About establishment of detailed regulations of application of provisions of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union

No. 399-410, 679), with subsequent changes, parts (4) and (7) Articles 3, parts (11) Articles 7, parts (13) Articles 8, parts (20) Articles 9, parts (4) Article 10 and Items c) - g) parts (1) article 11 of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union (The official monitor of the Republic of Moldova, 2025, Art. No. 215-222, 259) the DECIDES: Administrative board
1. In pursuance of provisions of parts (4) and (7) article 3 of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union, requirements to the standard offer and the maximum wholesale rates for regulated services of roaming which the operator of guest network in the Republic of Moldova, according to appendix can apply are established.
2. In case of application of provisions of parts (4) and (7) article 3 of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union, suppliers of networks of mobile communication of the Republic of Moldova are also guided by the Guidelines of BEREC on application of Article 3 of Regulations (EU) 2022/612 of April 6, 2022 about roaming in networks of mobile communication public in the territory of the Union (BoR (22) 147 of September 30, 2022 - the Management on wholesale roaming).
3. In case of application of provisions of part (11) Articles 7, parts (13) Articles 8, parts (20) Article 9 and part (4) article 10 of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union, suppliers of networks of mobile communication of the Republic of Moldova will rely on the Guidelines of BEREC according to Regulations (EU) 2022/612 and to Regulations on execution (EU) 2016/2286 Commissions (BoR (22) 174 December, 2022 - the Guidelines on retail roaming).
4. In case of establishment of conditions of wholesale access for the purpose of provision of services of roaming for communication between devices of machine type (M2M) suppliers of networks of mobile communication of the Republic of Moldova will consider the Report of BEREC on M2M and permanent roaming (BoR (24)165).
5. Publish this resolution on the official site of the National agency on regulation in the field of electronic communications and information technologies, to publish dispositive part of this resolution in the Official monitor of the Republic of Moldova.
6. This resolution becomes effective from the date of entry into force of the Law No. 81/2025 on regulation of services of roaming between the Republic of Moldova and member states of the European Union. In order to avoid doubts Item 4.1 of appendix is not applied to average wholesale rates which operators of guest networks in the Republic of Moldova apply to service providers of roaming to provision of regulated services of data transmission in roaming through guest network in the Republic of Moldova before the date of entry into force of this resolution.
