About the status of the teacher

This Law regulates the status, protection of the rights, social guarantees and ensuring effective implementation of obligations of the teacher.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) the teacher – person having the average and higher education which is engaged in training and education in educational institutions;

2) the status of the teacher – legal status, honor and advantage, social, economic security and immunity of professional activity of the teacher in society;

3) training of the teacher – process of preparation, advanced training, retraining and certification of the teacher;

4) retraining – post-qualifying education which is carried out for the purpose of development of new specialty.

Article 2. Legislation of the Republic of Tajikistan on the status of the teacher

The legislation of the Republic of Tajikistan on the status of the teacher is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 3. Principles of this Law

This Law is based on the following principles:

1) legality;

2) humanity;

3) protection of the rights, freedoms and legitimate interests of the teacher;

4) regular increase in professional skill of the teacher;

5) ensuring social protection of the teacher;

6) the teacher's cooperation with parents (persons, them replacing) in training process and education;

7) non-interference to professional activity of the teacher;

8) prohibition on involvement of the teacher to the works which are not connected with training process and education;

9) prohibition on not industry check and supervision of activities of the teacher.

Chapter 2. Legal status of the teacher

Article 4. Immunity and honor and dignity protection of the teacher

1. Honor and advantage of the teacher are inviolable.

2. Honor and advantage of the teacher are protected by the state.

3. The actions directly or indirectly directed to humiliation of honor and advantage of the teacher are forbidden.

Article 5. Teacher's rights

In case of accomplishment of professional activity the teacher has the right:

1) to demand from management of educational institution of providing necessary conditions for accomplishment of pedagogical activities;

2) to require respect for the profession from students and their parents (persons, them replacing);

3) to choose forms and training methods according to the state educational standards;

4) to participate in development of educational programs, textbooks and other training materials;

5) to make scientific and pedagogical experiments using innovative technologies and to implement the best practices;

6) independently and objectively to estimate knowledge, skills and ability of students in training process and education;

7) to leave in labor leave according to the legislation of the Republic of Tajikistan;

8) to have medical examination according to the legislation of the Republic of Tajikistan;

9) to be encouraged for creative and inventive innovations in educational activities;

10) to be engaged in commercialization of results of scientific and scientific and technical activities according to the legislation of the Republic of Tajikistan;

11) during pedagogical activities to delay obligatory compulsory military service according to the legislation of the Republic of Tajikistan;

12) to be engaged in individual pedagogical activities in the conditions of educational institutions or at home;

13) to be member of labor union of workers of the sphere for protection of the rights and professional interests according to the legislation of the Republic of Tajikistan;

14) to participate in management of educational institution, including work in councils and the commissions;

15) to be the covered retraining and advanced training;

Not to allow 16) to occupations of persons which do not have relations to training process and education;

17) on reaching retirement age, in case of desire to continue pedagogical activities;

18) to have other rights established by the legislation of the Republic of Tajikistan.

Article 6. Teacher's obligations

The teacher shall:

1) to organize training process and education according to the legislation of the Republic of Tajikistan;

2) not to allow the actions discrediting honor and advantage of the teacher in society;

3) to bring up students in the spirit of patriotism, compliance with law, respect of rights and freedoms of man and citizen, parents, people around, the senior generation, cultural, national and historical values and national shrines;

4) to respect honor and advantage of students and their parents (persons, them replacing);

5) to take necessary measures for education improvement of quality;

6) to follow rules of wearing the recommended clothes in labor activity;

Not to allow 7) in training process and education of promotion of political parties and movements and not to force pupils to assimilation of the political and religious ideas;

8) without prejudice to treat students, irrespective of their nationality, race, floor, language, religion and social position;

9) not to demand from the student of money for study, repair of buildings of educational institution, subscription to editions, carrying out open lessons, birthday of the teacher, the last call, the Teachers' Day, certification upon transition from one class to another and the termination, theater, cinema, works on improvement, purchase of training and methodical materials, visual aids, technical means and other educational accessories;

10) to observe the established criteria of estimation in case of training quality evaluation;

11) to carry out other obligations established by the legislation of the Republic of Tajikistan.

Article 7. Restrictions in pedagogical activities

Pedagogical activities are limited:

1) persons deprived based on court resolution of the right to be engaged in pedagogical activities for life or for certain term;

2) persons having according to the medical certificate mental and psychological diseases;

3) persons using drugs, psychotropic substances, precursors and their analogs;

4) persons who committed crime against sexual freedom and sexual integrity;

5) persons condemned for crimes of terrorist and extremist nature, other heavy and especially serious crimes;

6) persons having diseases which list is approved by authorized state body in health sector and social protection of the population.
