According to part ten of article 71 of the Law of Ukraine "About state regulation of production and turnover of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, liquids used in electronic cigarettes and fuel" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for creation and maintaining the Register of addresses of websites of the licensees performing beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion by the enclosed electronic trading (with use of means of remote communication or through online stores).

Procedure for creation and maintaining the Register of addresses of websites of the licensees performing beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion by electronic trading (with use of means of remote communication or through online stores)

1. This Procedure determines the procedure of creation and maintaining the Register of addresses of websites of the licensees performing beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion by electronic trading (with use of means of remote communication or through online stores) (further - the Register), including the mechanism of entering into the Register of data or changes in data concerning addresses of websites, URL addresses, domain names, IP addresses, mobile applications and network addresses which give sales opportunity or on which the offer to sale of such goods (products) by the licensees performing beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes is performed devices for consumption of tobacco products without their combustion by electronic trading (with use of means of remote communication or through online stores) (further - the licensee) based on the current license on the right of implementation of the corresponding type of activity, and exception of such data of the Register.

The register - the information and communication system providing collection, accumulating, protection, accounting, display, processing of register data and provision of register information on addresses of websites of licensees.

2. In this Procedure terms are used in the value given in the Laws of Ukraine "About state regulation of production and turnover of alcohol ethyl, spirit distillates, bioethanol, alcoholic beverages, tobacco products, tobacco raw materials, liquids used in electronic cigarettes and fuel" and "About public electronic registers".

3. The register is kept electronically in state language.

4. Creation and functioning of the Register is performed for means of the government budget, the international technical assistance and other sources which are not prohibited by the law.

5. The owner Reestra, including its program technical means, exclusive property rights on its software the state on behalf of GNS is.

6. Public registrars of the Register are officials of the device GNS.

7. Creator of information containing in the Register is the licensee or person authorized by it which submitted information, and also public registrar by results of carrying out processing (check) of the data of the Unified register of licensees by the official of the device GNS on production and turnover of alcohol ethyl, the spirit distillates, alcoholic beverages, tobacco products, tobacco raw materials and liquids used in electronic cigarettes concerning availability of data on lack of the current license (current licenses).

8. Data based on information on addresses of websites provided in GNS by licensees, URL addresses, domain names, IP addresses, mobile applications and network addresses which give sales opportunity or on which the offer to beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion by electronic trading is performed are entered in the Register (with use of means of remote communication or through online stores).

Information on entering into the Register of data or changes in the data containing in the Register, exception of data of the Register moves in GNS licensees according to the procedure approved by the Ministry of Finance.

9. Data are entered in the Register about:

1) licensees:

for legal entities - the name, the location, code according to EGRPOU;

for physical persons - entrepreneurs-surname, own name, middle name (in the presence), the location (the address of the registered/declared residence (stay) on which communication with physical person is performed - registration number of accounting card of the taxpayer or series (in the presence) and passport number of the citizen of Ukraine (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially reported about it to the relevant monitoring body and have mark in the passport of the citizen of Ukraine), unique number of entry in the Unified state demographic register (in the presence);

for persons authorized on accounting of activities for cooperation agreements without formation of legal entity and persons responsible for content and entering of taxes into the budget during execution of agreements, - the name and code of the authorized person according to EGRPOU and the tax number provided to such person in case of registration of the agreement according to Item 63.6 of Article 63 and Item 64.6 of article 64 of the Tax Code of Ukraine (further - the Code);

for foreign business entities - the name and tax number of permanent mission;

2) the address (addresses) of websites, URL addresses, domain names, IP addresses, mobile applications and network addresses which give sales opportunity or on which the offer to beer sale (except nonalcoholic), alcoholic, low alcohol beverages, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion by electronic trading is performed;
