - the vehicle equipped with special distinctive marks and taximeter, having no more than nine places for sitting including the place of sitting of the driver;

1.0.19. road transport public - the vehicle used in public conveyances and the loads which are carried out based on the appeal of legal entities or physical persons at the prices approved by the agreement using the regulated or declared tariffs;

1.0.20. load - the goods of commodity or non-commodity assignment accepted by automobile carrier for delivery to destination;

1.0.21. the cargo vehicle - the vehicle which on the design and the equipped equipment is intended for cargo hauling;

1.0.22. the consignor - legal entity or physical person addressed to which shipment is drawn up;

1.0.23. the consignee - legal entity or physical person with power on receipt of load according to the transportation agreement of load road transport or to other relevant documents;

1.0.24. the analog tachograph - the electromechanical control device established on the vehicle for the purpose of continuous registration of all information on movement of the specified vehicle including the overcome distance, motion speed, and also the periods of work and rest of drivers taking into account requirements of article 57-1 of this Law;

1.0.25. the digital tachograph - the electronic control device, established on the vehicle for the purpose of continuous registration of all information on movement of the specified vehicle, including the overcome distance, motion speed, and also the periods of work and rest of drivers taking into account requirements of article 57-1 of this Law;

1.0.26. the card of the digital tachograph - the card with integral chip providing storage of information about the periods of work and rest of the driver, and also other information necessary for work with the digital tachograph;

1.0.27. the takhografichesky card of the driver - the digital card used for storage of the relevant information on the periods of work and rest of the driver and identification of the identity of the driver under control of the vehicle;

1.0.28. the takhografichesky card of operator - the digital card belonging to the operator used for loading from the tachograph of the relevant information on the periods of work and rest of the driver;

1.0.29. the masterful card of the tachograph - the digital card used for installation, check, repair, carrying out testing, calibration of digital tachographs and their maintenance, and also loading of information from the digital tachograph;

1.0.30. the card of the controller for the tachograph - the digital card belonging to the staff of the body (structure) determined by relevant organ of the executive authority, and used for removal from the tachograph of the relevant information on the periods of work and rest of the driver;

1.0.31. the form - the document completed in electronic procedure in information system of the body (structure) determined by relevant organ of the executive authority in which information on passengers in case of irregular passenger traffic is reflected;

1.0.32. the booking count sheet - the document completed in electronic procedure in information system of the body (structure) determined by relevant organ of the executive authority in which it is recorded the sold tickets in regular long-distance (interdistrict) passenger traffic;

1.0.33. service of the order of taxi - the paid service connected with adoption of the order from the face, the person interested to order the taxi car, and transfer to person performing the specified transportations with use of means of telecommunication;

1.0.34. the operator of the order of taxi - the legal entity or the individual entrepreneur rendering services in the order of taxi to persons performing passenger traffic by taxi cars;

1.0.35. the throughput certificate - the permission issued to legal entities or individual entrepreneurs on activities in the field of passenger or goods transportation according to article 13 of this Law;

1.0.36. the throughput card - the card which is appendix to permission, issued to vehicles which are owned by the legal entities or individual entrepreneurs having the throughput certificate on the property right, leases or uses.
