About modification and amendments in the Law "About Approval of the Charter of Rescue Service"

Article 1. Regarding 1 article 2 of the Law of December 16, 2016 No. ZR-232 "About approval of the Regulations on rescue service" (further referred to as with the Law):

1) Items 10 and 11 to recognize invalid;

To add 2) with Items 12-19 of the following content:

"12) violation - abuse of regulations of behavior of the employee of rescue service, requirements of incompatibility or other restrictions, rules of prevention of conflict of interest, abuse of office powers or the influence following from them or exceeding of office powers, and also disciplinary violation (abuse of regulations of office discipline);

Rules of office discipline - the service duties established by the normative order of the head of authorized body or other subordinate regulatory legal acts, non-execution or improper execution of which can result 13) in disciplinary responsibility;

14) authorized body - authorized body of public administration in the field of internal affairs;

15) competent division - the structural division of authorized body responsible for internal security and anti-corruption activities of authorized body and performing formal investigations of abuses of official position or the influence following from them or excesses of office powers, disciplinary violations, and also the investigations provided by this Law;

16) sample for the analysis: samples of blood, hair, excrement;

17) diagnostic test - the inspection which is carried out with use of the corresponding equipment for the purpose of identification in organism of availability of alcohol, drugs or psychotropic (psychoactive) substances;

18) office investigation - consideration of the questions connected with respectability or service duties of the rescue employee, established by the law, other legal acts;

19) newly discovered fact - circumstances which existed at the time of decision making by results of office investigation were not known and could not be known to participants of office investigation, and these circumstances have essential value for permission of case, and also the obvious false expert opinion, obvious incorrect translation of the translator, falsification of proofs which led to decision making by results of the wrong office investigation.".

Article 2. To exclude words from Item 2 of part 5 of article 22 of the Law", and also persons designated for management of inspection check of division".

Article 3. In article 23 of the law:

To exclude 1) from heading of the word "and persons which arrived to inspection";

2) parts 2-5 to recognize invalid.

Article 4. To declare Item 15 of part 4 of article 27 of the law invalid.

Article 6. State article 66-74 of the law in the following edition:

"Article 66. Ensuring office discipline in Service of rescuing

1. The commander (chief) bears responsibility for proper maintenance and strengthening of office discipline among subordinates. For this purpose the commander (chief) shall:

1) to provide awareness of subordinates on the disciplinary rules and effects coming for their violation;

2) to monitor observance of disciplinary rules and office relations by subordinates;

3) to analyze the reasons of already allowed disciplinary violations and to consistently carry out explanatory work among subordinates on their elimination.

2. The acting as the employee (person which is carrying out service duties) appointed by the written order of the director of Rescue service, and also other employees having the right to apply incentive payments and authority punishments perform the right to apply incentive payments and authority punishments.

Chapter 7. Encouragement of the employee of rescue service

Article 67. The encouragement applied to the rescuer

1. The following types of encouragement established by the law of the Republic of Armenia "About civil service" are applied to the employee:

1) rewarding with medal or badge;

2) early assignment of rank.

2. According to the petition of Council of veterans of authorized body or the director of rescue service the head of authorized body can apply:

1) the encouragement types provided by Items 1-4 of part 1 of article 20 of the Law of the Republic of Armenia "About civil service" concerning the retired employee of Service of rescuing;

2) to the retired (reservists) staff of rescue service and other employees, according to provisions of the Law of the Republic of Armenia "About public service", the ranks of rescue service one step higher than reserve rank or rank of class, provided by the Items, "v", "g" or "e" of part 1 of article 14 of the Law of the Republic of Armenia "About rescue service", with addition of the word "honourable" after words "rescue service" are given.

3. The head of authorized body can apply encouragement, stipulated in Item 2 parts 2 of this Article, also to employees of state bodies of other partner states in spheres of emergency situations and civil defense.

4. Types, forms and procedure for delivery of medal and the badge handed to the employee of rescuing are established by the head of authorized body.

5. The encouragement type provided in Item 3 parts of 1 this Article can be applied once during the entire period of service.

6. Several types of encouragement at the same time can be applied to the rescuer.

7. The official, authorized to appoint the employee of rescue service, shall apply encouragement. Provided by the Law of the Republic of Armenia "About public service of" encouragement type "The thanksgiving letter" can be delegated by the order of the head of authorized body of power on application to the employees holding positions in the highest and primary groups of rescue service.

8. Awards for the director of rescue service and his deputies are distributed by the official, the representative to appoint them to posts.

9. The lowered ranks in rescue service are recovered along with cancellation of penalties, irrespective of post.

Article 68. Features of application of encouragement to pupils in full-time courses of educational institution of authorized body

1. The following types of encouragement are applied to the pupils studying according to the educational programs realized for position assignment of rescue service in educational institution of authorized body for the high progress shown during training, excellent accomplishment of service duties:

1) announcement of gratitude;

2) one-time monetary reward;

3) rewarding with souvenir;
