On regulation of services of roaming between the Republic of Moldova and member states of the European Union
The parliament adopts this organic law.
This law partially shifts Regulations of the European parliament and Council (EU) 2022/612 of April 6, 2022 about roaming in networks of mobile communication public in the territory of the Union (in the new edition), published in the Official log of the European Union by L 115 of April 13, 2022, CELEX: 32022R0612.
(1) This law establishes base on regulation of services of roaming between the Republic of Moldova and member states of the European Union, powers of the National agency on regulation in the field of electronic communications (further - the Agency) on enforcement of provisions of this law, the right and obligation of users and service providers of roaming.
(2) This law promotes harmonious functioning of common economic space in the field of electronic communications between the Republic of Moldova and the European Union, providing the high level of consumer protection, data protection, confidentiality and trust, encouraging the competition, independence and transparency in the market, and also providing both measures for stimulation of innovations, and possibility of the choice for consumers and integration for persons with limited opportunities, in case of full compliance with provisions of the European convention on human rights and the Constitution of the Republic of Moldova.
(3) Provisions of this law:
1) are guaranteed:
a) non-admission for users of networks of mobile communication public of the Republic of Moldova during trips within the European Union of increased prices on services of roaming in comparison with the competitive national prices of the incoming and outgoing calls, sending and receipt of Sms and use of data services packet switched provided that for this purpose are created and the conditions equivalent to the provided presents depending on the European Union are applied by the law; and
b) creation and application of the conditions depending on the Republic of Moldova during which users of networks of mobile communication public from the European Union during trips to the Republic of Moldova do not pay increased prices on services of roaming in comparison with the competitive national prices of the incoming and outgoing calls, during the sending and receipt of Sms and use of data services packet switched;
2) conditions of wholesale access to networks of mobile communication public for the purpose of provision of regulated services of roaming are established;
3) increase in transparency and improvement of informing users of services of roaming, including users of non-regulated services of roaming in the third countries, about rates is provided;
4) increase in transparency for users of non-regulated services of roaming in case of connection to not land network of mobile communication public, for example, on circumstances, on board the vessels or aircrafts is provided.
(4) Operation of this law extends as to the wholesale rates levied by operators of networks and for the retail rates levied by service providers of roaming.
(5) If the maximum rates provided by part (4) Articles 3, c) Articles 11, are expressed by Article 7 and Item in the currency other than euro, their values are determined in the corresponding currency by use of average value of the basic exchange rate published by National Bank of Moldova as of January 15, on February 15 and on March 15 the corresponding calendar year. The extreme values of the maximum rates expressed in the currency other than euro are subject to annual revision, since 2026, and are applied since May 15.
(6) the Situation of this law is not affected by the tasks of the Agency and other competent authorities established by the Law on electronic communications No. 72/2025, including obligation on enforcement of Chapter XVII of the specified law.
For the purposes of this law determinations, the stipulated in Article 2 Laws on electronic communications No. 72/2025, and also the following concepts are used:
1) zone of regulated roaming - the zone covering the Republic of Moldova and the European Union;
2) the service provider of roaming - the company providing to the receiver of services of roaming retail regulated services of roaming;
3) the national supplier - the company providing to the receiver of services of roaming of service of national mobile communication;
4) local network - the public communication network located in the country incoming zone of regulated roaming, and used by the service provider of roaming for provision of retail regulated services of roaming to the receiver of services of roaming;
5) guest network - the land network of mobile communication public located in the country in zone of regulated roaming, other than network of the national supplier of the receiver of services of roaming, allowing the receiver of services of roaming to perform outgoing or incoming calls, to send or receive Sms or to use data transmission packet switched on the basis of agreements with the operator of local network;
