About introduction of amendments to the Law on management of public property and its privatization No. 121/2007
The Parliament adopts this organic law.
Art. I. – In the Law on management of public property and its privatization No. 121/2007 (Official monitor of the Republic of Moldova, 2007, Art. No. 90-93, 401), with subsequent changes, to make the following changes:
1. In Article 2:
state the concepts "property of the public sphere of the state", "property of the private sphere of the state" and "privatization of public property" of the following edition:
"property of the public sphere государства/административно-территориальных units – property, by the nature or according to the law intended for public use or being of public interest and belonging to the state or administrative and territorial units;
property of the private sphere государства/административно-территориальных units – the property which is not relating to the public sphere, but belonging to the state or administrative and territorial units;";
"privatization of public property – the activities including transfer of public property to private property according to this law (privatization) and also transfer to concession, trust management and other activities directed to reducing participation of the state or administrative and territorial units in management of public property;";
after the concept "privatization of public property" to add Article with concept of the following content:
"idle assets – the fixed assets and other non-current assets which are not used in the current activities by bodies of the public power / public organizations on self-government, budget bodies / organizations, independent/autonomous budget bodies, the state/municipal companies and commercial societies with completely or mainly public capital;";
in the concept "list of objects, privatizeable" of the word "in accordance with the established procedure" to replace with the word "Government".
