CONSTRUCTION CODE OF THE REPUBLIC OF KAZAKHSTAN

of January 9, 2026 No. 253-VIII ZRK

This Code governs the public relations connected with implementation of architectural, town-planning and construction activities in the Republic of Kazakhstan, forming of the full-fledged habitat and life activity of the person, planning and development of settlements, the mezhselenny territories, safety of construction objects at all stages of their lifecycle.

Section 1. Basic provisions

Chapter 1. General provisions

Article 1. The basic concepts used in this Code

In this Code the following basic concepts are used:

1) emergency construction object - condition of construction object in case of which its further operation shall be without delay stopped because of impossibility of ensuring safe stay of people in it;

2) author's maintenance - engineering service in architectural, town-planning and construction activities for implementation of maintenance of stage of construction by the author (authors) of the construction project, including for introduction of changes in it;

3) the habitat and life activities of the person - environment in which stays and performs life activity of people. The habitat and life activities of the person includes:

the environment - the set of the conditions surrounding the person, substances and objects of material world including the environment and man-made habitat;

the architectural and landscape circle - space with combination of environment and architectural forms in which the person performs economic activity and other functions. As a rule, it is environment in limits and outside settlements which determines living conditions and psychophysical condition of the person;

the available circle (barrier-free) - the property of construction object, the place of servicing which is allowing to reach freely the place and to use service, and also having the parameters providing opportunity to use service;

the internal circle - the complex of living conditions in premises and work environment in working (production) rooms including social, esthetic, biological, psychological and physical and chemical factors, including natural radiation, external noise, biotic environment, impurity, humidity, structure and movement of air, smells, combustion products, natural and artificial illumination, purity of water and another;

4) executive geodetic surveying - the scheme of the actual stay on the parcel of land of buildings, constructions, engineering communications with binding to systems of exact coordinates and heights;

5) zoning of the territories - division of the territories in case of town-planning planning on functional zones with establishment of types of town-planning use of separate zones and possible restrictions on their use;

6) territorial and transport planning - development planning of transport system of the territory with priority of steady types of city mobility and forming of the barrier-free circle, and also taking into account the operational equipment of the territory and technical cover of ways of messages which including includes floor planning of infrastructure of all modes of transport and trace of route network of transport;

7) initial materials - the materials necessary for development of the project documentation;

8) unique construction object - the construction object and its complexes which are characterized by the special, earlier not applied separately or in total architectural, space-planning, constructive, engineering or technology solutions for which the state regulating documents or interstate standard rates (interstate regulating documents) on designing and construction determining need of development, approval and approval for this construction object of special specifications (special regulations) are not established;

9) the building - the artificial structure consisting from the bearing and protecting designs forming the obligatory land closed amount, depending on functional purpose used for accommodation or stay of people, accomplishment of production processes, and also placement and storage of material values. The building can have underground part;

10) technical inspection of reliability and stability of buildings and constructions - type of expert works as a result of which actual state of buildings and constructions and their elements, reliability and stability, possibility of further operation, receipt of quantitative assessment of the actual indicators of quality of designs taking into account the changes happening in time for establishment of structure and amount of works of major repair, upgrade or reconstruction of construction object, and also change of purpose is determined;

11) design code - set of the requirements and rules directed to forming harmonious and stylistically single architectural appearance of the settlements including concerning placement of elements of improvement, the information and advertizing structures, small architectural forms, non-stationary objects, the non-stationary shopping facilities used for the trading activity and (or) public catering, gardening, lighting, facades, barriers considering features of the developed land;

12) the draft of the detailed layout - the town-planning project developed for separate parts of the territories and functional zones of settlements, and also the territories located outside settlements;

13) the settlement territory - space within the established border (line) of the city or rural settlement;

14) the master plan of the settlement - the town-planning project of comprehensive planning of development and building of the city, settlement, village establishing zoning, planning structure of the settlement and the functional organization of their territory taking into account town-planning regulations, system of transport and engineering communications, gardening and improvement;

15) architectural appearance of the settlement (constituent parts of the settlement) - the space and composition solution of the territory in case of which the arrangement of construction objects, all elements of building, improvement and environment is directed to forming of complete esthetic architecture, the comfortable, available and safe circle;

16) subjects to special regulation and town-planning regulation - objects of architectural, town-planning and construction activities which realization is complicated without establishment of exceptions or introduction of amendments to the commonly accepted rules (procedure) of use of the territories, the territory of the settlement, separate construction object;

17) shabby construction object - condition of construction object in case of which its design, the basis cease to meet the set operational requirements as a result of physical wear;

18) cards of general seismic zoning - the cards constituted for all territory of the country in rather small scale for whom zones with different potential seismic danger which probabilistic estimates are given in peak accelerations of soil and points on scale of seismic intensity are allocated;

19) the individual apartment house - the separate building intended for personal (family) accommodation, no more than three floors high taking into account penthouse and the first floor, being in property of physical person together with economic and other structures and green plantings;

20) individual housing construction - construction of individual apartment houses by persons on the parcel of land assigned to them in accordance with the established procedure by their own forces or by contract method;

21) the territory of individual apartment block - the part of the territory of the settlement used for individual housing construction in complex with subjects to social, cultural and educational assignment, and also engineering and transport infrastructures;

22) interstate examination of projects - obligatory form of examination of the projects which are of interest to two and more State Parties of the international treaty on construction;

23) examination of projects - the expert activities consisting in carrying out the analysis and quality evaluation of construction projects, town-planning projects by establishment of compliance (discrepancy) of project decisions to conditions of initial materials and allowing documents for designing, the stipulated by the legislation Republic of Kazakhstan, and also observance in project solutions and calculations of requirements of town-planning and technical regulations, regulations and provisions of the state and interstate regulating documents;

24) the preproject documentation - the documentation which is preceding development of the project documentation and including programs, reports, reasons, technical and economic calculations, results of scientific research and engineering researches, technological and constructive calculations, sketches, drawings, prototypes, measurements and results of inspections of objects, and also other initial materials and materials necessary for decision making about development of the project documentation and the subsequent projects implementation of construction;

25) the project documentation - set of the textual and graphical records created during designing which includes:

projects of improvement and gardening. Projects of improvement and gardening can be as a part of the construction project;

town-planning projects - the projects containing solutions of comprehensive town-planning planning of the organization, development and building of the territories and settlements or their parts (the general scheme of the organization of the territory of the Republic of Kazakhstan, interregional schemes of territorial development, complex schemes of town-planning planning of the territories, master plans of settlements (the scheme of development and building of settlements), drafts of the detailed layout);

the construction project - the design estimates containing relevant requirements of this Code, and also estimate calculations for the organization and maintaining construction, engineering training of the territory, improvement. Projects of preservation and post-utilization of construction objects also belong to construction projects;

the architectural project - the project of construction of construction object (monument) in which designing participation of the architect is necessary;

26) project activities (designing) - the activities consisting in implementation of complex of the interconnected works on creation of the project documentation;

27) subjects of expert activities in the field of designing - the state expert organization, the expert organizations, and also the experts who are their workers or who are temporarily involved with these organizations as non-staff experts;

28) the expert in the field of designing - the physical person certified according to the procedure, provided by this Code, for implementation of expert works and being on the staff of the state expert organization or one of the expert organizations;

29) the project organization - the individual entrepreneur or the legal entity having the right to implementation of project activities in the procedure established by the legislation of the Republic of Kazakhstan;

30) project management - engineering service in the organization, planning, coordination, control of designing, construction and commissioning of construction objects which can include test authority and author's maintenance;

31) engineering infrastructure - the set of the companies (organizations), construction objects, communications and networks of engineering and utility support creating standard conditions for life activity of people, and also steady functioning of production or the goods circulation and services;

32) engineering services - the services in maintaining test authority, author's maintenance and project management providing preparation and implementation of construction for the purpose of achievement of optimum project indicators;

33) the topographical plan on duty - the digital cartographic basis which is constituent part of the state town-planning inventory and containing data on objects of architectural, town-planning and construction activities, engineering infrastructure, the planned construction subjects, subjects to improvement and street road traffic, transportation network;

34) warranty period - the useful life of construction objects established according to this Code, the Civil code of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan or the agreement throughout which the customer, the contractor (prime contractor) guarantee preserving quality of indicators of construction object according to the state regulating documents, the construction project and the legislation of the Republic of Kazakhstan;

35) preservation - package of measures for ensuring safety and quality characteristics of designs, materials and the equipment of object of construction in progress for temporary suspension of its construction;

36) transport infrastructure - set land (automobile and (or) iron) it is expensive, water (sea and (or) river) means of communication with complex of bridge, tunnel and other transport constructions, intersections and overpasses, the regulating alarm devices, communications, objects of engineering support of work of transport, servicing of vehicles, the moved loads, passengers, safety of road traffic and each participant of road traffic, ensuring functional activities of production and service personnel, storage facilities and the territories, sanitary protection and conservation zones the, and also the lands provided according to the laws of the Republic of Kazakhstan and assigned to the specified means of communication and objects with the real estate objects which are on them;

37) the apartment apartment house - the separate building with the single base on the single indivisible parcel of land with the corresponding purpose consisting of common property of object of condominium which is common ownership, from two and more apartments, non-residential premises having independent exits to the parcel of land adjacent to the apartment apartment house or in other parts of common property of object of condominium;

38) street road net - object of the transport infrastructure which is the part of the territories of settlements limited to red lines and intended for pedestrian traffic, mopeds, electric scooters, bicycles, small electric vehicles, public transport and other motorized vehicles, streamlining of building and laying of engineering communications, and also ensuring pedestrian and transport communications of the territories of settlements as constituent part of their means of communication. Basic elements of street road net are streets, avenues, lanes, drives, embankments, squares, pedestrian zones, sidewalks, pedestrian and bicycle lanes;

39) town-planning space - the territory of town-planning regulation within which any architectural, town-planning and construction activities on which the material habitat and life activities of the person (the population of the country, the region, the settlement, part of the settlement) is created are performed;

40) town-planning documentation - system of interconnected documents (including town-planning projects, the state and interstate regulating documents), necessary for town-planning development planning and building of the territories and settlements or their parts;

41) town-planning activities (town planning) - the activities in town-planning planning of the organization and development of the territories and settlements, their territorial and transport planning and traffic management, determination of types of town-planning use of the territories, complex designing of city and rural settlements including creative process of forming of town-planning space, creation of the town-planning project, coordination of all adjacent Sections of town-planning documentation;

42) town-planning regulations - the modes, permissions, restrictions (including encumbrances, prohibitions and servitudes) uses of the territories (parcels of land) and other real estate objects, and also any admissible changes of their condition established according to the legislation of the Republic of Kazakhstan;

43) the mezhselenny territories - the territories which are outside borders (line) of settlements;

44) the selitebny territory - the part of the territory of the settlement intended for placement of residential, public (public and business) and recreational zones, and also separate parts of engineering and transport infrastructures, other objects which placement and activities do not make the impact requiring sanitary protection zones;

45) construction - artificially created three-dimensional, plane or linear construction object (land, surface and (or) underground, underwater) having natural or artificial space borders and intended for accomplishment of production processes, placement and storage of material values or temporary stay (movement) of people, loads, and also placement (laying, posting) the equipment or communications. The construction can also have art and esthetic, arts and crafts or memorial assignment;

46) national bank of construction projects - the digital resource containing standard projects and the design estimates on construction of the new construction objects which received the positive decision of complex non-departmental examination of construction projects;

47) the state investments into construction (the state investments) - investments into construction of new construction objects, engineering and transport communications, and also reconstruction (expansion, upgrade, modernization) or major repair of construction objects which source are:

means republican and (or) local budgets, including the target funds allocated for budget investments and budget crediting of subjects of the quasi-public sector;

target means of non-state loans under the state guarantee or the guarantee of the state;

means of National fund of the Republic of Kazakhstan;

means of subjects of the quasi-public sector, except for the organizations and legal entities, shareholder (the participant, the trustee) of which is the National Bank of the Republic of Kazakhstan;

means of the autonomous organizations of education.

Means republican and (or) local budgets, directed to joint financing and (or) payment of compensation of investment costs for projects of public-private partnership also belong to the state investments;

48) construction activities (construction) - activities for creation of fixed assets of production and non-productive assignment by construction NOVV_KH and (or) changes (expansions, upgrades, modernization, reconstruction, restoration, major repair) construction objects (their complexes, communications), mounting (dismantle), the related processing and plumbing system, production (production) of construction materials, products and designs, and also implementation of works on preservation of objects of construction in progress and post-utilization of the construction objects which developed the resource;

49) building and construction works - the construction activities including:

earthwork operations and special works in soil;

works on post-utilization (demolition) of construction objects with the structure of temporary engineering networks, roads, storage areas, and also vertical layout of the territory;

construction of the bearing and (or) protecting designs of construction objects (including bridges, transport platforms, tunnels and the subways, overpasses, pipelines, other artificial structures);

special construction and installation works on laying of linear constructions;

structure of outside engineering networks and constructions, and also internal engineering systems;

works on protection and finishing of designs and equipment;

construction automobile and railroads;

mounting of processing equipment, including its assembly and installation in project provision on site continuous operation, individual testing and load test, and also dismantle;

50) the conclusion about quality of building and construction works - the document confirming quality of the performed building and construction works;

51) technology of information modeling of construction objects - set of the technologies, production processes and regulations providing possibility of collective creation and information management about construction object at all stages of its lifecycle;

52) certification of construction objects - the technical procedure of inventory count of the existing building of the urbanized territory located in seismically active zone with the description of the constructive decision, physical and operational condition of construction object and assessment of their seismic stability and constructive vulnerability in inventory count process;

53) construction object - the object of artificial environment in building image or constructions which is resulting effect of construction activities;

54) post-utilization of construction object - complex of works on dismantle and demolition of construction object after the termination of its operation (use, application) with simultaneous recovery and recycling of the regenerated elements (designs, materials, the equipment), and also conversion of the elements and waste which are not subject to regeneration;

55) the acceptance act of construction object in operation - the document confirming completion of construction according to the approved construction project and the state (interstate) regulating documents and complete readiness of construction object for operation;

56) unique number of construction object - the identification eighteen-place number created in the automated digital system of the state town-planning inventory for information collection (data) on construction object from receipt of initial materials and allowing documents for project development of construction, reconstruction (re-planning and re-equipment) before acceptance and commissioning of construction object for the purpose of monitoring of its lifecycle;

57) the plumbing system of construction object (plumbing system) - complex of the engineering systems and engineering devices creating normative or comfortable conditions of accommodation (life), labor activity (stay) of people, providing preserving material values, and also engineering support of processing equipment and production processes;

58) lifecycle of construction object - the consecutive and interconnected stages of existence of construction object, including:

stage of creation of construction object - stage of lifecycle of construction object which includes the following stages of construction object: development of the preproject documentation, designing, construction, acceptance and commissioning, and also major repair and reconstruction;

operational phase of construction object - the stage of lifecycle of construction object covering the actions connected with use of construction object to destination during settlement service life and according to safety level, the established earlier issued permissions and regulations. Includes stages of construction object: content and running repair;

the stage of completion of existence of construction object - lifecycle stage when construction object does not perform the functions any more or does not meet the modern requirements, standards owing to what the stage of post-utilization of construction object is implemented;

59) quality of construction object - set of the characteristics (including esthetic) the final construction object brought to the consumer reflecting the requirements aimed at providing interests and safety of owners (users) and society in general throughout operational phase of construction object;

60) technical complexity of construction object - level of responsibility of construction object on degree of technical requirements to reliability and durability of the bases and designs established by the state and (or) interstate (international) regulating documents depending on functional purpose of construction object, features its the bearing and protecting designs, the number of floors (constructive tiers), seismic danger or others special geological, hydrogeological, geospecifications of the place (area) of construction which are subdivided on:

the first level of responsibility - raised;

the second level of responsibility - normal;

the third level of responsibility - lowered;

61) digital model of construction object - set of information provided electronically on construction object, including three-dimensional models, initial materials, allowing, project, executive and operational documentation;

62) passing of allowing procedures in the field of construction - provision of the right to the subject of architectural, town-planning and construction activities on realization of his intention for construction and (or) change of construction objects (separate parts);

63) lines of regulation of building (the line of building) - the building borders established in case of placement of construction objects with space from red and yellow lines or from lot lines in the absence of the established red and yellow lines;

64) unbuilt areas - lands in borders (line) of the settlement on which there are no construction objects, objects of transport infrastructure, engineering networks and constructions;

65) the built-up territories - the territories with the construction objects located on them which further building is possible by means of post-utilization (demolition) of construction objects;

66) national institute of technical regulation in construction - the legal entity determined according to the procedure, established by this Code, on implementation of activities for development and enhancement of the state regulating documents;

67) the estimated cost of construction - amount of money, necessary for construction, determined in the design estimates (in the presence) based on project materials and estimate regulating documents;

68) object of construction in progress - the construction object which is not accepted in operation according to the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities;

69) red lines - the borders separating the territories of quarters, residential districts, other elements in planning structure of settlements streets (drives, squares). Red lines are applied to regulation of borders of building;

70) interstate standard rates (interstate regulating documents) - the system of normative and technical documents, rules and other mandatory requirements, conditions and restrictions including the interstate construction regulations and sets of rules, interstate standards in construction which are acting on the basis of the international treaties ratified by the Republic of Kazakhstan in the territories of the Republic of Kazakhstan and other state (other states);

71) the automated digital system of the state town-planning inventory - the digital system of the state town-planning inventory providing collection, accounting, registration, introduction (filling), processing, storage, access, provision of information and (or) data, display and distribution of data of the state town-planning inventory;

72) the state expert organization - the legal entity created according to the decision of the Government of the Republic of Kazakhstan in form of business of the republican state company on the right of economic maintaining and performing the activities for examination of projects referred to the state monopoly, and also performing other activities provided by the laws of the Republic of Kazakhstan;

73) the state architectural construction supervision and supervision - the activities of the state bodies exercising the state architectural construction supervision and supervision, directed to the warning, identification, suppression and elimination of violations of the law of the Republic of Kazakhstan of architectural, town-planning and construction activities, and also control and supervision of their observance;

74) the state system of regulating documents (the state regulating documents) - system of regulatory legal acts, town-planning and technical regulations, and also regulating technical documents which provisions provide favorable, safe and other necessary conditions for dwelling and life activity of the person;

75) the schedule of visit of object - the document attached to the notification on the beginning of building and construction works, confirming with the customer the voluntary agreement on visit by the state body exercising the state architectural construction supervision and supervision, construction object in the period of construction according to the approved schedule;

76) the conclusion about object compliance to requirements of fire safety - the document issued by territorial authority of authorized body in the field of civil protection on compliance of the constructed object with mass stay of people and buildings more than twenty eight meters high to requirements of fire safety before their acceptance in operation;

77) the local expert opinion - the conclusion of complex non-departmental examination of construction projects which is drawn up and issued to the customer at each stage of expert maintenance on appropriate sections (parts) of the construction project, except for completion phase of project appraisal of construction;

78) public spaces - the territories and objects which are available or open for the population;

79) fire and technical inspection - type of inspection as a result of which compliance or discrepancy to requirements of fire safety of the constructed objects with mass stay of people and buildings more than twenty eight meters high is determined;

80) restoration - complex of the actions providing preserving and disclosure of historical, architectural and art appearance of historical and cultural monuments on the basis of evidence-based data;

81) expert works - works on examination of the project documentation, carrying out test authority and technical inspection of reliability and stability of buildings and constructions;

82) the expert opinion - the document of the state expert organization or expert organization which is result of conducting complex town-planning examination of town-planning projects and complex non-departmental project appraisal of construction;

83) the expert organization - the legal entity accredited according to the procedure, established by this Code, performing the complex non-departmental examination of construction projects which is not referred by the legislation of the Republic of Kazakhstan to the state monopoly;

84) yellow lines - borders of the most admissible zones of possible distribution of blockages (collapses) of construction objects as a result of earthquakes, other emergency situations of natural or technogenic nature. Yellow lines are applied to regulation of gaps between construction objects;

85) the declaration of conformity - the document which the contractor (prime contractor) certifies compliance of the performed works to the approved construction project and requirements of the state (interstate) regulating documents for complete construction object;

86) architectural and planning task - complex of requirements to assignment, key parameters and placement of construction object on the specific parcel of land (site, trass), and also the mandatory requirements, conditions and restrictions to designing and construction established according to town-planning regulations for this settlement. At the same time establishment of requirements for color scheme and material utilization of finishing of external walls (facades) of construction objects, volume space to the decision according to sketches (conceptual designs) provided by the customer (investor) is allowed;

87) the automated register in the field of architectural, town-planning and construction activities (the automated register) - the component of digital system in the field of architecture, town planning and construction integrated with digital objects of state bodies and other organizations, containing the information about subjects of architectural, town-planning and construction activities according to this Code;

88) self-regulatory organization in the field of architectural, town-planning and construction activities - the single non-profit organization in the form of association (union) or other form of business based on voluntary membership (participation) of subjects of private entrepreneurship.

The self-regulatory organization in the field of architectural, town-planning and construction activities as single non-profit organization of self-regulation is created in the directions determined by authorized body for architecture, town planning and construction;

89) the register of the certified specialists (experts) in the field of architectural, town-planning and construction activities - constantly updated single list of the physical persons which underwent certification;

90) authorized body for architecture, town planning and construction - the central executive body performing management and also within the competence cross-industry coordination in the field of public administration by architectural, town-planning and construction activities;

91) the work of architecture, town planning - the object of copyright and intellectual property of the author (authors) which is result of creative activities in the professional activity of physical persons directed to creation of any object of architecture or forming of town-planning space including the author's intention fixed in the form of digital model, the project documentation, the separate drawing, prototype, the sketch and (or) realized in nature;

92) architectural construction supervision and supervision - the measure directed to observance by subjects of architectural, town-planning and construction activities of the requirements established by the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities;

93) architectural and construction documentation - complex of the documents necessary for the organization of construction (expansion, upgrade, modernization, reconstruction, restoration, major repair, preservation and post-utilization), and also the organizations of engineering training of the territory, improvement, gardening, external design;

94) architectural activities (architecture) - the activities for creation of objects of architecture including creative process of creation of external and internal appearance of construction object, the space, composition, space-planning and functional organization fixed in architectural part of the project documentation for construction (reconstruction, restoration), conducting author's maintenance in case of project implementation of construction;

95) architecture object - construction object in building image, the constructions, their exteriors and (or) interiors, monument, elements of improvement, landscape or landscape gardening art created on the basis of architectural or town-planning projects in which development participation of the architect is necessary;

96) regions (zones) of the increased seismic danger - the areas determined based on cards of seismic microzoning with the possible (expected) seismic impact;

97) cards of seismic microzoning - the cards constituted for the built-up territories of settlements taking into account influence of seismotectonic and local engineering-geological conditions;

98) estimate regulating documents (estimate standard rates) - estimate norms, estimate cost indexes, indexes and other regulating documents on pricing, constructions, necessary for determination of estimated cost, and also benefits and methodical recommendations;

99) the customer - the physical person or legal entity performing activities according to the legislation of the Republic of Kazakhstan. Depending on the purposes of activities by the customer the customer investor of the project (program), the customer (owner) or their authorized persons can act;

100) test authority - engineering service in supervision of construction on all project implementation phases of construction, including quality, cost, acceptance of the performed works and input of construction objects in operation;

101) the technical customer - the legal entity involved by the customer for realization of "turnkey" construction, who is acting on the basis of the contracts with the purpose of ensuring qualified process control of realization of "turnkey" construction at all its stages;

102) technogenic impacts - undesirable or harmful (dangerous) effects on the population, the settlements or the mezhselenny territories caused as a result of economic activity without threat or with threat of emergence of emergency situations of natural and technogenic nature;

103) technogenic disasters - the extreme factors connected with economic activity and which caused:

industrial, transport and other accidents (incidents);

fires, explosions or threat of explosion;

emissions or threat of emission biologically, chemically dangerous or radioactive materials;

sudden collapses of construction objects, communications;

breaks of hydraulic engineering or sewage facilities;

accidents on electrical power and communication life support systems;

104) "turnkey" construction - the complex works on construction of construction object and its input in operation including accomplishment project, prospecting, construction (expansion, upgrade, modernization, reconstruction, restoration, major repair) and other works, and also the delivery of goods, rendering services accompanying the specified works, except for conducting complex non-departmental examination of construction projects and services of test authority;

105) sealing (pointed) building - construction of new buildings or constructions in historically built up territories;

106) the standard project - the design estimates for further repeated use when designing developed within the budget program of authorized body for architecture, town planning and construction;

1. The main activities in the field of architecture, town planning and construction shall provide the state, public and private interests in this sphere:

1) state interests - interests of society in general for providing conditions of sustainable development of regions, cities, rural settlements, active mobility, functioning of life support systems, transport and engineering communications, communication and power, environmental protection, preserving objects of historical and cultural heritage;

2) public concerns - interests of the population of certain regions, cities, rural settlements in providing favorable conditions for accommodation (stay) in this territory, improvements of environmental setting, prevention of dangerous (harmful) impacts as a result of economic and other activity, development of infrastructures of settlements and the territories adjoining to them, preserving objects of historical and cultural heritage, natural landscapes;

3) private interests - interests of physical persons and legal entities in connection with implementation of architectural, town-planning and construction activities on the parcels of land belonging to them.

If architectural, town-planning and construction activities of physical persons and legal entities create impossibility of use, ownership or order belonging to them (used by them) by the construction object (the parcel of land or other real estate), it is subject to restriction according to the laws of the Republic of Kazakhstan.
