I ORDER:

1. Bring in the order of the Minister of Water Resources and Irrigation of the Republic of Kazakhstan of April 11, 2025 No. 59-HK "About approval of standard agreements of provision of regulated services" (it is registered in the Register of state registration of regulatory legal acts No. 35972) the following changes and amendment:

state Item 1 in the following edition:

"1. Approve:

1) the Standard agreement on provision of regulated services of water supply in channels, water supply for irrigation (for agricultural producer) according to appendix 1 to this order;

2) the Standard agreement on provision of regulated services in regulation of superficial drain by means of retaining hydraulic engineering constructions, according to appendix 2 to this order;

3) the Standard agreement on provision of regulated services of water supply in channels (for the consumer, not being agricultural producer) according to appendix 3 to this order.";

appendices 1 and 2 to the specified order to be reworded as follows according to appendices 1 and 2 to this order;

add with appendix 3 according to appendix 3 to this order.

2. To provide to department of regulation of tariff policy of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Water Resources and Irrigation of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. The basic concepts used in the Agreement

1. In the Agreement the following basic concepts are used:

1) limit of the Section of balance sheet accessory – the line of the Section of elements of water supply systems and water disposal between owners on the basis of property, economic maintaining or operational management;

2) settlement period – the period determined in the Agreement as the period of time equal to one calendar month from 00:00 o'clock the first day till 24:00 o'clock the last day of month for which calculation by the Consumer for service is made;

3) services of water supply in channels, water supply for irrigation – transportation and distribution of water on conduits (channels, pipelines), and its giving to water users;

4) limit of the Section of operational responsibility – the line of the Section of elements of water supply systems and water disposal on the basis of obligations (responsibility for their operation) established by the agreement of the parties. In the absence of such agreement the limit of operational responsibility is established on limit of the Section of balance sheet accessory;

5) checking – set of the transactions which are carried out by the public metrological service or other accredited legal entities for the purpose of determination and confirmation of conformity of measuring instruments to the established technical and metrological requirements;

6) apportionment point – the place of transfer of water resources from the water user to the water consumer;

7) the water metering device – the technical device intended for commercial accounting of consumption of regulated services, allowed for use according to the procedure, determined by the legislation of the Republic of Kazakhstan;

8) metering station of water – the system of devices (the water counter, flowmeter, the manometer) and devices (shutoff valves, direct sites of pipelines before and after measuring instrument, means of remote data transmission, the regulator of pressure and other types of devices) providing water accounting;

9) the water channel (main, intereconomic, intraeconomic) – the artificial construction intended for transportation of water from water intake to points of water apportionment of the consumer, dumping of waters, regulation of water flows;

10) authorized body in the field of protection and use of water fund (further – authorized body) – the central executive body performing management and cross-industry coordination in the field of protection and use of water fund;

11) specific regulation of water consumption – assigned amount of the consumed water per unit of the made products (on certain amount of the performed work or the rendered service);

12) the payment document – the document constituted on paper or created electronically on the basis or by means of which the payment and (or) money transfer are made;

13) the consumer – the physical person or legal entity using or intending to use regulated services.

Other concepts and terms used in this Agreement are applied according to legal acts of the Republic of Kazakhstan.

Chapter 2. Subject of the agreement
