About establishment and distribution of the tariff quotas, establishment of rates of export customs duties on export of wheat and meslin, barley and corn from the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region

According to articles 3 and 36 of the Law of the Russian Federation "About customs tariff" the Government of the Russian Federation decides:

1. Establish for the term of 1 January till December 31, 2026 the tariff quotas on export from the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, wheat and meslin (codes 1001 19 000 0, of 1001 99 000 0 CN FEA EEU), barley (code 1003 90 000 0 of the CN FEA EEU) and corn (code 1005 90 000 0 of the CN FEA EEU) placed under customs procedure of export (further respectively - the tariff quota, the subject of the Russian Federation, grain crops), in amounts according to appendix No. 1.

2. Establish for the term of 1 January till December 31, 2026 rates of export customs duties on wheat and meslins, barley and corn which is taken out from the territories of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporizhia region and Kherson region out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union according to appendix No. 2.

3. Distribution of the tariff quota is performed by the management official of the subject of the Russian Federation (person, it replacing) or person authorized by it in position not below the vice-chairman of the supreme executive body of the subject of the Russian Federation (further - person authorized on distribution of the tariff quota) in case of the address of participants of foreign trade activity in declarative procedure according to the rules approved by the management official of the subject of the Russian Federation (person, it replacing).

Decisions on distribution of amounts of the tariff quotas are issued by person authorized on distribution of the tariff quota in form according to appendix No. 3 (further - the decision).

Distribution of the tariff quota to the participant of foreign trade activity is performed within amount of the tariff quota taking into account the decisions issued according to the paragraph to the second this Item.

4. The copy of the decision signed by person authorized on distribution of the tariff quota goes to the Ministry of Industry and Trade of the Russian Federation and the Ministry of Agriculture of the Russian Federation within one working day from the date of its signing according to rules, the stipulated in Item 3 presents of the resolution.

5. Use of the tariff quota is performed based on the one-time license for export granted by the Ministry of Industry and Trade of the Russian Federation according to the procedure, established by Rules of licensing in the field of foreign trade in the goods approved by the order of the Government of the Russian Federation of November 18, 2024 No. 1577 "About approval of Rules of licensing in the field of foreign trade in goods" taking into account the features provided by this resolution.

When filling with the participant of foreign trade activity of the statement number and date of the decision are specified licensing for export in the column 17 "Basis for Licensing".

6. Export of grain crops within the tariff quotas is performed during action of the tariff quotas according to the export licenses granted according to Item 5 of this resolution and existing for date of the actual export of grain crops in case of application when placing grain crops under customs procedure of export of features of customs declaring, the stipulated in Clause 102 Federal Laws "About Customs Regulation in the Russian Federation and about Modification of Separate Legal Acts of the Russian Federation".

In case of non-use of the specified features of customs declaring export of grain crops within the tariff quotas is performed according to the export licenses granted according to Item 5 of this resolution and existing on registration date of the customs declaration (the declaration on goods).

7. To the Ministry of Industry and Trade of the Russian Federation from the date of entry into force of this resolution till December 31, 2026 to perform issue to participants of foreign trade activity of export licenses from the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, grain crops within amount of the tariff quota based on the decision.

8. To the Federal Customs Service from the date of entry into force of this resolution to make customs transactions concerning grain crops according to customs procedure of export based on export licenses.

9. This resolution becomes effective since January 1, 2026.
